HomeMy WebLinkAboutResolution No. 1984-61RESOLUTION NO. 84 -61 A RESOLUTION REQUESTING THE STATE OF FLORIDA DEPARTMENT OF NATURAL RESOURCES TO REBRAW *REVIEW THE COASTAL CONSTRUCTION .CONTROL LINE IN BREVARD COUNTY AS RAPIDLY AS POSSIBLE; PROVIDING AN EFFECTIVE DATE. WHEREAS, in 1981 the Florida Legislature established the Coastal Construction Control Line Law in an attempt to protect the state's coastal areas from the "unguided development" which results in the destruction and damage of public asset; and WHEREAS, the objective of the current law is to allow as much, freedom of development as possible for the property owner while adequately protecting Florida's beach areas including the dunes and property of the people in these areas; and WHEREAS, the natural profile of a gently sloping beach of adequate width and height is still the most effective method known for dissipating wave energy; and WHEREAS, the dune system with its vegetation is the last of the natural defenses of the beach profile against wave attack and it acts as a levee against high water; and WHEREAS, the dunes serve as a sand . bank which replenishes the beach in times of severe erosion; and WHEREAS, the exchange of sand between the dune -beach system and the offshore bar is a natural process which protects Brevard .County's sandy beaches and should not be interfered with; and .WHEREAS, efforts to control erosion and restore the beauty and usefulness of the beach have met with only partial success; and WHEREAS, Brevard County's Coastal Construction Control Line has not been reevaluated since its establishment. in 1981; and WHEREAS, the recent storm has caused significant recession of the dune, line; and WHEREAS, the need for an additional setback form the Coastal Construction Control Line for all alterations has been identified; and WHEREAS, the Department of Natural Resources, Division of Beaches and Shores, indicated that the Coastal Construction Control -;upended on 12 -04 -84 Resolution No. 84 -61 Page 1 of 2 MICROFIE f ED 4..1.5 -85 in Brevard County is not scheduled for restudy in the near future; and WHEREAS, the Department of Natural Resources, Division of Beaches and Shores has the capacity to assist Brevard County in the analysis of an adequate interim setback from the Coastal Conntruction Control Line; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Cape Canaveral, Florida, as follows: SECTION 1. That the Department of Natural Resources, Division of Beaches and Shores assist Brevard County in the analysis of an *interixt setback from the Coastal Construction Control Line. SECTION 2. The City Clerk is hereby authorized to provide copies of this Resolution to the State of Florida Department of Natural Resources and the Brevard County Board of County Commissioners. SECTION 3. This Resolution shall become effective immediately upon its adoption.
