UTILITY EASES TO THE CITY OF THE WEST FIVE
FOOT (5') OF LOT 2 (ALONG RIDGEWOOD AVENUE,
INTERSECTING WITH THE EATING FIVE FOOT REAR
EASEMENT); PROVIDING FOR AN EFFECTIVE DATE,
WHEREAS, Scott and Melinda McCauley ( "Petitioner "), 601 Monroe Avenue, has
petitioned the City of Cape Canaveral to vacate the former twenty five foot (25') public utility

easement of Lot 2, Sea Monica I, according to Plat Book 36, page 45 of the County Public
Records; and
WHEREAS, the City Council has determined that it is in the best interest of the City to
vacate that easement.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City Cape
of Ca P
Canaveral, Brevard County, Florida, as follows:
SECTION 1, The City of Cape Canaveral hereby vacates the former twenty five foot
(25') Public Utility ty
ty Easement of Lot 2, Sea Monica I, according to Plat Book 36, page 45 of the
Public Records of Brevard County, Florida more particularly described as follows:
A parcel of land lying in Section 23, Township 24, Range 37, Lot 2, Sea Monica

SECTION 2, The vacation of the property described in Section 1 is contingent upon the
Petitioner granting the following easement to the City:
Five Foot (5') Public Utilities Easement on a parcel of land lying in Section 15,
Township 24, Range 37, west five foot (5') of Lot 2, Sea Monica I, Brevard
County, Florida

SECTION 3. The vacation of the property described in Section 1 is contingent further
upon the Petitioner paying all costs involved including, but not limited to engineering,
administrative, advertising and recording fees
SECTION 4. It is specifically understood that the vacated property cannot be used as
acreage for any density calculations.
SECTION 5. This Resolution shall take effect immediately upon its adoption.
ADOPTED BY the City Council of the City of Cape Canaveral, Florida, this 19th day
of September , 1995.
