Any member of the public may address any items that do not appear on the agenda and any agenda item
that is listed on the agenda for final official action by the Board excluding public hearing items which are
heard at the public hearing portion of the meeting, ministerial items (e.g. approval of agenda, minutes,
informational items), and quasi-judicial or emergency items. Citizens are encouraged to limit their comments
to three(3)minutes. The Board will not take any action under the"Public Participation"section of the agenda.
The Board may schedule items not on the agenda as regular items and act upon them in the future.
NEW BUSINESS:
1. Approve Minutes for Regular Construction Board of Adjustment and Appeals
Meeting of December 3, 2013.
2. Appeal of the Building Official's October 31, 2013 decision on Kitchen and
3 Bathroom Remodel Permit submittal for 350 Fillmore Avenue Unit 2F:
(a) Whether a permit may be issued to the owner under the owner-builder
exception set forth in section 489.103(7), Florida Statutes.
(b) Whether a building permit is required for each and every aspect of the
proposed kitchen and bathroom renovation project given in the scope of
work.
(c) if the answer to question #1 is no, may the owner complete the portions of
the renovation not requiring a permit before the permit is pulled?

making her Presentations, she proceeded to instruct Members on her role as legal

5. Election of Chairperson.
Attorney Latorre opened the floor to nominations for Chairperson. A motion was made
by William Budesa, seconded by Joseph Tichich, to nominate Geoff Goetz for
Chairperson. No other nominations were made and Mr., Goetz accepted the
nomination. Vote on the motion carried unanimously.
6. Election of Vice Chairperson.
Chairperson Goetz opened the floor to nominations Vice `�at

7. Appeal of the Building Official's Octobers , d13 .decision on Citchen and

Building Official Glenn Pereno introduced himself to the Board and requested the
Appeal be moved to another:-bearing date. He explained more time was needed to
research the issue. Discussion ensued and included: when the Permit was applied for
and how much time the Building Official is requesting to prepare. Chairperson Goetz
requested guidance from Staff regarding how to proceed. Attorney Latorre stated Mr.
Pereno has separate legal counsel assisting him to present his side of the Appeal to the
Board, but because of the holiday they have not had a chance to meet.
Attorney Latorre acknowledged the Appellant, Mr. S. Ken Gray, is present and would
like to address the 'Board. She advised it will be up to the Board; a Motion will be
necessary and at least three Members will have to agree to continue the case. Attorney
Latorre suggested the Board could decide on a date-certain, since all parties are here, if
that is the will of the Board. The Board agreed to allow Mr. Gray to speak.
Mr. Gray stated he received a phone call the previous night relaying the message that
Mr. Pereno was not ready for the Meeting. He indicated he has been in limbo since
October 2013 and unable to utilize or do anything to the condominium regarding

renovations so he and Mrs. Gray can live in it in the future. He stated the whole issue
comes down to Florida Statute 483.103 (7)(a); can an owner of a condominium pull a
permit as owner, as a single family owner can do, or not? Mr. Gray stated the Building
Official has interpreted the issue one way and he is saying Mr. Pereno is wrong. Mr.
Gray stated he is ready, the City has had time to prepare for this meeting and he would
like to proceed. He thanked the Board.
Discussion ensued and included whether the Appellant, Mr. Grp is required to hire a
general contractor or can he, as owner, pull the permit; an• ,.ae number of units in the
Appellants' condominium. Chairperson Goetz thanked h :-y, but stated the Board
would need to decide to hear the Appeal or not befor ;gekm*nto the details of the
case. Administrative Services Director Angela App Ion in fry'? ced herself to the
Board. She stated the Appeal was filed by Mr. Gray &,November ,, and the City has
not had 45 days to prepare for this case. She,confirmed that becau��-•f the holiday, it
has taken time to arrange proper legal counset and that is the purpose f - -,equest to
continue. She reminded the Board that As ` tant City:,Attorney Lat.`"`e may not
represent Staff in this manner. Ms. Apperson endouraged the Board to pick a date in
January, but that Staff would speed up their prey rations should they choose a
December date. Mr. Gray stated it his been 43 days sce the Stop Work Order was
ry placed on the Unit, and he has bed 3fronstant contact with the City since then.
Discussion ensued regarding granting t e C vti0 e time
A motion was made by Mr. Agtmaal, seco ed riV,11.F l ichich, to hear the Appeal
this evening and den -t �. 2equest fo a Continuance by the Building Official.
Discussion ensued,=and incliidc1 the fact that if the Board denies continuance of the
case tonight, then the decision of the Board 'becomes final. Attorney Latorre stated the
decision becomes final subject-to appellate rights of the losing party to further appeal
beyond this Board; and-as -far as-the City process goes, this is the final stop. Ms.
Apperson.pointed of t,that Board Members do not have to make a decision this evening.
Vote on the motion failed by 6,3-2 majority, with Members voting as follows: Mr.
Agtmaal, For; Mr. Budesa, Against; Mr. Goetz, Against; Mr. Quinn, Against; Mr.
TichichFor.
Attorney Latorre advised the Board to make a motion to continue to a date certain
instead of tabling the item. Discussion ensued regarding scheduling the next meeting
date and time A motion was made by Mr. Quinn, seconded by Mr. Budesa, to
reschedule the Hearing for December 18, 2013. Vote on the motion carried
unanimously. The`'Board agreed to meet at 5:30 pm on December 18th for the next
Construction Board of Adjustment and Appeals meeting.
Chairperson Goetz inquired if there was any other business before the Board. An
audience member stated their concern over the Board Members not taking Oaths of
Office. Attorney Latorre stated she would research the issue.

Based upon Section 82-33(a)(4)of the City Code of Ordinances, I desire to appeal the decision
of the Building Official as follows:
1. Whether a permit may be issued to the owner under the owner-builder exception set forth
in section 489.103(7),Florida Statutes.
2. Whether a building permit is required for each and every aspect of the proposed kitchen
and bathroom renovation project given in the scope of work.
3. If the answer to question ti l is no, may the owner complete the portions of the renovation
not requiring a permit before the permit is pulled?
Attached please find a copy of the Building Permit Application including the scope of work.

review of the submitted permit application documents, the permit for remodeling must be submitted by a Licensed
1 Contractor. I have included the Florida Statutes for your records.
1 1. Pursuant to Florida Statute 489.103: Exemption,
1 (7)(a) Owners of property when acting as their own contractor and providing direct, onsite supervision
3 themselves of all work not performed by licensed contractors:
When building or improving farm outbuildings or one-family or two-family residences on such property
1 for the occupancy or use of such owners and not offered for sale or lease, or building or improving
$ commercial buildings, at a cost not to exceed $75,000, on such property for the occupancy or use of such
r owners and not offered for sale or lease. In an action brought under this part,proof of the sale or lease, or
offering for sale or lease, of any such structure by the owner-builder within 1 year after completion of same
; creates a presumption that the construction was undertaken for purposes of sale or lease.
Based on this statute,please contact a Division I Contractor per Florida Statute 489.105:
"Contractor"means the person who is qualified for, and is only responsible for,the project contracted for
1 and means, except as exempted in this part, the person who, for compensation,undertakes to, submits a bid
to, or does himself or herself or by others construct, repair, alter, remodel, add to, demolish, subtract from,
or improve any building or structure, including related improvements to real estate, for others or for resale
7 to others; and whose job scope is substantially similar to the job scope described in one of the paragraphs of
this subsection. For the purposes of regulation under this part,the term "demolish"applies only to
demolition of steel tanks more than 50 feet in height; towers more than 50 feet in height; other structures
more than 50 feet in height; and all buildings or residences. Contractors are subdivided into two divisions,
Division I, consisting of those contractors defined in paragraphs (a)-(c), and Division II, consisting of those
contractors defined in paragraphs (d)-(q):

(a) "General contractor"means a contractor whose services are unlimited as to the type of work which he
or she may do, who may contract for any activity requiring licensure under this part, and who may perform
any work requiring licensure under this part, except as otherwise expressly provided in s. 489.113.
(b) "Building contractor"means a contractor whose services are limited to construction of commercial
buildings and single-dwelling or multiple-dwelling residential buildings, which do not exceed three stories
in height, and accessory use structures in connection therewith or a contractor whose services are limited to
remodeling, repair, or improvement of any size building if the services do not affect the structural members

The Foregoing statement must be read and signed by the property owner. The property
owner must sign the affidavit in front of a Notary Public.
I understand that state law requires construction to be done by a licensed contractor and have applied for
I an owner-builder permit under an exemption from the law.The exemption specifies that I,as the owner
of the property listed,may act as my own contractor with certain restrictions even though I do not have a
license.

I understand that building permits are not required to be signed by a property owner unless he or she is

responsible for the construction and is not hiring a licensed contractor to assume responsibility.

3 PERMITTING REQUIREMENTS/FLORIDA BUILDING CODE
a. Florida Statute 468, Section 468.604 Responsibilities of building code
administrators,plans examiners, and inspectors.—
(1) It is the responsibility of the building code administrator or building official to
administrate, supervise, direct, enforce, or perform the permitting and inspection of
construction, alteration, repair, remodeling, or demolition of structures and the
installation of building systems within the boundaries of their governmental
jurisdiction, when permitting is required, to ensure compliance with the Florida
Building Code and any applicable local technical amendment to the Florida
Building Code. The building code administrator or building official shall faithfully
perform these responsibilities without interference from any person. These
responsibilities include:
(a) The review of construction plans to ensure compliance with all applicable
sections of the code. The construction plans must be reviewed before the issuance of
any building, system installation, or other construction permit. The review of
construction plans must be done by the building code administrator or building
official or by a person having the appropriate plans examiner license issued under
this chapter.
b. Florida Statute 553, Section 553.775 Interpretations.—
(1) It is the intent of the Legislature that the Florida Building Code be interpreted
by building officials, local enforcement agencies, and the commission in a manner
that protects the public safety, health, and welfare at the most reasonable cost to the
consumer by ensuring uniform interpretations throughout the state and by
providing processes for resolving disputes regarding interpretations of the Florida
Building Code which are just and expeditious.
Florida Statute 553, Section 553.79 Permits; applications; issuance; inspections.—
(1) After the effective date of the Florida Building Code adopted as herein
provided, it shall be unlawful for any person, firm, corporation, or governmental
entity to construct, erect, alter, modify, repair, or demolish any building within this
state without first obtaining a permit therefor from the appropriate enforcing
agency or from such persons as may, by appropriate resolution or regulation of the
authorized state or local enforcing agency, be delegated authority to issue such
permits, upon the payment of such reasonable fees adopted by the enforcing agency.
The enforcing agency is empowered to revoke any such permit upon a
determination by the agency that the construction, erection, alteration,
modification, repair, or demolition of the building for which the permit was issued is
in violation of, or not in conformity with, the provisions of the Florida Building
ICode. Whenever a permit required under this section is denied or revoked because
1 the plan, or the construction, erection, alteration, modification, repair, or demolition
1 of a building, is found by the local enforcing agency to be not in compliance with the
Florida Building Code, the local enforcing agency shall identify the specific plan or

project features that do not comply with the applicable codes, identify the specific

I information to the permit applicant. Installation, replacement, removal, or metering
1 of any load management control device is exempt from and shall not be subject to

a. 489.103 Exemptions.—This part does not apply to:
(7)(a) Owners of property when acting as their own contractor and providing
direct, onsite supervision themselves of all work not performed by licensed
contractors:
1. When building or improving farm outbuildings or one-family or two-family
1 residences on such property for the occupancy or use of such owners and not offered
for sale or lease, or building or improving commercial buildings, at a cost not to
exceed $75,000, on such property for the occupancy or use of such owners and not
offered for sale or lease. In an action brought under this part,proof of the sale or
Ilease, or offering for sale or lease, of any such structure by the owner-builder within
1 1 year after completion of same creates a presumption that the construction was
undertaken for purposes of sale or lease.
