ORDINANCE NO. 5 -84
AN ORDINANCE ESTABLISHING CHAPTER 629, "NATIONAL
FIRE PREVENTION CODE ", BY ADOPTING THE NATIONAL
FIRE PREVENTION CODE *3444- lD441- (NFPA #1); 1975 Filition, as
REPEALING ALL PORTIONS OF THE CODE IN CONFLICT ammded
HEREWITH; PROVIDING AN EFFECTIVE DATE.
WHEREAS, it is the desire of the City Council of the City
of Cape Canaveral, Florida, to adopt, in all respects, the
National Fire Prevention Code; and
WHEREAS, the adoption of this Code is done to facilitate
proper inspection activities by the City of Cape Canaveral, Florida
relating to construction and to maintenance of buildings within the
corporate limits of said City and relating to public safety, health
and general welfare.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the
City of Cape Canaveral, Florida, as follows:
SECTION 1. Chapter 629, entitled "National Fire Prevention
Code ", of the City Code of the City of Cape Canaveral, Florida,
is hereby established and shall read as follows:
CHAPTER 629
NATIONAL FIRE PREVENTION CODE
Sec. 629.01 National Fire Prevention Code Adopted.
The following Code is hereby adopted by reference as though
it was copied herein fully:
National Fire Prevention Code *4 9,4 -E442 ,e 1975 Edition,
(NFPA #1) as amended
Sec. 629.03 Municipal Fire Inspector. Whenever the
term authority having jurisdiction, or official, is used
in this Code, it shall be construed to mean the Municipal
Fire Inspector of the City of Cape Canaveral, Florida, or
his authorized representative.
Sec. 629.05 Penalty. Any and all persons who shall violate
any of the provisions of this chapter or shall fail to comply
therewith; or who shall violate or fail to comply with any
order or regulation made thereunder; or who shall build in
violation of any detailed statement or specifications or
plans submitted and approved thereunder; or any certificate
or permit issued thereunder; shall severally for each and
every such violation and non - compliance, respectively, be
punished as provided in Sec. 801.01.
SECTION 2. All portions of the City Code in conflict herewith
are hereby repealed.

This Ordinance shall take effect immediately
upon its adoption.

Florida, this 3rd day of April
