HomeMy WebLinkAboutResolution No. 1995-23• • RESOLUTION NO. 95 -23 A RESOLUTION OF THE CITY OF CAPE CANAVERAL, BREVARD COUNTY, FLORIDA; ESTABLISHING A NEW SCHEDULE OF SEWER IMPACT ASSESSMENT FEES, UNDER APPENDIX B, CHAPTER 78, UTILITIES, ARTICLE II, SANITARY SEWER SYSTEM , SUBSECTION (e) IMPACT FEES OF THE CODE OF ORDINANCES OF THE CITY OF CAPE CANAVERAL, FLORIDA, SERVICE AREA; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 78 -129 of the City's Code of Ordinances of the City of Cape Canaveral provides for the adjustment of Sewer Impact Assessment Fees by Resolution, based on the Consumer Price Index; and WHEREAS, the Consumer Price Index for the previous year has changed and increased by 2.9 %. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cape Canaveral, Florida, as follows: SECTION 1. The Schedule of Fees contained in Appendix B, Chapter 78, Utilities, Article II Sanitary Sewer System, Subsection (e) Impact Fees of the Code of the City of Cape Canaveral is hereby deleted in its entirety and the following adopted in lieu thereof: RESIDENTIAL: Each single family dwelling unit $ 2,274.13 Each residential unit of a multiple family unit, duplex, triplex and /or apartment unit . • • 2,274.13 Each condominium unit 2,274.13 Each mobile home space 2,274.13 COMMERCIAL: The impact assessment fee shall be the greater of $2,274.13 or the amount calculated for the uses described below: Barber and beauty shops, per chair $ 568.53 Bowling alleys, per lane 568.53 • • • Churches, per seat Dentist offices, per doctor Doctor offices, per doctor Food Service operations 16.78 1,421.34 1,421.34 a. Restaurant, per seat 284.27 b. 24 -hour restaurant, per seat 426.41 c. Bar and cocktail lounge, per seat 170.10 d. Drive -in restaurant, per car space 284.27 Hospitals, per bed 1,421.34 Hotels, motels, per room 852.79 Laundry facilities, per washing machine 2,274.13 Nursing, rest homes, per person 568.53 Office building, per worker 114.17 Schools, per student 142.14 Service stations, per water closet and per urinal 1,421.34 Shopping centers without food or laundry, per square foot of floor space 0.56 Stores without food service, per square foot of floor space 0.56 Theaters, indoor, per seat 27.97 Travel trailer park without water and sewer hookup, per space 426.41 Travel trailer park with water and sewer hookup, per space 568.53 INDUSTRIAL: a. Impact fees for industrial or other commercial facilities not listed above shall be based upon either the use of the fixture unit count or the number of workers in an office building, whichever is greater. 1. The fixture unit count shall be that defined in the most recent plumbing fixture value table published by the Standard Plumbing Code. The table shall be reviewed annually. Each 18 fixture units, or fraction thereof, equals one equivalent single - family dwelling unit. Equivalent and fractional r City of Cape Canaveral, Florida Resolution No. 95 -23 Page 3 equivalents shall be multiplied by $2,274.13 to determine the applicable impact fee. 2. The impact fee associated with the numbers of workers in an office building shall be that listed under the commercial facilities. The number of workers shall be multiplied by $114.17 in order to determine the applicable impact fee. b. The minimum impact assessment fee for industrial and other commercial facilities not listed above shall be $2,274.13. SECTION 2. Savings Clause. If any provision, paragraph, word, section or article of this Resolution is invalidated by any court of competent jurisdiction, the remaining provisions, paragraphs, words, sections and articles shall not be affected and shall continue in full force and effect. SECTION 3. Effective Date. This Resolution shall take effect on July 1, 1995. ADOPTED BY the City Council of the City of Cape Canaveral, Florida, this 29th day of June , 1995. Sandra O.
