HomeMy WebLinkAboutOrdinance No. 19-1978MICROFILMED 3.14-80 ORDINANCE NO. 19-78 *AMENDED ON 2ND READING AN ORDINANCE AMENDING SECTIONS 637.31, 637.51, 638.23 AND *638.25, R -2, R -3 AND T -1 ZONING DISTRICTS OF THE ZONING REGULATIONS OF THE CITY OF CAPE CANAVERAL, FLORIDA, BY AMENDING THE MINIMUM SETBACK REQUIREMENTS FOR THE SIDE INTERIOR LOTS AND FOR REAR SETBACKS OF THE R -2 ZONING DISTRICT BY AMEND- ING THE MINIMUM SETBACK REQUIREMENTS FOR FRONT SETBACKS, SIDE INTERIOR LOT SETBACKS, SIDE CORNER LOT SETBACKS, REAR SETBACKS AND MINIMUM LIVING OR FLOOR AREA IN THE R -3 ZONING DISTRICT; BY AMENDING THE MINIMUM SEATING CAPACITY OF EATING ESTABLISHMENTS FROM 200 TO 50 IN THE T -1 ZONING DISTRICT; REPEALING ALL PORTIONS OF THE CODE IN CONFLICT HEREWITH; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED by the City Council of the City of Cape Canaveral, Florida as follows: SECTION 1. Chapter 630 of the Code of the City of Cape Canaveral, Florid, Zoning Regulations, is hereby amended as follows: (1) Section 637.31, Minimum Setback Requirements R-2 Zoning District by deleting the phrase "plus 3 feet for each story above the first" for the Side •(Interior Lot) setback requirement and.Rear setback requirements. *AMENDED ON * Delete the phrase "The 3 ft. requirement for each story above 2nd READING the first shall not apply to single family residences" for Side (Interior Lot). *AMENDED ON * Delete 20 Ft. in Rear and substitute 15 Ft. 2nd READING (2) Section 637.51, Minimum Setback Requirements R -3 Zoning District, amended as follows: (a) Delete Front Setback requirements in its entirety and substitute therefor the following: "FRONT: Residential, office, hotels and motels: 25 ft., Churches, hospitals and the like: 25 Ft." *AMENDED ON 2ND READING (b) Delete the phrase "plus 3 ft, for each 10 ft. or increment thereof over 20 ft. in height" in Residential, Offices, Hotels nd Motels, for Side Inter Lot setback requirements. Delete the phrase, "plus 3 ft. for each 5 ft. or increment thereof over 40 ft. in height" in_ lithurches, Hospitals and the like, for Side Interior Lot setback requirements. elete the phrases "plus 3 ft. for each story above the first. The 3 ft. requirement for each story above the first shall not apply to single family residences" under One family, two family and multiple family, for Side Interior Lot setback requirements, ORDINANCE NO. 19-78 PAGE 1 OF. 3 PAGES MICROFILMED 3-14 -80 *AMENDED ON 2ND READING (c) * Delete the phrase "plus 2 ft. for each 5 ft. or increment thereof over 40 Ft. in height" under Residential, offices, hotels and motels; SIDE CORNER LOT. Delete the phrase "plus 3 ft. for each 5 ft. or increment thereof over 40 ft. in height" under Churches, hospitals and the like, SIDE CORNER LOT. (d) Delete Rear setback requirements in its entirety and substitute therefor: "REAR: Residential, offices, hotels and motels: 15 ft. Churches, hospitals and the like: 25 Ft., 20 Ft. when abutting an alley." *AMENDED ON 2ND READING (3) Section 637.51, Area and Dimension Requirements - R -3 District Under Minimum Living or Floor Area One family: delete 1,050 and substitute 1,000; Two family: delete 850 and substitute 750, Multiple family, One bedroom delete 850 and substitute 650, Two bedroom delete 1,050 and substitute 750. (4) Section 638.23, Structures in the T -1 Zoning District by deleting paragraph B in its entirety and substituting therefor the following: "B. Eating establishments provided, however, that in no case shall there be•a seating capacity of less than fifty (50)." *Amended on * (5) Section 638.25 (B) Accessory uses and Structures in 2nd READING T -1 Zoning District by deleting the last sentence in paragraph "B" and substituting the following: "Eating and drinking establishments as accessory uses are not required to meet the 50 seat minimum capacity." This Ordinance shall become effective immediately upon its adoption. ADOPTED by the City Council of the City of Cape Canaveral, Florida, this 5 day of December , 1978.
