HomeMy WebLinkAboutResolution No. 1983-21��R ®F1.rv�E,D 4.�5�8� RESOLUTION NO. 83 -21 i1� A RESOLUTION AUTHORIZING THE MAYOR OF THE CITY OF CAPE CANAVERAL, FLORIDA TO ENTER INTO AN ADDENDUM TO THE SEWAGE FRANCHISE AGREEMENT WITH THE CANAVERAL PORT AUTHORITY ADOPTED ON RESOLUTION NO. 70 -14; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Cape Canaveral wishes to equalize impact fees for its residents and the tenants of Port Canaveral; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cape Canaveral, Florida, as follows: SECTION 1. The Mayor and City Clerk are hereby authorized to enter into an addendum to the sewage franchise agreement with the Canaveral Port Authority adopted on Resolution No. 70 -14, a copy of which is attached hereto and made a part hereof by reference. SECTION 2. This Resolution shall become effecti -e immediately upon its adoption. Authority, a body corporate and a body politic under the laws of the State of Florida, hereinafter referred to as "Port ". WHEREAS, the City has more than doubled it's sewage service capacity, and 'WHEREAS, the Sewage Plant expansion allows for additional growth inside both the Port and City,. and WHEREAS, the 'City is encumbering Two million dollars for the sewage plant expansion, and WHEREAS, new development should pay for the expansion NOW, THEREFORE, IT IS AGREED as follows: 1. The Port shall cause any new development which hook- up to the system or any additional tap -on to pay to the City . a sewer impact fee which, shall be calculated in accordance with the presently existing schedule for residents of the City, 'a copy of which is attached.. APPROVED by the Canaveral Port Authority at its regular meeting on the 13th day of April ,,1983, with the undersigned officers executing this Agreement as the duly author - izeddact of the Canaveral Port Authority pursuant to resolution duly adopted at said meeting. CONNECTION ASSESSMENT" TO "SEWER IMPACT ASSESS.,12=11; BY AMENDING 7E1E COMMEICIAL RATE STRLMM; BY ADDING SECTION 535.05 "MODIFYING EXISTING STRLCIVRFS "; REPEALING ALL POR- TIONS OF THE CODE IN CONFLICT HEPEWITH; BY PROVIDING AN EFFECTIVE COTE. BE IT ORDAINED by the City Council of the City of Cape Canaveral, Florida, as follows: SECTION 1. *• The Title of Chapter 535 of the Code of the City of Cape Canaveral, Florida, is hereby changed fram "Sewer Connection Assessment" to "Sewer Impact Assessment ". SECTION 2. Section 535.01 of Chapter 535, entitled "Sewer Connection Assessment ", of the Code of the City of Cape Canaveral, Florida, is hereby deleted in its entirety, and the following new subsection substituted therefor: "Sec. 535.01 Seder Impact Assessment Established. There shall be paid an assessment to defray the cost and expense of transmission and treatment of sewage and related systems and for necessary equipment, repairs, replacemnt and additions and for any new sewer plant expansion for the City of Cape Canaveral, Florida, sewer system on all new construction and all structures initially connecting to the City sewer system in the City as follows: *Each single family dwelling unit $ 1,400 Each residential unit of a multiple family unit, duplex, triplex and/or apartment unit 1,400 Each condominium unit 1,400 Each nubile park space 1,400 Each hotel or notel ram 540 Each av:pgrou:d park space 215.. *All single family dwelling units in excess of 5 bedrooms, shall have an additional charge ca:puted using the Department of Environmental Regulations Technical Information Menora:dum 621 for those . excess bedroom. other r -emirm eiah•- **units will be based on units of 400 gallons of water per day at $1,400 per unit, as determined by the Building Official, . in conformance with Deparbrent of Environmental Regulations Technical Information Memorandum 6.21 (attached) In the event that the calculated gallonage in excess of any 400 gallon unit is less than 200 gallons per day then a one -half fee shall be assessed. In the event that it is greater than 200 gallons per day then the entire 400 gallons per day impact fee shall he assessed.
