RESOLUTION NO. 85-39
A RESOLUTION AUTHORIZING THE MAYOR AND THE
CITY CLERK TO ENTER INTO AN AGREEMENT WITH
BREVARD COUNTY BOARD OF COUNTY COMMISSIONERS
TO CONDUCT THE MUNICIPAL ELECTION FOR THE
CITY OF CAPE CANAVERAL; PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City of Cape Canaveral' s General Election will
be held on November 5 , 1985; and
WHEREAS, Brevard County will not be conducting an election
this year;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of Cape Canaveral, Florida, as follows:
SECTION 1 . The Mayor and the City Clerk are hereby authorized
to execute an agreement with the Brevard County Board of County
Commissioners to assist with the Municipal election to be held on
November 5 , 1985 . A copy of said agreement is attached hereto
and made a part hereof by reference.
SECTION 2. This Resolution shall become effective immediately
upon its adoption.
ADOPTED BY the City Council of the City of Cape Canaveral,
Florida, this 20th , day of August , 1985 .

A G R E E M E N T
THIS AGREEMENT, made and entered into this 24th day of
September , 1985 , by and between the CITY OF
Cape Canaveral , hereinafter referred to as "City," and the

BOARD OF COUNTY CONVUSSIONERS AND SUPERVISOR OF ELECTIONS OF BREVARD COUNTY,
FLORIDA, hereinafter referred to as "County".

WITNESSETH :
WHEREAS, the City has adopted a single permanent registration system
with the County for the registration of electors of the City; and
WHEREAS, the City desires the County to assist in the
General Municipal
•
Election(s) of the City to be held
on November 5 , 1985 for the purpose of
electing a Mayor and referendum questions
•
NOW, THEREFORE, in consideration of the premises and covenants herein
contained, the County and the City agree as follows:
•
1. The County agrees to do the following:
a. Furnish and place at the polling places sufficient voting
equipment.
b. Provide City Clerk with a list of registered voters qualified
to vote in their City election.
c. Provide lists of sufficient inspectors and clerks to conduct
the election.
d. Coordinate printing of ballots.
e. Furnish and place at the polling places the registration records
for each precinct.
2. The City agrees to do the following:
a. Furnish the County by the close of business day of

September 17 , 1985 (last date of qualification) a certified copy under seal of
the City Clerk of the proposed ballot showing the exact names of all qualified
candidates for the election for each office, as they will appear on the official
ballot. Also, the exact wording of questions or issues to be placed on the ballot.

b. Cause the sample ballot to be advertised in the newspaper as
•
required by law.
c. Pay all costs of printing and advertising of the official
ballots, sample ballots, and other printed forms required by law.
d. Pay all transportation and labor cost for delivery of voting
equipment to and from polling places.
e. If the assistance of a Voting Equipment Technician is requested,
mileage and technician services will be paid by the City.
f. Cooperate in coordinating and printing the ballot and approving
the form of the ballot.
g. The City shall be responsible for appointing and paying each
inspector and clerk at each polling place.
h. Do whatever else is. agreed herein.
3. The City shall provide for absentee voting, all in accordance with
the provisions of the general laws of the State of Florida.
4. The County shall count the votes and submit to the Supervisor of
Elections the Certificate of Results of Election certifying in duplicate the
votes cast for each candidate. The Supervisor shall deliver two copies of
the Certificate of Results to the City Clerk who will transmit one copy to
the Mayor.
The Mayor and City Clerk shall transmit the returns to the City
Council at a special meeting for the canvassing of the election, which shall
be held at 7 : 30 P.M. , November 7 , 1985
on the second day following the election.
After the absentee ballots have been counted by the County, a list
shall be made of those voted for with the number of votes for each, and certify
in duplicate as to the correctness of the absentee vote count. The Supervisor
shall deliver two copies of the absentee vote count to the City Clerk who will
transmit one copy to the Mayor. The City Clerk shall then transmit the returns
to the City Council.
After receiving all returns, the City Council shall approve the
election results as submitted by the County and said returns shall be by the
City Council declared as the result of the election.
The City shall then -submit one copy of their Certification of
Election to the County.

THE PARTIES hereto, by their respective proper officials, execute this
Agreement on the date aforesaid.
