AN ORDINANCE OF THE CITY OF CAPE CANAVERAL,
BREVARD COUNTY, FLORIDA, AMENDING CHAPTER 611,
BUILDING CODE, OF THE CODE OF ORDINANCES OF
THE CITY OF CAPE CANAVERAL, FLORIDA, BY
ADOPTING THE 1993 REVISIONS OF THE STANDARD
BUILDING CODE; AMENDING SECTIONS 3202.4.1 AND
3204.1.2 OF CHAPTER 32, ROOF COVERINGS, OF THE
STANDARD BUILDING CODE; REPEALING ALL PORTIONS
OF THE CODE IN CONFLICT HEREWITH; PROVIDING
FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE
DATE.
BE IT ORDAINED, by the City Council of the City of Cape
Canaveral, Brevard County, Florida, as follows:
SECTION 1. Chapter 611, Building Code is hereby amended by
repealing Sections 611.01 and 611.02 in their entirety and
replacing same with the following:
Sec. 611.01 Building Code Adopted. The following Code
is hereby adopted by reference as though it was copied
herein fully: Standard Building Code - 1991 Edition,
with 1992 and 1993 revisions, by Southern Building Code
Congress International, Inc. ( "Standard Building Code ")
including Appendices "A" through "M ", with the exception
of Appendixes "B ", "I ", "K ", and "L" which have been
deleted.
Sec. 611.02 Sections Amended. Sections 101.4.1,
101.4.2, 101.4.3, 101.4.4, 105.3, 3202.4.1, 3204.1.2 of
the Standard Building Code are amended to read as
follows:
101.4.1 - Building Official Qualifications. The Building
Official shall have at least ten (10) years experience or
equivalent, as an architect, engineer, inspector,
contractor, or superintendent of construction, or any
combination of these for five (5) years of which shall
have been in responsible charge of work. The Building
Official should be certified as a Building Official
through a recognized certification program. The Building
Official shall be appointed or hired by the City Manager
and shall not be removed from office except for cause
after full opportunity has been given to be heard on
specific charges before the City Manager.
101.4.2 - Chief Inspector Qualifications. The Building
Official, with the approval of the City Manager, may
designate Chief Inspectors to administer the provisions
of the Building, Electrical, Gas, Mechanical and Plumbing
Codes. They shall have at least ten (10) years
experience or equivalent, as an architect, engineer,
inspector, contractor, or superintendent of construction,
or any combination of these for five (5) years of which
shall have been in responsible charge of work. They
should be certified through a recognized certification
program for the appropriate trade. They shall not be
removed from office except for cause after full
opportunity has been given to be heard on specific
charges in accordance with the City Code of Ordinances.
101.4.3 - Inspector Oualifications. The Building
Official, with the approval of the City Manager, may
appoint or hire such number of officers, inspectors,
assistants, and other employees as shall be authorized
from time to time. A person shall not be appointed or
hired as Inspector of Construction who has not had at
least five (5) years experience as a building inspector,
engineer, architect, or as a superintendent, foreman or

competent mechanic in charge of construction. The
inspector should be certified, through a recognized
certification program for the appropriate trade.
101.4.4 - Deputy Building Official. The Building
Official may designate as his deputy an employee in the
department who shall, during the absence or disability of
the Building Official, exercise all the powers of the
Building Official. The Deputy Building Official shall
have the same qualifications listed in 101.4.2. In the
event a Deputy Building Official is designated, he or she
shall serve as the Chief Inspector described in 101.4.2.
105.3 - Powers. The Construction Board of Adjustments
and Appeals shall have the power, as further defined in
105.4, to hear appeals of decisions and interpretations
of the Building Official and consider variances of the
technical codes. The City Board of Adjustment shall be
the Construction Board of Adjustment and Appeals.
3202.4.1 Nails, clips or familiar fastening devices
shall be hot - dipped galvanized, stainless steel, non-
ferrous metal or other suitable corrosion resistant
material.
3204.1.2 Shingle application shall be as specified in
the manufacturer's published application instructions.
Notwithstanding anything to the contrary contained
herein, asphalt shingles must be fungus resistant.
SECTION 2. All portions of the Code in conflict herewith are
hereby repealed.
SECTION 3. If any section, paragraph, phrase, or word of this
Ordinance is held to be unconstitutional or invalid, such portion
shall not affect the remaining portions hereof and it shall be
construed to have been a legislative intent to pass this Ordinance
without such unconstitutional or invalid part.
SECTION 4. This Ordinance shall take effect immediately upon
its adoption.
