ARegular Meeting of the Code Enforcement Board of the City of Cape Canaveral, Florida was

Assistant City Attorney Latorre swore in all persons giving testimony.

COMPLIANCE HEARINGS:
2. Case No. 12-00006 — Violation of Section 301.3, Vacant Structures and Land: Section
302.3, Sidewalks and Driveways: Section 303.4, Structural Members; Section 303.6,
Exterior Walls; Section 303.7, Roofs and Drainage; Section 303.10, Stair and Walking
Surfaces; Section 303.14, Window, Skylight and Door Frames; Section 303.16, Doors;
Section 304.3, Interior Surfaces, of the of the International Property Maintenance Code
(1998 edition), as adopted by Section 82-221, of the CitV of Cape Canaveral Code of
Ordinances; and Section 34-96(d), Standards Established, of the City of Cape Canaveral
Code of Ordinances; and Section 301.1, General, of the Standard Unsafe Building
Abatement Code (1985 Edition), (7521 Magnolia Ave.) — Lenny Cassanelli, PropertV
Code EnfO[C8Ole[t Officer, [>Ure8 Alexander, provided an overview Ofthe C8S6 history and
presented exhibits for the Board's review. Officer Alexander testified that the violation is for the
condition of the StrUCLUr8. Officer Alexander stated that the Respondent has boarded up all of
the windows and secured of the property; however the property is not in compliance with the
Board Order.
LennyCaSSaDeUi` property owner, testified that he has been working to S8CUr8 the pn}p8dv by
boarding Up all the windows. Mr. CasS8nHUi stated that he has obtained a report from 8 design
professional, as ordered, and is ready iOsubmit the report and plans to the building department
for review. Mr. Cass@neUi further stated that he has a fRvv folks that may be interested in the
purchase Ofthe property.
Officer Alexander respectfully requested that the Board find the Respondent non-compliance Of
the 4th AnO8Dd8d Board Order Imposing Penalty on First Violation, and impose the fine in the
8OOOuDt of two hundred and fifty dollars /$250.00\ for the first day and one hundred do||G[S
($1OO.00) per day thereafter until found incompliance.
Motion by Mr. H8|8' SGCOnd8d by Mr. Vi8nS. to accept Staff's recommendation and find the
respondent in non-compliance and iD1p0S8 8 fine in the amount of two hundred and fifty dO||8rS
/%25O.O0\for the first day and one hundred dollars /$100.00\ per day thereafter until found in
compliance. Vote on the nlOtiOO carried unanimously.

Code Enforcement Officer, Brian Palmer, provided an overview of the C8S8 history and
presented exhibits for the Board's review. Officer Palmer testified that the violation is for

residence. Officer Palmer further stated that there were no screens OO any of the windows, @
cracked window, a |8ok at the kitchen Sink. 8 b8ihr0Orn window that will not open, and 8 back
door that was hard t0close.
Giuseppe CODOSDenti, property manager, i88tU5ed that he has not been able to get in to the unit
because the tenant would only allow access after 5pOoduring weekdays and nnthe weekends.
Mr. COnoecBnh stated that the tenant has not paid rent for the past three months and the
property management company has stated the eviction process. Hefurther stated that h8isnot
able to contact the t8O@Dt or it will violate the eviction process and they would have to start over.
Mr. Conoscenti explained that, once the tenant is evicted, he will clean up the unit.
Officer Palmer respectfully requested that the Board find the Respondent inviolation of Section
34-07(8)/0\. [)UU88 and Responsibilities for Maintenance, of the City of Cape C8O8ve[o| Code of
Ordinances; Section 308.1' Extermination; Section 303.14.Window, Skylight, and Door Frames;
GecU0O 303.15, Insect Screens; Section 303.10. Doors; Section 505.3, Water System, of the
International Property Maintenance Code /1098 edition\, as adopted by 8eCUOD 82-221. of the
City OfCape Canaveral Code of Ordinances and give the Respondent until June 20' 2013 to

for the first day and seventy-five dollars ($75.O0) per day thereafter until found incompliance.
