HomeMy WebLinkAboutOrdinance No. 11-1976kg- � MICRPFILMED o14'8C ORDINANCE NO. 11 -76 AN ORDINANCE AMENDING ORDINANCE NO. 5 -74, AS AMENDED, BY PROVIDING FOR GARBAGE FEES; ESTABLISHING A SCHEDULE OF GARBAGE FEES FOR SINGLE FAMILY RESIDENCES, CONDOMINIUMS, TRAILER PARKS, DUPLEXES AND APARTMENTS; BY PROVIDING FOR A CREDIT FOR AD VALOREM TAXES PAID; BY REPEALING ALL PARTS OF THE CITY CODE IN CONFLICT THEREWITH; BY PRO- VIDING AN EFFECTIVE DATE. BE IT ORDAINED by the City Council of the City of Cape Canaveral, Florida, as follows: SECTION 1. Ordinance No. 5 -74, as amended, is hereby amended by the addition of the following: Section 7. (A) Garbage Service Fees and Schedule of Rates All owners, residents, occupants and users of all resi- dential units and commercial establishments shall pay a fee for garbage service, based upon the following schedule: Single Family Dwelling Unit $3.00 per month Condominiums 3.00 per month per unit Mobile Home Parks 3.00 per month per space Duplex 3.00 per month per unit Apartments & Townhouses 3.00 per month per unit The above rates shall apply only to those dwelling units physically occupied during each monthly billing period or fraction of said month. For the purpose of this Ordinance a dwelling unit shall be held to be physically occupied for the entire month if said dwelling unit is so occupied for any portion of said month. These rates will be effective for garbage service rendered between May 1, 1976 and September 30, 1976. Section 7. (B) Credit for Ad Valorem Taxes Paid Each dwelling unit described in Paragraph 7 (A), shall receive a credit based upon the 3.31 Ad Valorem tax to the City pro rated per dwelling unit per :month. Section 7. (C) City Treasurer to Establish Billing and Accounting Procedures The City Treasurer shall be responsible for estab- lishing the necessary billing and accounting procedures as may be required to implement this Ordinance. These procedures shall contain a method to accurately determine whether or not the dwelling l 1 1 1 MICROFILMED 344-80 ea units provided for herein are physically occupied or unoccupied during the monthly billing period. Section 7. (D) Violations It shall be unlawful for any person to willfully and knowingly provide the City Treasurer with inaccurate figures per- taining to the occupancy or unoccupancy of any dwelling unit pro- vided for herein. Upon conviction hereof, those persons violating this Ordinance shall be punished as provided in Section 801.04 of the Code of the City of Cape Canaveral. SECTION 2. All Sections of the City Code in conflict herewith are hereby repealed. SECTION 3. This Ordinance shall become effective immediately upon its adoption.
