ORDINANCE NO. 33-74
AN ORDINANCE AMENDING ORDINANCE NO. 5 -74 WHICH
PERTAINS TO GARBAGE AND TRASH COLLECTION, BY
PROVIDING THAT USERS OF SAID SERVICE, INCLUDING
MULTIPLE DWELLING UNITS AND COMMERCIAL ESTAB-
LISHMENTS MAY USE MECHANICAL GARBAGE CONTAINERS
AND PAY TO THE CITY A MONTHLY RENTAL THEREFOR;
BY PROVIDING A SCHEDULE OF RENTAL RATES FOR
MECHANICAL GARBAGE CONTAINERS; REPEALING ALL
ORDINANCES IN CONFLECT HEREWITH; PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED by the Ci ty Council of the City of Cape Canaveral,
Florida, as follows:
SECTION 1. Ordinance No. 5 -74 pertaining to garbage and trash
collection is hereby amended as follows:
(1) Paragraph 1, Section 2, entitled "Garbage receptacles to be
provided" is deleted in its entirety, and the following new section is to
be substituted therefor:
"Section 2. Garbage receptacles to be provided:
(a) All owners, residents and all occupants of any residential unit
and the owner, user, manager or occupant of any multiple dwelling
unit or any place of business or commercial establishment within
the City are hereby required to provide garbage receptacles to hold
four (4) days accumulation of garbage.
(b) In lieu of garbage receptacles, a mechanical container or
containers may, upon request of the user, be used in place of
garbage receptacles. Said containers shall be provided by the
Collector and the owner, user, manager or occupant shall pay a
monthly rental fee to the City in accordance with the schedule of
rates set fort h in Section 2(d) of this Ordinance.
(c) It shall be the duty of the owner, manager, tenant or occupant
of any multiple dwelling unit to furnish or see that each unit with
cooking facilities of said multiple dwelling is furnished or supplied
with a garbage receptacle or receptacles or mechanical container
or containers adequate and sufficient in size to comply with the
terms of this Ordinance. All such receptacles or containers shall
be kept tightly covered at all times, except when it is necessary to
lift the cover for disposal or removal of garbage or to deposit
garbage therein. Multiple dwelling units containing 1ecc tha i4
un .cs or other commercial establishments or professional offices (Amend ea c
utilizing garbage receptacles other than mechanical containers 12 -3 -74)
shall be required to shield said receptacles by a screening device
or other suitable method as may be approved by the Building
Official of the City. It shall be unlawful for any person to deposit
garbage in such amounts in the receptacle or receptacles or
mechanical containers that will not permit the cover thereof to be
kept tightly in place.

(d) Schedule of Mechanical Container Rental Rates: The following
rental fees shall be charged by the City to the user as provided in
Section 2 hereof, in accordance with the following Schedule:
2 cu. yd. container
3 cu, yd. container
4 cu. yd. container
6 cu. yd. container
8 cu. yd. container
$11.00 per month
$13.20 per month
$15.40 per month
$17.60 per month
$20.90 per month.
The rental fees set forth in this Schedule are based upon the rental
fee as charged by the Collector to the City for said containers.
These rental fees are subject to a change in accordance with the
provisions of theContract between the Collector and the City.
All rental fees as provided herein to be paid by the user shall be
payable in advance.
(2) Section 11, entitled "Penalties, " shall be amended by the
addition of the following sentence:
"Prosecution and /or conviction for violations hereunder shall in no
way impair the right of the City to any civil redress available to
it for any violations hereunder or for non - payment of mechanical
container rentals, as provided herein."
SECTION 2. The payment of monthly rental fees for mechanical
containers as provided in Section 1 hereof shall commence DJce ber

SECTION 3. All ordinances or parts of ordinances in conflict here-
with are hereby repealed.
SECTION 4. This Ordinance shall become effective immediately
upon its adoption.
ADOPTED by the City Council of the City of Cape Canaveral, Florida,
