AN ORDINANCE OF THE CITY OF CAPE CANAVERAL,
FLORIDA, AMENDING CHAPTER 624, "FLOOD DAMAGE
PREVENTION ", SECTION 624.20 (B) ENTITLED
"CONSTRUCTION STAGE" AND SECTIONS 624.27(A)
AND (B) ENTITLED RESPECTIVELY "RESIDENTIAL
CONSTRUCTION" AND "NON- RESIDENTIAL
CONSTRUCTION" OF THE CODE OF ORDINANCES OF THE
CITY OF CAPE CANAVERAL, BREVARD COUNTY,
FLORIDA; REPEALING ALL PORTIONS OF THE CODE IN
CONFLICT HEREWITH; PROVIDING A SEVERABILITY
CLAUSE; PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED, by the City Council of the City of Cape
Canaveral, Brevard County, Florida, as follows:
SECTION 1. Section 624.20 (B) entitled "Construction Stage"
of the Code of Ordinances of the City of Cape Canaveral, Florida is
hereby amended to read as follows:
"Sec. 624.07 B. Construction Stage.
Provide a first floor (i.e., lowest living area)
elevation which is a minimum of twelve (12) inches above
the crown of any street (measured at centerline) which is
contiguous to the site or flood - proofing certification
after the lowest floor is completed, or in instances
where the structure is subject to the regulations
applicable to Coastal High Hazard Areas, after placement
of the horizontal structural members of the lowest floor.
Upon placement of the lowest floor, or flood-proofing by
whatever construction means, or upon placement of the
horizontal structural members of the lowest floor,
whichever is applicable, it shall be the duty of the
permit holder to submit to the Building Official a
certification of the elevation of the lowest floor,
flood- proofed elevation, or the elevation of the lowest
portion of the horizontal structural members of the
lowest floor, whichever is applicable, as built, in
relation to mean sea level. Said certification shall be
prepared by or under the direct supervision of a
registered land surveyor or professional engineer and
certified by same. When flood- proofing is utilized for
a particular building, said certification shall be
prepared by or under the direct supervision of a
professional engineer or architect and certified by same.
Any work undertaken prior to submission of the
certification shall be at the permit holder's risk. The
Building Official shall review the floor elevation survey
data submitted. Deficiencies detected by such review
shall be corrected by the permit holder immediately and
prior to further progressive work being permitted to
proceed. Failure to submit the survey or failure to make
said corrections required hereby, shall be cause to issue
a stop -work order for the project."
SECTION 2. Section 624.27 (A) entitled "Residential
Construction" of the Code of Ordinances of the City of Cape
Canaveral, Florida is hereby amended to read as follows:
"A. Residential Construction. New construction or
substantial improvement of any residential structure
shall have a first floor (i.e., lowest living area)
elevation which is a minimum of twelve (12) inches above

the crown of any street (measured at centerline) which is
contiguous to the site. Should solid foundation
perimeter walls be used to elevate a building, openings
sufficient to facilitate the unimpeded movements of flood
waters shall be provided in accordance with standards of
Sec. 624.27."
SECTION 3. Section 624.27 (B) entitled "Non- Residential
Construction" of the Code of Ordinances of the City of Cape
Canaveral, Florida is hereby amended to read as follows:
"B. Non - Residential Construction. New construction or
substantial improvement of any commercial, industrial, or
non - residential structure shall have a first floor
elevation which is a minimum of twelve (12) inches above
the crown of any street (measured at centerline)
contiguous to the site. Buildings located in all A -zones
may be flood - proofed in lieu of being elevated provided
that all areas of the building below the required
elevation are water tight with walls substantially
impermeable to the passage of water, and use structural
components having the capability of resisting hydrostatic
and hydrodynamic loads and the effect of buoyancy. A
registered professional engineer or architect shall
certify that the standards of this subsection are
satisfied. Such certification shall be provided to the
official set forth in Sec. 624.20."
SECTION 4. Conflict. All portions of the Code in conflict
herewith are hereby repealed.
SECTION 5. Savings Clause. If any provision, paragraph,
word, section or article of this Ordinance is invalidated by any
court of competent jurisdiction, the remaining provisions,
paragraphs, words, sections and articles shall not be affected and
shall continue in full force and effect.
SECTION 6. Effective Date. This Ordinance shall take effect
immediately upon its adoption.
ADOPTED by the City Council of the City of Cape Canaveral,
