A RESOLUTION VACATING THE TWELVE FOOT ALLEYWAY BETWEEN
HARRISON AND TYLER AVENUES., BLOCK 40, AVON -BY -THE -SEA
WITHIN THE CITY OF CAPE CANAVERAL, FLORIDA) PROVIDING
AN EFFECTIVE DATE,
WHEREAS, Clifford A. Schill and Beachparkr Inc. has
petitioned the City Of Cape Canaveral# Florida to vacate the
twelve foot alleyway between Harrison and Tyler Avenues in Block
40, Avon -by- the -Sea, and
WHEREAS, the City Council of the City of Cape Canaveral,
Florida has determined that it is in the best interest of the
City to vacate that alleyway,
NOW, THEREFORE, BE IT RESOLVED as follows$
SECTION 1. The City Of Cape. Canaveral, Florida, hereby
vacates the twelve foot alleyway in Block 40, Avon -by- the -Sea,
more particularly described as follow$$
A 12 foot wide alley lying between Lot$ 5o 10, 11, 12, 13,
14, 15 all in Block 40 of AVON -BY -THE -SEA according to the
plat thereof as recorded in plat Book 3 at Page 7 of the
Public Records of Brevard County# Florida. the same being
more particularly described as follows: Begin at the
Southeast corner of said Lot 10, said point, lying on the
Northerly right of Way line of Tyler Avenue, as id right of
way being 48 feet in width as shown an said platf thence run
N87 °47 4 6.E along said Northerly . right of way line for 12.00
feet to the Southwest corner of said Lot 151 thence run
N15 °19'38'E for 258.71 feet to the Northwest corner of said
Lot 11, said point lying on the Southerly right of way Tina'
of Harrison, said right of way being 48 feet in width as
shown on said platithence run 687 °55'38 "W along said
Southerly right of way line for 12.00 feet to the Northeast
corner of said Lot 51 thence run 815'19'38 "W for 256.74 feet
to the POINT OF BEGINNING, said parcel containing 0.1168
acres; more or lese.
SECTION 2. The vacation of this street is contingent upon
-accepting
the city- t*Ve}vkeq a ten -foot utility easement dedicated to the
City of Cape Canaveral, Florida,
' .SECTION 3., It is specifically_ underetood that any _
additional land created by this vacation shall not be considered
in any density calculations.
SECTION 4. This Resolution shall become effective immediately
upon its adoption.

LEGAL DESCRIPTION
A 10 fool wide parking easement lying in the South 10 feet of Block 40
of AVON -BY- THE -SEA, according to the plat thereof recorded In Plat
Book 3 at Page 7 of the Public Records of Brevard County. Florida,
being more particularly described as follows: Commence at the Southwest
corner of Lot 10 In said Block 40; thence run N87 047148 "E along the South
line of said Lot 10, said line being the Northerly right of way line of Tyler
Avenue (sold right of way being 48 feet In width) for 41.24 feet to the
POINT OF BEGINNING of the easement herein described; thence continue
Ne9 "53'00 "E along said right of way line for 196.00 feet to a. point lying on
the Department of Natural Resources Coastal Construction Control Line as
recorded in Survey Book 2A at Pago IIS of the Public Records of Brevard
County. Florida; thence run N1401810YIE along said line for 10,43 feet;
thence run S87 94748 11W parallel with and 10 feet north of by perpendicular
measurement of said Northerly right of way line of Tyler Avenue for 198.96
feet; thence run S020120 11"E perpendicular to sold line for 10.00 feet to the
POINT OF BEGINNING. Said easement contains 1975 square feet, more or less.
NOTE
The bearings shown are based on the coordinates of Florida Department of
Natural Resources Wriuments 70- 80-A04 6 70- 80-AOS as shown on the Florida
Department of Natural Resources Coastal Construction Control Line recorded
in Survey Book 2A at Page 15 of the Public Records of Brevard County, Florida.
