ORDINANCE NO. 46 -85
AN ORDINANCE AMENDING CHAPTER 631, ZONING
REGULATIONS, OF THE CITY OF CAPE CANAVERAL,
FLORIDA, BY AMENDING SECTION 632.01,
"DEFINITIONS ", BY AMENDING THE DEFINITION OF
"SETBACK "; BY AMENDING SECTION 639.01,
"OFF- STREET PARKING REGULATIONS" BY CREATING
A NEW SUB - SECTION (C) ENTITLED "ACCESS
CONTROL "; BY AMENDING SECTION 639.21,
"SETBACK ENCROACHMENTS "; BY AMENDING SECTION
639.33, "LOCATION OF RECREATIONAL VEHICLES,
CAMPING EQUIPMENT, BOATS AND BOAT TRAILERS ";
BY REPEALING ALL PORTIONS OF THE CODE IN
CONFLICT HEREWITH; BY PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED by the City Council of the City of Cape
Canaveral, Florida, as follows:
SECTION 1. Section 632.01, Definitions, is hereby amended
by deleting the definition of "Setback" in its entirety and
replacing it with the following:
Setback - A required open space on the same lot with a
principal building, which space is unoccupied and un-
obstructed by buildings from the ground upward, except
as specified in Sections 639.21 and 639.23. All
required setback areas shall be landscaped with
greenery (sod) and shall be properly maintained.
SECTION 2. Section 639.01, Off- street Parking Regulations,
is hereby amended by adding the following sub - section:
639.01 (C) Access Control
In order to promote the safety of (the) motorist and the
pedestrian, and to minimize traffic congestion and conflict
by reducing the magnitude of and the points of contact, the
following regulations shall apply:
1. A point of access (a driveway or other opening for
vehicles onto a public street) shall not exceed twenty -
four (24) feet in width, except as otherwise provided in
this section.
2. The maximum number of points of access permitted onto
any one street shall be as follows:
Lot Width Abutting Street
Less than 65 feet
65 feet - 200 feet
Over 200 feet
Number of Points of Access
One (1)
Two (2)
Two (2), plus one (1) for
each additional 200 feet
or fraction thereof.
3. In lieu of any two (2) openings permitted on any one
street, there may be permitted a single point of access
up to thirty -five (35) feet in width. However, service
stations shall be permitted two (2) openings not to
exceed thirty -five (35) feet each in width, along any
abutting public street, provided that such property
abuts such street for a distance of not less than one
hundred twenty (120) feet.

4. Except for single - family residential projects, there
shall be a minimum distance of twelve (12) feet between
any two (2) openings onto the same street. Single -
family residential projects shall not be permitted to
have an opening onto a street within three (3) feet of
the property line.
5. No point of access shall be allowed within thirty (30)
feet of the intersection of the right -of -way lines of
any public street.
6. No curbs shall be cut or altered, and no point of access
or opening for vehicles onto a public street shall be
established, without a permit issued by the City
Building Department.
7. Projects for which a site plan is required, such as
plaza developments, compound uses and shopping centers,
shall be considered on an individual basis and may
deviate from these requirements in the interest of
traffic safety, upon recommendation by the Planning and
Zoning Board.
SECTION 3. Section 639.21, Setback Encroachments, is hereby
amended by deleting sub - paragraphs (G), (H) and (I) in their
entirety and replacing with the following:
Sec. 639.21(G) - Parking may be located in a required front
or rear setback for single family and two family dwellings.
Sec. 639.21(H) - In the Commercial and Industrial zoning
districts, with the exception of any property abutting
Highway A1A and located north of the existing centerline of
Central Boulevard, required off - street parking spaces may be
permitted within ten (10) feet of the front lot line.
Sec. 639.21(I) - No required setback or landscape buffer
shall be used for any parking space or backout area, except
as specified in sub - paragraphs (G), (H) and (K) of this
section.
SECTION 4. Section 639.33, Location of Recreational
Vehicles, Camping Equipment, Boats and Boat Trailers, is hereby
amended by deleting sub - paragraph 639.33(C) in its entirety and
replacing with the following:
Sec 639.33(C) - In commercial and industrial zones, all
recreational vehicles shall be allowed to be parked in
accordance with Sec. 639.01 and Sec. 639.21
SECTION 5. All portions of the Code in conflict herewith
are hereby repealed.
SECTION 6. This Ordinance shall take effect immediately
upon its adoption.
