HomeMy WebLinkAboutResolution No. 1995-48• • RESOLUTION NO. 95 -48 A RESOLUTION OF TITIE CITY COUNCIL OF THE CITY OF CAPE CANAVERAL, BREVARD COUNTY, FLORIDA, REQUESTING THAT THE BREVARD COUNTY TOURIST DEVELOPMENT COUNCIL SET ASIDE ADDITIONAL FUNDING THROUGH ITS BEACH IMPROVEMENT GRANT PROGRAM TO FUND BEACH RENOURISHMENT PROJECTS. WHEREAS, the beaches of Brevard have experienced severe erosion damage primarily due to the lack of a sand bypass system and the Corps of Engineers use of hopper dredges for channel maintenance since the early 1950's when the harbor inlet was constructed to and including 1993; and, WHEREAS, a study of the erosional effect of the harbor inlet by the coastal engineering firm of Olsen Associates, Inc. was completed in 1992 indicated that the beaches south of the inlet were deprived of approximately 14 million cubic yards of sand with erosional effects 26 miles south of the inlet; and, WHEREAS, the Olsen study estimated that approximately eight million cubic yards of sand were removed from the harbor over a period of approximately 40 years by hopper dredges and deposited in an off -shore area well beyond the littoral zone as being a major contributor of beach erosion to the south; and, WHEREAS, as early as 1962 the Corps of Engineers documented in its General Design Memorandum that lack of a sand bypass system and the continuing use of hopper dredges would cause severe erosion to the south; and, WHEREAS, although the extension and tightening of the south jetty and a portion of the sand bypass was completed in the summer of 1995 as a federal mitigation project, this project was designed to reduce the amount of erosion of the beaches south of the inlet, but it will not replace the sand lost due to erosion over the 40 years of federal neglect since the harbor entrance was constructed; and, WHEREAS, the uplands within Canaveral Harbor are owned and operated by both Port Canaveral, a subdivision of the State of Florida, and the U.S. Department of Defense in support of commercial and military operations respectively; and, WHEREAS, the restoration of the beaches of Brevard are necessary to provide storm damage protection for $1 billion worth of building and structures and to preserve 20,000 tourist related jobs as well as provide Brevardians with a recreational beach; and, WHEREAS, the Jacksonville Corps of Engineers is expected to complete its Draft Feasibility Report for the Brevard Beach Restoration Project early in 1996; and, WHEREAS, the Clinton Administration has taken the position to exclude local beaches, such as Brevard County's, from the Corps of Engineers Beach Restoration projects; and, • City of Cape Canaveral, Florida Resolution No. 95 -48 Page 2 WHEREAS, the U.S. Congressional committees having jurisdiction over beach restoration projects have voiced a strong disagreement with the Clinton policy; and, WHEREAS, obtaining a federal project for beach restoration in Brevard County is appropriate as a mitigation measure because of the past actions and inaction by the federal government; and, WHEREAS, based on preliminary figures at the Brevard County Technical Conference it was conservatively estimated that with a federal project, local funds in the amount of $5.1 million will be required from Brevard County for its local share • $1.7 million in FY97 • $ .7 million in FY98 • $ .7 million in FY99. NOW, THEREFORE, BE IT RESOLVED, that the Brevard County Commission direct the Tourist Development Council as its highest priority to accrue the funds required as set forth above for Brevard County's local share of the federal beach renourishment project; and, NOW, THEREFORE, BE IT RESOLVED, that the Brevard County Commission, in conjunction with Port Commissioners and Mayors of the affected beach communities involved, aggressively and effectively lobby our State Legislative Delegation to obtain state matching funds in FY97, FY98 and FY99 for a federal beach restoration project; and, NOW, THEREFORE, BE IT RESOLVED, that Congressman Weldon, Senator Graham and Senator Mack use their good offices to introduce the Brevard Beach Renourishment Project for authorization in the Water Resource Development Act (WRDA '96) and to obtain appropriations in FY96 for the Corps of Engineers to continue design of the Brevard County Beach Restoration Project; and, NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Brevard Legislative Delegation, State Representatives Randy Ball, Howard E. Futch, Harry C. Goode, Jr. and Bill Posey, and State Senators Patsy Kurth and Charlie Bronson use their good offices to obtain matching funds in FY97, FY98 and FY99 for the state's share of a federal beach renourishment project for Brevard County; and • City of Cape Canaveral, Florida Resolution No. 95 -48 Page 3 DONE, ORDERED AND ADOPTED BY the City Council of the City of Cape Canaveral, Florida, _this, I7th day of October, 1995. r vet, APPROVED AS TO FORM: Kohn Bennett, CITY ATTORNEY John K.
