boarding and grooming business) in the C -1 Commercial Zoning District per Section
110- 334(c)(1).

Summary: The owner of property at 109 Long Point Road is seeking approval for
lessee to operate a dog boarding and grooming business at 109 Long Point Road. The
existing building was damaged by fire and owner intends to redevelop the property to
accommodate a dog boarding and grooming business. The business will have 35
spaces for boarding and will have limited doggy day care. Animals will not be outside
after 7pm or before lam. Stockade fencing will be provided around perimeter of outside
animal area.
Surrounding properties are zoned C -1 Commercial and properties to the east, south and
west are in commercial uses. Property to the northeast is a vacant lot and property to
the northwest is a townhome development.

Staff Recommendation to the Plannina and Zoning Board
With provision of fencing and adherence to proposed hours of operation, a dog boarding
and grooming business is appropriate at the proposed location. Staff recommends
approval of the requested Special Exception.

RE: Special Exception Request No. 13-09 —109 Long Point Rd.
I have reviewed the Special Exception Request and have the following comment:
The application provides that "no dogs will be outside the structure after 7:00pm or before
7:00am ". That notwithstanding, I recommend that the Applicant and the Board remain aware
of all prohibited noises, especially Sec. 34- 153(5), which is underlined below. This section
continually applies all day and all night (it is not limited to a specific duration of time, as other
subsections).
Sec. 34 -153. Enumeration of prohibited noises.
It is unlawful for any person within the city to make, continue or cause to be made or continued any loud,
unnecessary or unusual noise which either annoys, disturbs or endangers the comfort, repose, health,
peace or safety of others, and the following acts, among others, are declared to be loud, disturbing and
unnecessary noises in violation of this section, but the enumeration shall not be deemed to be exclusive:
(1) The sounding of any horn or other signaling device on any automobile, motorcycle or other motor
vehicle on any street or in any public place within the city, except as a danger warning; the creation
by means of such signaling device of any unreasonably loud or harsh sound and the sounding of any
such device for an unnecessary and unreasonable period of time; the use of any horn or other
signaling device operated by the engine exhaust of any motor vehicle and the use of any such horn
or other signaling device when traffic is for any reason held up.
(2) The playing, using or operating or permitting to be played, operated or used any radio receiving set,
musical instrument, television set, phonograph or other machine or device for the producing or
reproducing of sound in such a manner as to disturb the peace, quiet and comfort of the neighboring
residents at any time with louder volume than is necessary for the convenient hearing of the person
who is in the room, vehicle or immediate area in which such machine or device is being operated
and who is a voluntary listener thereto. The operation of any such radio receiving set, musical
instrument, television set, phonograph or other machine or device for producing or reproducing
sound between the hours of 11:00 p.m. and 7:00 a.m. in such a manner as to be plainly audible at a
distance of 100 feet from the building, structure or vehicle in which it is located, shall be deemed
prima facie evidence of a violation of this section.
(3) The playing, using or operating or permitting to be played, used or operated any radio receiving set,
musical instrument, phonograph, loudspeaker, sound amplifier or other machine or device for the
producing or reproducing of sound which is cast upon the public streets for the purpose of
commercial advertising or attracting the attention of the public to any building or structure; provided,
however, within the commercial zoned district, the city manager may issue a permit to allow certain
of the such activities, subject to conditions that would not materially disturb the tranquility of persons
in the vicinity.
(4) Yelling, shouting, hooting, whistling or singing on the public streets between the hours of 11:00 p.m.
and 7:00 a.m. or at any time or place so as to annoy or disturb the quiet, comfort or repose of
persons in any office, store or in any dwelling, hotel or other type of residence.
(5) The keeping of any animal or bird which, by frequent or long- continued noise. shall disturb the
comfort or repose of persons in the vicinity thereof.
(6) The discharge into the open air of the exhaust of any engine, motor, motorboat or motor vehicle,
except through a muffler or other device which will effectively prevent loud, explosive and
unnecessary noise therefrom.
(7) The use of any automobile, motorcycle or other vehicle so out of repair, so loaded or in such manner
as to create loud and unnecessary grating, grinding, rattling or other noise.

Description of Request for a Special Exception
We would like to be considered for a Special Exception to open a dog
boarding and grooming business at 109 Long Point Road, Cape Canaveral.
Property Owner- Deborah Dean
Proposed Business Owner- Leonard Meckalavage
Proposed Use-
The property was recently purchased by Deborah Dean and has been
unoccupied for some time due to fire damage remaining from the prior owner.
Ms. Dean would like to renovate and redevelop the property and have a tenet in
place. I would like to open a dog boarding and grooming business and hope that
you will agree that this is an acceptable location.
Ms. Dean would renovate the existing structure and grounds to
accommodate a dog boarding business. I am prepared to lease the property and
open the business in July- August 2014.
The business model is based on assuming the following information-
35 spaces available for boarding
70% average yearly occupancy
Limited dogging day care of 10 -12 dogs
Limited retail sales of specialty dog food and supplies
Dog grooming offered
Hire 4 -5 local residents to fill staffing positions.
Ms. Dean and I would like to redevelop an eyesore and create a thriving
locally owned and staffed business while offering a missing and needed service
for the community. The nearest business competitor is in downtown Cocoa
Beach or Merritt Island.

Any noise concerns will be addressed with fencing and landscaping to
dampen sound. Visual partitions will be used to separate animals from each
other which will minimize barking. All animals will have a staff member in
attendance while outside. No dogs will be outside the structure after 7:00pm or
before 7:00am.

An applicant for a Special Exception is required to meet with the Planning Director prior
to completing and submitting the application. The following worksheet will be used to
evaluate the requested Special Exception.
A Special Exception is a use that would not be appropriate generally or without
restriction throughout the zoning district, but which, if controlled as to number, area,
