AN ORDINANCE OF THE CITY OF CAPE CANAVERAL,
BREVARD COUNTY, FLORIDA, AMENDING CHAPTER 685,
PARKING REGULATIONS, OF THE CODE OF ORDINANCES
OF THE CITY OF CAPE CANAVERAL, TO AMEND
SECTION 685.01 WITH REGARD TO THE REFERENCE OF
FLORIDA STATUTES CONTAINED THEREIN; BY
AMENDING SECTION 685.02 REGARDING THE
ESTABLISHMENT OF NO PARKING ZONES TO PROVIDE
THAT THE CITY FIRE CHIEF MAY DESIGNATE FIRE
LANES AND DESIGNATING THE FIRE CHIEF OR HIS
DESIGNEE AS A PARKING ENFORCEMENT SPECIALIST
TO CITE VIOLATIONS OF PARKING IN FIRE LANES;
BY AMENDING SECTION 685.06 TO ADD A VIOLATION
FOR PARKING IN A FIRE LANE; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL OF
CONFLICTING ORDINANCES AND RESOLUTIONS; AND
PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CAPE
CANAVERAL, BREVARD COUNTY, FLORIDA, as follows:
SECTION 1. Section 685.01, Parking Regulations, of the City
Code of Ordinances of the City of Cape Canaveral is hereby amended
to read as follows:
Sec. 685.01. Parking Regulations. Section 316.1945,
Florida Statutes, is hereby adopted as the parking regulation
for the City of Cape Canaveral, Florida.
SECTION 2. Section 685.02, Establishing of No Parking Zones,
of the City Code of Ordinances of the City of Cape Canaveral is
hereby amended to read as follows:
Sec. 685.02 Establishing of No Parking Zones.
A. Except as provided in B. below, the chief law
enforcement officer may establish no parking zones by
designating those places where motor vehicles are prohibited
from parking. The chief law enforcement officer shall place
a sign or other identifying mark indicating no parking zones.
B. The City Fire Chief shall designate all fire lanes
in which it shall be unlawful for any vehicle to park. The
Fire Chief, or his designee, is hereby designated as a parking
enforcement specialist who may enforce prohibitions against
parking in fire lanes.
SECTION 3. Section 685.06, Penalties, of the City Code of
Ordinances of the City of Cape Canaveral is hereby amended to read
as follows:
Sec. 685.06 Penalties. Anyone violating any of the
provisions of this Chapter shall be punished in accordance
with the Schedule as set out below:

1. Parked in excess of Authorized Time
2. Parked in "No Parking" Zone
3. Parked in "Loading Zone"
4. Parked in Reserved Zone Without Permit

SECTION 4. Severability. If any section, paragraph, phrase,
or word of this Ordinance is held to be unconstitutional or
invalid, such portion shall not affect the remaining portions
hereof and it shall be construed to have been a legislative intent
to pass this Ordinance without such unconstitutional or invalid
part.
SECTION 5. Conflicting Provisions. Any ordinance, or parts
of an ordinance, in conflict herewith are repealed.
SECTION 6. Effective Date. This Ordinance shall take effect
immediately upon its adoption.
