ORDINANCE NO. 24 -94
AN ORDINANCE OF THE CITY OF CAPE CANAVERAL, BREVARD
COUNTY, FLORIDA, AMENDING ARTICLE III, SERVICE RATES.
DEPOSITS AND BILLING PROCEDURES, OF CHAPTER 78,
UTILITIES, OF THE CODE OF ORDINANCES OF THE CITY OF CAPE
CANAVERAL, BY ADDING TO SECTION 78 -151 TO PROVIDE FOR
PAYMENT OF DEPOSIT, TERMINATION OF SERVICES AND REFUND OF
UTILITY DEPOSIT; PROVIDING FOR SEVERABILITY; PROVIDING
FOR REPEAL OF CONFLICTING ORDINANCES AND RESOLUTIONS;
PROVIDING FOR AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City
of Cape Canaveral, Brevard County, Florida, that:
SECTION 1. The Code of Ordinances, City of Cape Canaveral, is
hereby
amended by adding the following subsections (c), (d) and (e)
to Section 78 -151 of Article III, Service Rates, Deposits and
Billing Procedures, of Chapter 78, Utilities, as follows:
(c) The deposit shall be paid to the city by the new
customer upon occupancy.
(d) The deposit shall be returned to the depositor upon
satisfaction of all outstanding balances, upon termination of
the service.
(e) Any deposit pursuant to this section shall be
refunded to the customer upon the satisfactory completion of
twenty -four (24) months service without a thirty -day
delinquency.
SECTION 2. Severability. If any section, paragraph,
phrase, or word of this Ordinance is held to be unconstitutional or
invalid, such portion shall not affect the remaining portions
hereof and it shall be construed to have been a legislative intent
to pass this Ordinance without such unconstitutional or invalid
part.
SECTION 3.
Conflicting Provisions. Any ordinance, or
parts of an ordinance, in conflict herewith is repealed.

SECTION 4. Effective Date.
