ORDINANCE NO. 15-95
AN ORDINANCE OF THE CITY OF CAPE CANAVERAL, BREVARD
COUNTY, FLORIDA, AMENDING ARTICLE II, ALARM SYSTEMS,
DIVISION 2, PERMIT, SECTION 30 -48, TERM: FEE: TRANSFERABILITY,
OF THE CODES OF CAPE CANAVERAL, FLORIDA, AMENDING THE
TERM REQUIREMENTS OF AN ALARM PERMIT; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL OF CONFLICTING
ORDINANCES AND RESOLUTIONS; AND PROVIDING FOR AN
EFFECTIVE DATE.
BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF CAPE
CANAVERAL, FLORIDA, as follows:
SECTION 1. SECTION 30 -48. Term: fee; transferability, is here deleted in its
entirety, and the following is adopted in lieu there:
(a) Alarm permits issued for the following uses shall have the following uses shall
have the following terms:
(1) Single family residential - No time limit subject, however, to the amended
application procedures required in Section 30- 47(b).
(2) Multi - family residential, commercial and industrial - One (1) year for date
of issuance. Such term to begin October 1 and end September 30. Any
alarm permit issued after October 1 will be valid through September 30.
(b) A fee as set forth appendix B to the Code shall be charged to the alarm user by
the City for each permit issued, including successive renewal permits, if any, to
defray the cost of regulation.
(c) Any alarm permit issued pursuant to this division shall not be transferable or
assignable and shall cover only one (1) building or premises.
SECTION 6. SEVERABILITY. If any section, paragraph, phrase, or word of this
Ordinance is held to be unconstitutional or invalid, such portion shall not affect the remaining
portions hereof, and it shall be construed to have been a legislative intent to pass this Ordinance
without such unconstitutional or invalid part.

SECTION 7. CONFLICTING PROVISIONS. Any ordinance or resolution, or parts
of an ordinance or resolution, in conflict herewith are repealed.
SECTION 8. EFFECTIVE DATE. This Ordinance shall take effect immediately upon
its adoption.
