The meeting was called to Order at 6:00 p.m. by Chairperson, Lamar Russell. The Secretary called the roll. However, as of the date of the meeting, the City Council had not yet formally approved a Resolution appointing him to the Board. While Mr. Buddenhagen cast his vote on the items under consideration, no item passed or failed based on his vote alone and the Board's actions at this meeting would have resulted the same regardless of Mr. Buddenhagen's participation. Community & Economic Development Director, Todd Morley announced that Planning & Zoning Director, Barry Brown had resigned. Mr. Morley advised that he would be performing the Planning & Zoning Director's duties until a new Director is hired. NEW BUSINESS Approval of Planning & Zoning Board Minutes Meetinq - October 23, 2013. Ron Friedman requested that a minor change be made to the draft Minutes. Motion by Bruce Collins, seconded by Harry Pearson to approve the Meeting Minutes of October 23, 2013, with the minor change requested by Ron Friedman. Vote on the motion carried unanimously. 2. Approval of Planning & Zoning Board Meeting Minutes - November 13, 2013. Motion by Ron Friedman, seconded by John Price to approve the Meeting Minutes of November 13, 2013, as presented. Vote on the motion carried unanimously. 3. Quasi-Judicial and/or Public Hearinq: Consideration and Recommendation to Board of Adiustment Re: Special Exception Request No. 13-09 to Allow a Veterinary Hospital/Clinic (dog boarding and grooming business) in the C-1 zoning district, per City Code of Ordinances, Section 110-334 (c) (1), Special Exceptions Permissible by the Board of Adiustment - (109 Long Point Road) - Deborah F. Dean, Petitioner. Planning & Zoning Board Meeting Minutes January 8, 2014 Page 2 of 2 Community & Economic Development Director, Todd Morley gave an overview of the request. He explained that the property owner of 109 Long Point Road was seeking approval for a Special Exception for the lessee to operate a dog boarding and grooming business. He gave a Staff Report and read comments from City Staff pertaining to stormwater control; disposal of animal waste; and adherence to the City Code regarding noise. Brief discussion followed. Todd Morley clarified that this was a request for a dog boarding and grooming business, not a veterinary hospital or clinic. The Board reviewed the Special Exception Worksheet. An ensuing discussion followed regarding: noise, fencing, buffering, traffic, parking, animal waste, odor, hours of operation, proposed 50 lb. weight limit of animals, number of boarding cages, and outside play areas. Chairperson, Lamar Russell opened the floor for public comment. Business Owner/Lessee, Leonard Meckalavage answered property owners' questions and addressed concerns regarding: noise, odor, disposal of animal waste, traffic, fencing and buffering, staffing, and the utilization of Brevard County Humane Society Standards and Procedures to run the day to day business. The Board held additional discussion regarding the proposed use being similar to permitted uses in the C-1 zoning district. Todd Morley determined that Staff was comfortable interpreting that the requested use was similar to other principal uses in the C-1 zoning district; and therefore, the requested Special Exception was not required. The Board unanimously agreed with his interpretation. Petitioner, Deborah Dean voluntarily withdrew the Special Exception Application. 4. Election Re: Chairperson and Vice Chairperson. Lamar Russell opened the floor for nominations. Lamar Russell nominated John Price for Chairperson, Ron Friedman seconded the nomination. John Price accepted the nomination. Chapman, Secretary City of Cape Canaveral, Florida Planning and Zoning Board February 26, 2013 STAFF O. vpecial Exception No. Request: For a Special Exception to allow for the assembly, outside display of merchandise, and sales of electric vehicles. Applicant and Owner: Stanley (Ed) Schoefield (agent) Subject property: 7077 N. Atlantic Avenue. The property is 1.84 acres. Zoning and Future band Use designation: C -2, Commercial. Surrounding zoning: North — C -2, Commercial East — C -1, Commercial South — C -2, Commercial West — C -2, Commercial Surrounding uses: North — multi- tenant office and light manufacturing East — food/beverage South — general office West - multi- tenant office and light manufacturing Background /Analysis: Mr. Schoefield is requesting to establish a sales and service center for a line of all electric vehicles. According to Section 110 -383 (c)(6) of the Code, a Special Exception must be granted in order to allow the "Sales of new and used automobiles, major recreational vehicles..." within the C -2 zoning district. The Code includes a definition of an "Automotive Vehicle" as a self - propelled vehicle or conveyance designed and used for the purpose of transporting or moving persons..." Although the current Code did not contemplate electric vehicles, the definition of an automotive vehicle is general enough to apply this section of the Code. Although the City does not have specific regulations for the operation of electric vehicles (low - speed vehicles), the State of Florida, as contained in F.S. 316, has established certain rules for their operation. Section 110- 383(c)(6) a -e of the City Code establishes requirements that must be met when establishing an automotive sales /service center. Notably that that all outside display areas shall be paved, all repair activities shall be in an enclosed structure, and there shall be no parking /storing of wrecked vehicles. Staff has requested the applicant provide a site plan indicating the location of the proposed outside display areas in relation to the principal structure. Staff has requested the applicant submit the site plan for staff review and approval prior to the Planning and Zoning Board meeting. Due to similarities between the proposed use and Vehicle Rental Facilities, Staff is requesting that the Board impose an additional condition which is required of Vehicle Rental Facilities: a minimum five (5) foot wide landscape buffer along the property's frontage of N. Atlantic Avenue. This buffer will meet the standards of Sec. 110- 687(1)(a) and (b) of the City's Code. A credit shall be provided for existing plants /trees located in the buffer area. ATLANTIC AVE. - ELECTRIC VEHICLES I recommend approval of the Special Exception with the following comments: Please clarify the type of electric vehicles proposed (Golf Carts? Low-Speed Vehicles?). Restrictions imposed 110- 383 -(c)6 will apply. Restricted to sale only. Continued compliance with Florida Statutes regarding the use of Golf Carts and Low-Speed Electric Vehicles will be required (see attached). 1 Low-Speed Vehicles and Golf Carts ��° �u��20I2 Florida Statutes 320.01 Definitions, general (42) "Low-speed vehicle" means any four-wheeled vehicle whose top speed is greater than 20 miles per hour but not greater than 25 miles per hour, including, but not limited 1o, neighborhood electric vehicles. Low-speed vehicles must comply with the safety standards in4BC.F.R. s. 571.500 and s.316.2122. 316.2122 Operation of aUom-speed vehicle or mini truck on certain roadways.— The operation of low-speed vehicle as defined in s. 320.01(42) or mini truck as defined in s. 320.01/45\ on any road is authorized with the following restrictions: (1) A low-speed vehicle or mini truck may be operated only on streets where the posted speed limit is 35 miles per hour orless. This does not prohibit low-speed vehicle or mini truck from crossing a road or street at an intersection where the road or street has a posted speed limit of more than 35 miles per hour. (2) A|ovv-spaed vehicle must beequipped with headlamps, stop lamps, turn signal lamps, tail lamps, reflex reflectors, parking brakes, rearview mirrors, windshields, seat belts, and vehicle identification numbers. (3) A low-speed vehicle ormini truck must be registered and insured in accordance with s. 320.03 and titled pursuant to chapter 319. (4) Any person operating a low-speed vehicle ormini truck must have in his orher possession a valid driver's license. (5) A county or municipality may prohibit the operation of low-speed vehicles or mini trucks on any road under its jurisdiction if the governing body of the county or municipality determines that such prohibition is necessary in the interest of safety. (6) The Department of Transportation may prohibit the operation of low-speed vehicles or mini trucks on any road under its jurisdiction if it determines that such prohibition is necessary in the interest of safety. 316.212 Operation of golf carts on certain roadways.—The operation of golf cart upon the public roads or streets of this state is prohibited except as provided herein: (1) A golf cart may be operated only upon e county road that has been designated by a county, or municipal street that has been designated by municipality, for use by golf carts. Prior to making such a designation, the responsible local governmental entity must first determine that golf carts may safely travel on or cross the public road or street, considering factors including the speed, volume, and character of motor vehicle traffic using the road or street. Upon a determination that golf carts may be safely operated on a designated road or street, the responsible governmental entity shall post appropriate signs to indicate that such operation is allowed. (2) A golf cart may be operated on a part of the State Highway System only under the following conditions: (a) To cross a portion of the State Highway System which intersects a county road or municipal street that has been designated for use by golf carts if the Department Of Transportation has reviewed and approved the location and design ofthe crossing and any traffic control devices needed for safety purposes. (b) To cross, at rnidb|ock, a part of the State Highway System where a golf course is constructed on both sides of the highway if the Department of Transportation has reviewed and approved the location and design of the crossing and any traffic control devices needed for safety purposes. (c) A golf cart may be operated on a state road that has been designated for transfer to a local government unit pursuant to s. 335.0415 if the Department of Transportation determines that the operation of golf cart within the right-of-way of the road will not impede the safe and efficient flow of motor vehicular traffic. The department may authorize the operation of golf carts on such a road if: 1. The road is the only available public road along which golf carts may travel or cross Or the road provides the safest travel route among alternative routes available; and 2. The speed, volume, and character of motor vehicular traffic using the road is considered in making such a determination. Upon its determination that gotf carts may be operated ona given road, the department shaK[ost appropriate signs on the road to indicate that such operation is allowed. (3) Notwithstanding any other provision of this section, a golf cart may be operated for the purpose of crossing a street or highway where a single mobile home park is located on both sides of the street or highway and is divided by that street or highway, provided that the governmental entity having original jurisdiction over such street or highway shall review and approve the location of the crossing and require implementation of any traffic controls needed for safety purposes. This subsection shall apply only to residents or guests of the mobile home park. If notice is posted at the entrance and exit of any mobile home park where residents of the park operate golf carts or electric vehicles within the confines of the park, it is not necessary for the park to have a gate nr other device at the entrance and exit in order for such golf carts or electric vehicles to be lawfully operated in the park. (4) Notwithstanding any other provision of this section, if authorized by the Division of Recreation and Parks of the Department of Environmental Protection, a golf cart may be operated on a road that is part of the State Park Road System if the posted speed limit is 35 miles per hour or less. (5) A golf cart may be operated only during the hours between sunrise and sunset, unless the responsible governmental entity has determined that a golf cart may be operated during the hours between sunset and sunrise and the golf cart is equipped with headlights, brake lights, turn signals, and o windshield. (0) A golf cart must be equipped with efficient brakes, reliable steering apparatus, safe tines, a rearview mirror, and red reflectorized warning devices in both the front and rear. (7) /\ golf cart may not be operated on public roads or streets by any person under the age of 14. (8) /\local governmental entity may enact an ordinance relating to: (a) Golf cart operation and equipment which is more restrictive than those enumerated in this section. Upon enactment of such ordinance, the local governmental entity shall post appropriate signs or otherwise inform the residents that such an ordinance exists and that it will be enforced within the local government's jurisdictional territory. An ordinance referred t0 in this section must apply only to an unlicensed driver. (b) Golf cart operation on sidewalks adjacent 1O specific segments of municipal streets, county roads, or state highways within the jurisdictional territory of the |0Ca| governmental entity if: 1. The local governmental entity determines, after considering the condition and current use of the sidewalks, the character of the surrounding community, and the locations of authorized golf cart crossings, that golf carts, bicycles, and pedestrians may safely share the sidewalk; 2. The local governmental entity consults with the Department of Transportation before adopting the ordinance; 3. The ordinance restricts golf carts to a nnaxirnurn speed of 15 miles per hour and permits such use on sidewalks adjacent to state highways only if the sidewalks are at least 8 feet wide; 4. The ordinance requires the golf carts to meet the equipment requirements in subsection (6). However, the ordinance may require additional equipment, including horns or Other warning devices required bys.31{.271; and 5. The local governmental entity posts appropriate signs or otherwise informs residents that the ordinance exists and applies to such sidewalks. /9\ A violation of this section is a noncriminal traffic infraction, punishable pursuant to chapter 318 as a moving violation for infractions of subsections (1)-(5) or a local ordinance corresponding thereto and enacted pursuant to subsection (8), or punishable pursuant to chapter 318 as a nonmoving violation for infractions of subsection /6\/ subsection (7), or a local ordinance corresponding thereto and enacted pursuant to Subsection (8). The C-2 District is directed towards a mix of low density commercial and light industrial. Special exceptions in this District do allow: a. Sales of recreational equipment; and b. Vehicle rental facility. 2. While an initial concern was that this exception to C-2 zoning is not adjacent to any other C-2 area, the engineering criteria is very favorable. 3. Minimum structure sizes of 10,000 s.f. is required in C-2 (See. 110-385). The submitted application does meet this criteria as well as other setbacks, parking, etc. Based on the above, it is recommended that this special exception be approved.
