HomeMy WebLinkAboutOrdinance No. 29-1975MICROFILMED 3.14-80 ORDINANCE NO. 29 -75 AN ORDINANCE AMENDING CHAPTER 637 CITY OF CAPE CANAVERAL ZONING CODE PERTAINING TO SCHEDULE OF DISTRICT REGULA- TIONS BY AMENDING ZONING DISTRICT ENTITLED "SINGLE FAMILY MOBILE HOME" (MH -1); BY ESTABLISHING PRINCIPAL USES AND STRUCTURES; ACCESSORY USES AND STRUCTURES: BY PROVIDING FOR SPECIAL EXCEPTIONS; BY ESTABLISHING PRO- HIBITED USES AND STRUCTURES, AREA AND DIMENSIONS REGULATIONS, SETBACK REGULATIONS, OFF- STREET PARKING AND ACCESS; BY ESTABLISHING REGULATIONS PERTAINING TO SIGNS, DEVELOPMENT STANDARDS AND STREETS AND ROADS; BY REPEAL- ING ALL ORDINANCES OR PARTS THEREOF AND CODE SECTIONS AND PARTS THEREOF WHICH ARE IN CONFLICT HEREWITH; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED by the City Council of the City of Cape Canaveral, Florida, as follows; SECTION 1. Sections 637.61 through 637.73 of the Zoning Code of the City of Cape Canaveral, Florida are hereby amended as follows: "637.61 MH -1: SINGLE FAMILY. MOBILE HOME DISTRICT The provisions of this district are intended to apply to areas devoted to single family mobile homes. 637.63 PRINCIPAL USES AND STRUCTURES A. Single family mobile home units; B. Public recreational facilities; C. Home occupations. 637.65 ACCESSORY USES AND STRUCTURES A. Customary accessory uses of a residential nature, clearly incidental and subordinate to the principal use. Structures used for accessory uses shall be detached from the mobile home unit, shall have no sanitary plumbing or kitchen facilities and shall not be used for home occupations. 637.67 ATTACHED STRUCTURES Structures attached to mobile units shall be limited to screen- ed enclosures and shelters over patios or porches. These structures shall be constructed of metal, fiberglass or glass or any combination thereof and shall be comprised of manufactured components recognized by the component manufacturer as being suitable for use with a mobile home unit as a part of an attached structure. 637.69 SPECIAL EXCEPTIONS A. Schools, churches. 637.71 PROHIBITED USES AND STRUCTURES All uses not specifically or provisionally permitted herein. MICROFILMED 3.14.80 r 637.73 AREA AND DIMENSIONS REGULATIONS: MH -1 Minimum Site Size: Minimum site for development of an area shall not be less than 6 acres. Minimum Lot Size: An area not less than 6000 square feet and having a frontage of not less than 100 feet and having a depth of not less than 60 feet. Minimum Living Area: 500 square feet Maximum Height of Structure: 15 feet MINIMUM SET BACK REQUIREMENTS: MH -1 Front: 20 feet Side: 7 1/2 feet Rear: 15 feet 637.75 OFF- STREET PARKING Off - street parking and access to a public or private street shall be provided in accordance with Chapter 639, except that the two required spaces shall be paved with class B concrete, 4 inches thick and shall have a minimum area of 20 x 20 feet. 637.76 SIDEWALKS Sidewalks with a width of four feet, constructed of concrete in accordance with City specifications shall be provided on each side of all streets in the development with lot frontage. Sidewalks construction shall coincide with street paving and shall be complete before occupancy of any lot. 637.77 DEVELOPMENT STANDARDS The minimum design and construction requirements for potable water systems, sanitary sewer systems, storm drainage systems, grading and street paving, shall be in accordance with the requirements of Chapter 503 of the City Code pertaining to subdivision of land, except that streets shall have a minimum paved width of 20 feet and shall be located symetrically about the centerline of a 34 foot right of way. In addition, the following shall apply: (A) All electrical power, gas, community antenna television and telephone systems shall be underground, conforming to applicable ordinances, codes and utility company regulations. (B) A street lighting system providing illumination conforming to applicable standards of the Illumination Engineering Society shall be installed. (C) An adequate fire protection system consisting of fire mains, hydrants, and necessary appurtenances shall be provided. Plans and specifications for the fire protection system shall be approved by the City E sgineer and Fire Marshall before work is commenced on the system. The system shall be installed in accordance with the approved plans and specifications. ORDINANCE 29 -75 PAGE 2 OF 3 - s MICROFILMED 5.14.80 (b) All requirements of this section entitled "Development Standards" shall be complete throughout the entire development and approved by the City and other applicable agencies prior to occupancy of any lot. 637,78 NON- CONFORMITY: The provisions of Section 643 apply to this district except as follows: (A) Due to the limited life of mobile home units and the need to replace or upgrade these units from time to time, nothing contained in Section 643 shall pro- hibit the removal of a mobile home unit and /or the installation of a mobile home unit on a lot or lots in this district provided that the area and dimensions regulations and the minimum setback requirements for a MH -1 District in effect at the time of the passage of this ordinance are not violated. 637. 79 PERMIT The removal and /or installation of a mobile home unit shall be done only after a permit for this purpose is issued by the Building Official. SECTION 2. All ordinances and parts of ordinances, zoning code sections and parts thereof in conflict with this ordinance are hereby repealed. SECTION 3. This ordinance shall become effective immediately upon its adoption. ADOPTED by the City Council of the City of Cape Canaveral, Florida this 9th day of March, 1976.
