HomeMy WebLinkAboutOrdinance No. 17-19961 1 1 ORDINANCE NO. 17 -96 AN ORDINANCE OF THE CITY OF CAPE CANAVERAL, BREVARD COUNTY FLORIDA, AMENDING CHAPTER 110, ZONING, BY THE ADDITION OF PUBLIC SCHOOLS AS AN ALLOWABLE USE IN 'I'HE R-2, R 3 AND C -1 ZONING DISTRICTS, BY AMENDING SECTION 110- 292, PRINCIPAL USES AND STRUCTURES (R-2), 110-312, PRINCIPAL USES AND STRUCTURES (R-3), AND 110 -332, PRINCIPAL USES AND STRUCTURES (C -1); AND BY THE ADDITION OF VOCATIONAL SCHOOLS AND COLLEGES AS AN ALLOWABLE USE IN THE M -1 ZONING DISTRICT BY AMENDING SECTION 110 -352, PRINCIPAL USES AND STRUCTURES (M -1); PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED. by the City Council of the city of Cape Canaveral, Brevard County, Florida, as follows: SECTION 1. Section 110 -292, Principal Uses and Structures, in the R -2 zoning district is hereby deleted in its entirety, and the following is adopted in lieu thereof: Sec. 110 -292. Principal Uses and Structures. In the R -2 medium density residential district, the principal uses and structures shall be: (1) single - family dwellings; (2) two- family dwellings; (3) multi- family dwellings; or (4) public schools. Notwithstanding the foregoing, there shall be no more than fifteen (15) dwelling units per net residential acre, and dwelling unit rentals of less than seven (7) days are expressly prohibited. SECTION 2. Section 110 -312, Principal Uses and Structures, in the R -3 zoning district is hereby deleted in its entirety, and the following is adopted in lieu thereof. Sec. 110 -312. Principal Uses and Structures. In the R -3 medium density residential district, the principal uses and structures shall be: 1 1 1 City of Cape Canaveral Ordinance No. 17 -96 Page 2 (1) single - family dwellings; (2) two- family dwellings; (3) multi - family dwellings; or (4) public schools. SECTION 3. Section 110 -332, Principal Uses and Structures, shall be amended by the addition of a new subparagraph (14) as follows: (14) public schools SECTION 4. Section 110 -352, Principal Uses and Structures, shall be amended by the addition of a new subparagraph (7) as follows: (7) vocational schools and colleges SECTION 5. Any ordinance, or parts of an ordinance, in conflict herewith are repealed. SECTION 6. If any section, paragraph, phrase, or word of this Ordinance is held to be unconstitutional or invalid, such portion shall not affect the remaining portions hereof, and it shall be construed to have been a legislative intent to pass this Ordinance without such unconstitutional or invalid part. SECTION 7. This Ordinance shall take effect immediately upon its adoption.
