ORDINANCE NO. 33 -94
AN ORDINANCE OF THE CITY OF CAPE CANAVERAL, BREVARD
COUNTY, FLORIDA, BY PROVIDING AN ADDITIONAL AMENDMENT TO
THE LIST OF AMENDMENTS IN SECTION 82 -32, AMENDMENTS OF
THE CITY CODE OF ORDINANCES, TO PLACE A TIME LIMIT ON THE
VALIDITY OF BUILDING PERMITS; PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES; AND
PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CAPE
CANAVERAL, BREVARD COUNTY, FLORIDA, as follows:
SECTION 1. Sec. 82 -32, Amendments of the city code of
ordinances, is hereby amended to add the new following subsection
(9). Section 103.6.1 is amended to read as follows:
Sec. 103.6.1. Permit Intent.
A permit issued shall be construed to be a license to
proceed with the work and not as authority to violate, cancel,
alter or set aside any of the provisions of the technical
codes, nor shall issuance of a permit prevent the Building
Official from thereafter requiring a correction of errors in
plans, construction, or violations of this code. Every permit
issued shall become invalid unless the work authorized by such
permit is commenced within six (6) months after its issuance,
or if the work authorized by such permit is suspended or
abandoned for a period of six (6) months after the time work
is commenced. Further, the permit shall become invalid after
twelve (12) months from the date of its issuance in the case
of construction occurring in the R -1 and R -2 zoning districts
of the City and eighteen (18) months in the case of
construction in R-3, C -1 and M -1 zoning districts in the City,
unless the building or buildings subject to the permit have
exteriors and landscaping which are in substantial compliance
with the plans and specifications and comply with the
provisions of Sec. 34 -96, Sec. 34 -97, subsections 34- 98(3),
(4), (5), (6), (7), (8), (9), and (11), Sec. 34 -99, and Sec.
34 -122 of the City Code of Ordinances. Extensions of time for
building permits may be granted only by the City Council.
SECTION 2. Severability. If any section, paragraph,
phrase, or word of this Ordinance is held to be unconstitutional or
invalid, such portion shall not affect the remaining portions
hereof and it shall be construed to have been a legislative intent

to pass this Ordinance without such unconstitutional or invalid
part.
SECTION 3. Conflicting Provisions. Any ordinance, or
parts of an ordinance, in conflict herewith are repealed.
SECTION 4. Effective Date. This ordinance shall take
immediately upon its adoption.
