ORDINANCE NO. 24 -85
AN ORDINANCE AMENDING CHAPTER 630, "ZONING
REGULATIONS ", OF THE CODE OF ORDINANCES OF
THE CITY OF CAPE CANAVERAL, FLORIDA BY
ESTABLISHING SECTION 635.25, "COASTAL
CONSTRUCTION SETBACK AND CONTROL LINES ";
REPEALING ALL PORTIONS OF THE CODE IN
CONFLICT HEREWITH; PROVIDING AN EFFECTIVE
DATE.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City
of Cape Canaveral, Florida, as follows:
SECTION 1. Section 635.25 of the Zoning Regulations of the
City of Cape Canaveral, Florida, is hereby established as follows:
635.25 COASTAL CONSTRUCTION SETBACK AND CONTROL LINES.
A. Cape Canaveral Coastal Construction Setback Line
Established. There shall be established and exist a Cape
Canaveral Coastal Construction Setback Line (City Setback
Line) for all property located within the incorporated
areas of the City of Cape Canaveral, Florida, East of State
Road AlA. Said Cape Canaveral Coastal Construction Setback
Line shall be located twenty -five (25) feet landward of the
Coastal Construction Control Line (CCCL) established by the
State of Florida Department of Natural Resources, purusant
to the provision of § 161.053, Florida Statutes, and shall
run parallel thereto.
B. Structures Prohibited.
1. No major structures, either habitable or non- habitable,
facilities, utilities, or any site alteration or minor
structures appurtenant thereto, which are minimum
requirements by the City of Cape Canaveral for the
issuance of a Certificate of Occupancy for said
property, shall be constructed seaward of the Cape
Canaveral Coastal Construction Setback Line (City
Setback Line) except for repairs to already exisitng
structures that in no way enlarge the existing
structure but merely bring it to its original
construction.
2. For purposes of this section, "habitable major
structures" shall include house, mobile homes, modular
homes, travel trailers, multi - family residential
buildings, condominiums, motels, hotels, restaurants,
towers, and other types of residential, commercial, or
public buildings.
3. For purposes of this section, "non - habitable major
structures" shall include swimming pools, bathhouses,
detached garages, cabanas, pipelines, piers, canals,
lakes, ditches, drainage structures, and other water
retention structures, roads, streets, highways, parking
areas, and other paved areas exceeding 10% of the site
area located between the Florida State Coastal
Construction Control Line and the Cape Canaveral
Coastal Construction Setback Line, underground storage
tanks and similar structures.
4. For purposes of this section, "minor structures" shall
include pile- supported, elevated dune and beach

walkover structures, beach access ramps and walkways,
stairways, viewing platforms, gazebos, boardwalks,
impervious areas not exceeding 10% of the site area
located between the Florida State Coastal Construction
Control Line and the Cape Canaveral Coastal
Construction Setback Line, life guard support stands,
cantilevered decks or porches on new or existing
structures, earth retaining walls, sand fences, privacy
fences, ornamental projects and other similar
structures and projects. Usage will not be the only
criterion used to classify structures as minor, but it
shall also be a characteristic of minor structures that
they are considered to be expendable under design wind,
wave, and storm forces.
5. For purposes of the section, "seaward" shall mean a
direction toward the Atlantic Ocean.
6. For purpose of this section "landward" shall mean a
direction away from the Atlantic Ocean.
C. Structures Permitted. Minor structures which are not
minimum requirements by the City of Cape Canaveral for the
issuance of a Certificate of Occupany for said property,
may be constructed seaward of the Cape Canaveral Coastal
Construction Setback Line; provided, however, that all
other applicable federal, state, and local zoning,
building, and construction codes and regulations are
satisfied.
Zoning Board of Adjustment
D. Variances. The eity- eouncrf of the City of Cape Canaveral,
Florida, is hereby allowed the authority to allow variances
to Sec. 635.25(B), and only to this section, and such
variances may be granted after public hearing, pursuant to
the following criteria and procedures:
1. A fully completed application for variance shall be
submitted by the property owner of record, or his
authorized representative, to the City of Cape
Canaveral Planning and Zoning Department, on a form
provided by the City of Cape Canaveral.

2. The C-i - eourrci-1- may grant the requested variance after
public hearing, in those cases where the facts
presented at the pubic hearing evidence the following:
a. The imposition of the Cape Canaveral Coastal
Construction Setback Line causes the applicant
unnecessary and undue hardship.
b. That the granting of the variance will not be
contrary to the public interest.
c. That the State of Florida Department of Natural
Resources, Bureau of Beaches and Shores, February,
1985, Survey Information, indicates the subject
property experienced less than twenty -five (25)
feet of beach dune erosion during the period of
September 1972, through February 1985. A copy of
said February 1985 survey is kept on file in the
office of the City Clerk.
d. The granting of the Variance will not be injurious
to other adjacent properties.
e. The conditions upon which a request for Variance
are based are peculiar to the property for which
the variance is sought and are not generally

applicable to other property and do not result from
actions of the applicant.
f. The variance is consistent with the intent and
purpose of the City of Cape Canaveral Zoning
Ordinance, the City of Cape Canaveral Comprehensive
Plan, and the requirements of this chapter.
g.
If the Board approves a variance, the Board may
attach such conditions to the variance as will
assure that the variance will comply with the
intent and purpose of this chapter.
3. The extent of the variance to the Cape Canaveral
Coastal Construction Setback Line granted under this
procedure may not exceed the difference between
twenty -five (25) feet and the actual erosion experience
on the subject property, as evidenced by the State of
Florida Department of Natural Resources, Bureau of
Beaches and Shores, February, 1985, Survey Information.
4. Regulation of construction seaward of the established
State of Florida Department of Natural Resources
Coastal Construction Control Line shall remain within
the ambit of the State of Florida Department of Natural
Resources permitting procedures.
5. All other federal, state, and local zoning, building
and construction codes, rules and regulations shall be
satisfied.
E. Cape Canaveral Coastal Construction Control Line. There
shall be established and exist a Cape Canaveral Coastal
Construction Control Line for all property located within
the incorporated area of the City of Cape Canaveral,
Florida. Said Cape Canaveral Coastal Construction Control
Line shall be located as depicted on the State of Florida
Department of Natural Resources, Bureau of Beaches and
Shores March 1985, Aerial Map which is kept on file in the
office of the City Clerk.
F. Construction Controlled. Prior to site plan approval or
the issuance of any building permit by the City of Cape
Canaveral Building Official, for construction of any
structures seaward of the established Cape Canaveral
Coastal Construction Control Line, the following
conditions shall specifically be met:
1. All habitable structures shall be set as far landward
as possible while still meeting existing City of Cape
Canaveral Building and Zoning Setback requirements.
Where a seawall or other coastal or shore protection
structure exists, proposed major structures shall be
located a sufficient distance landward of the coastal
or shore protection structure to allow for future
maintenance or repair of the coastal or shore
protection structure and seawall or bulkhead tie - backs.
2. All structures shall be designed so as to minimize any
expected adverse impact on the beach -dune system for
adjacent properties and structures, and shall be
designed consistent with policies set forth in Section
16B- 33.05, Florida Administrative Code.
3. Structures shall be constructed pursuant to all
applicable requirements set forth in Section 16B- 33.07,
Florida Administrative Code.

G. Additional Permit Application Requirements and Procedures.
In addition to those permit application requirements and
procedures for the issuance of a building permit by the
City of Cape Canaveral Building Official, any person
desiring to construct seaward of the established Cape
Canaveral Coastal Construction Control Line shall satisfy
the following additional application requirements and
procedures prior to the issuance of the building permit:
1. A statement describing the proposed work, activity, or
construction seaward of the established Cape Canaveral
Coastal Construction Control Line.
2. A statement giving specific reasons why the applicant
believes that the building permit should be approved,
and why construction seaward of the established Cape
Canaveral Coastal Construction Control Line is
necessary for the reasonable use of the property.
3. Two copies of a topographic survey of the subject
property, prepared or verified for accuracy not more
than six months prior to the date of application, and
certified by a land surveyor registered in the State of
Florida. The topographic survey shall include the
following specific information.
a. The location of the contour line corresponding to
elevation 0 NGVD.
b. The location of any existing vegetation line on the
subject property.
c. The location of the established State of Florida,
Department of Natural Resources Coastal
Construction Control Line, the Cape Canaveral
Coastal Construction Control Setback Line for the
full width of the subject property, including the
location and number of the two nearest State of
Florida Department of Natural Resources' baseline
monuments.
d. The location of any existing structures on the
subject property, and the location of any proposed
construction or activity showing their
relatioinship to the established State of Florida
Department of Natural Resources CCCL, the Cape
Canaveral Coastal Construction Control Line and the
Cape Canaveral Coastal Construction Setback Line.
4. The street address of the property, if available.
5. The applicant shall also submit two copies of detailed
final construction plans and specifications for all
proposed structures or excavation, including all
planned appurtenant structures and utilities. For
major structures and rigid coastal and shore protection
structures, these documents shall be signed and sealed
by the design engineer or architect, as appropriate,
who must be registered in the State of Florida.
6. The City of Cape Canaveral Building Official may
require the applicant to provide other site specific
information or calculations as is necessary for proper
evaluation of the application.
7. The above described conditions for issuance of a
building permit for construction seaward of the Cape
Canaveral Coastal Construction Control Line shall be

administered by the City of Cape Canaveral Building
Official.
SECTION 2. Alternate Remedies. In addition to any other
remedies, whether civil or criminal, for any violation of this
Ordinance by any person, the proper authorities of the City of Cape
Canaveral may institute any appropriate action or proceeding,
including injunction in a court of competent jurisdiction.
SECTION 3. Severability. If any section, paragraph,
subdivision, clause, sentence or provision of the Ordinance shall
be adjudged by a court of competent jurisdiction to be invalid,
such judgment shall not affect, impair, invalidate or nullify the
remainder of this Ordinance, but the affect thereof shall be
confined to the section, paragraph, subdivision, clause, sentence
or provision involved in said controversy in which such judgment
shall be rendered.
SECTION 4. Conflicting Regulation. In case of direct
conflict between any provision of this Ordinance and a part or
provision of any other applicable federal, state or local law,
rule, code or regulation, the more restrictive provision shall
apply.
SECTION 5. All portions of the Code in conflict herewith are
hereby repealed.
SECTION 6. This Ordinance shall take effect immediately upon
its adoption.
ADOPTED by the City Council of the City of Cape Canaveral,
Florida, this 21st day of May , 1985.
