HomeMy WebLinkAboutOrdinance No. 29-1985 failed ORDINANCE NO. 29-85 AN ORDINANCE AMENDING CHAPTER 630, "ZONING REGULATIONS" OF THE CODE OF ORDINANCES OF THE CITY OF CAPE CANAVERAL, FLORIDA, BY AMENDING SECTION 632. 01, "DEFINITIONS" ; AMENDING THE DEFINITION OF "HEIGHT OF BUILDING" ; ESTABLISHING THE DEFINITION OF HEIGHT OF WALL; REPEALING ALL PORTIONS OF THE CODE IN CONFLICT HEREWITH; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED by the City Council of the City of Cape Canaveral, Florida, as follows : SECTION 1 . Section 632. 01 , Definitions , shall be amended by deleting the definition of "Height of Building" in its entirety and replacing it with the following: Height, Building- means the vertical distance from twelve (12) inches above the crown of the fronting street, natural grade, or top of foundation, whichever is lower, to the highest finished roof surface, in the case of. flat roofs or to a point at the average height of roofs having a pitch of more than one (1) foot in four and one-half (42) feet. No portion of any roof system shall-extend beyond the point of average by more than five (5) feet. SECTION 2. Section 632 . 01 , Definitions , shall be amended by establishing the definition of "Height of Wall" , as follows : Height, Wall - means the vertical distance to the top measured from the foundation wall, or from a girder or other intermediate support of such wall, whichever is lower. SECTION 3 . All portions of the code in conflict herewith are hereby repealed. SECTION 4. This Ordinance shall take effect immediately upon its adoption.
