A RESOLUTION VACATING THE NORTH -SOUTH PORTION
OF BOOTH COURT BETWEEN TRACT 12 AND TRACTS 11
AND 14 OF CHANDLER PARK REPLAT, WITHIN THE
CITY OF CAPE CANAVERAL, FLORIDA; DEDICATION
TO THE CITY OF CAPE CANAVERAL, FLORIDA,.A
10 FT. UTILITY EASEMENT IN THE CENTER OF THE
VACATED STREET; PROVIDING AN EFFECTIVE DATE.
WHEREAS, Innovative Development Corporation has
petitioned the City of Cape Canaveral, Florida to vacate
the North -South portion of Booth Court between Tracts 11,
12 and 14, and
WHEREAS, the City Council of the City of Cape Canaveral,
Florida has determined that it is in the best interest of the
City to vacate that portion of Booth Court.
NOW, THEREFORE, BE IT RESOLVED as follows:
SECTION 1. The City of Cape Canaveral, Florida hereby
vacates the North -South portion of Booth Court between Tracts
11, 12 and 14, more particularly described as follows:
A portion of Booth Court as shown on replat of
Chandler Park, according to the plat thereof
recorded in Plat Book 21 at Page 80 of the
Public Records of Brevard County, Florida, the
same being more particularly described as follows:
Begin at the Southwest corner of Tract 11 thence
N01 °07'50 "W for 287.25 feet to a point on the
South Line of Tract 15; thence West for 50.00 feet;
thence S01 °07'50 "E for 287.06 feet to the Southeast
corner of Tract 12; thence East 50.00 feet to the
Point of Beginning. Said parcel contains 0.33
Acres, more or less.
SECTION 2. The vacation of this street is contingent
upon the City receiving a 10 ft. utility easement dedicated
to the City of Cape Canaveral, Florida.
SECTION 3. This Resolution becomes effective immediately
upon its adoption.
