ORDINANCE NO. 19 -92 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF CAPE CANAVERAL, BREVARD COUNTY, FLORIDA, BY AMENDING CHAPTER 639, ENTITLED "TOWNHOUSE REGULATIONS "; PROVIDING CHANGES IN THE TOWNHOUSE AREA AND DIMENSION REGULATIONS; PROVIDING FOR CHANGES IN THE MINIMUM TOWNHOUSE SET BACK REQUIREMENTS; PROVIDING LEGISLATIVE INTENT; REPEALING ALL PORTIONS OF THE CODE IN CONFLICT HEREWITH; ESTABLISHING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Cape Canaveral, Florida wishes to promote development within the City which is in conformity with and consistent with its comprehensive plan and is in furtherance of the public health, safety and welfare of the citizens of the City. NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Cape Canaveral, Brevard County, Florida, as follows: SECTION 1. Chapter 639, "Townhouse Regulations ", Code of Ordinances is hereby amended as follows: Section 639.03 entitled "Townhouse Area and Dimension Regulations" shall be repealed in its entirety and replaced with the following: TOWNHOUSE AREA AND DIMENSION REGULATIONS Minimum Area to be Developed 7,500 square feet Minimum Lot Area 2,800 square feet Minimum Lot Width 28 feet Minimum Lot Depth 100 feet Maximum Lot Coverage by all Buildings 40% of Site Area Minimum Building Width 20 feet Minimum Living Area plus 1,400 square feet a two (2) car garage per dwelling unit Maximum Building Length or width 175 feet TOWNHOUSE MINIMUM SETBACK REOUIREMENTS Front 25 feet Side, End Unit 8 feet Side, Interior Unit 0 feet Rear 25 feet 1 City of Cape Canaveral, Florida Ordinance No. 19 -92 Page 2 Side, Corner Lot 25 feet; on all nonconforming lots of record, 15 feet SECTION 2. Legislative Intent. Due to the existence of a large number of properties within the City which are conducive to the construction of townhomes and other dwellings which are accompanied by inadequate parking and in minimal compliance with quality and square footage requirements set forth by the City, it is the intent of this Ordinance to encourage the construction of single family dwellings, increase green areas, increase percolation, and increase parking, all in furtherance of the goals and objectives of the comprehensive plan and further to encourage the development and maintenance of single family detached dwellings on 50 feet wide, nonconforming lots of record. SECTION 3. Conflict. All portions of the Code in conflict herewith are hereby repealed. SECTION 4. Savings Clause. If any provision, paragraph, word, section or article of this Ordinance is invalidated by any court of competent jurisdiction, the remaining provisions, paragraphs, words, sections and articles shall not be affected and shall continue in full force and effect. SECTION 5. Effective Date. This Ordinance shall take effect two years from the date hereof. ADOPTED BY the City Council of the City of Cape Canaveral, Florida, this day of , 1992. ATTEST: Faith G.
