HomeMy WebLinkAboutResolution No. 1983-55a; RESOLUTION NO. 83 -55 ��'CRCF9Lr4'FD 4-15•$5 A RESOLUTION PRESCRIBING ASSESSMENT CRITERIA TO BE USED IN ASSESSING ABUTTING PROPERTY OWNERS IN THE CITY'S HARBOR HEIGHTS RESURFACING PROJECT; ESTABLISHING METHOD OF PAYMENT; PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED by the City Council of the City of Cape Canaveral, Florida, as follows: SECTION 1. The following prescribed assessment criteria shall be used by the City of Cape Canaveral, Florida, its agents, servants and employees, in assessing abutting property owners in the proposed Harbor Heights Resurfacing Project: A. Assessments shall be levied on all property abutting the improvements and only on those properties. B. Assessable footage shall be measured on the side or sides upon which the assessment is based, determined by the actual amount of frontage contiguous to the improvement. C. For determining the assessment on curved lots, the County Tax Assessor's criteria shall be followed to arrive at front footage. SECTION 2. In the event that the criteria prescribed in Section 1 does not allow for equitable assessment to the benefited properties, any inequities resulting may be adjusted by the City Council sitting as the Board of Equalization at the conclusion of the Harbor Heights Resurfacing Project. SECTION 3. The assessment shall be based on a front footage figure and determined by dividing the entire front footage figure into the total cost of the project. The City shall pay the con- tracted price and shall allow the assessed property owners to repay the assessment fee over a three (3) year period in annual install- ments to include principal and interest as allowed by State Statute, or sooner. SECTION 4. This Resolution shall become effective immediately upon its adoption.
