HomeMy WebLinkAboutOrdinance No. 23-1994ORDINANCE NO. 23 -94 AN ORDINANCE OF THE CITY OF CAPE CANAVERAL, BREVARD COUNTY, FLORIDA, AMENDING ARTICLE VI, CODE ENFORCEMENT, OF CHAPTER 2, ADMINISTRATION, OF THE CODE OF ORDINANCES OF THE CITY OF CAPE CANAVERAL, BY ESTABLISHING A CODE ENFORCEMENT BOARD PURSUANT TO CHAPTER 162, FLORIDA STATUTES; ESTABLISHING MEMBERSHIP OF THE CODE ENFORCEMENT BOARD; PROVIDING DUTIES OF THE CODE ENFORCEMENT BOARD; PROVIDING FOR PROSECUTIONS OF VIOLATIONS WITH NO CRIMINAL PENALTY; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES AND RESOLUTIONS; PROVIDING FOR AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Cape Canaveral, Brevard County, Florida, that: SECTION 1. The Code of Ordinances, City of Cape Canaveral, Article VI, Code Enforcement, of Chapter 2, Administration, including Sections 2 -246 through 2 -288 is hereby amended to read as follows: Sec. 2 -246. Enforcement Board authority granted successor statute. Sec. 2 -247. appoint members of with the terms of successor statute. ARTICLE VI CODE ENFORCEMENT BOARD Code Enforcement Board Created. A Code is hereby established pursuant to the by Chapter 162, Florida Statutes, or any Membership. The City Council shall the Code Enforcement Board in accordance Section 162.05, Florida Statutes, or any Sec. 2 -248. Duties, Responsibilities and Powers. The Code Enforcement Board shall have duties, responsibilities and powers as set forth, and shall be governed in all respects, by Chapter 162, Florida Statutes, or any successor statute, and shall have the power to hear appeals as otherwise set forth in the City Code of Ordinances. Sec. 2 -249. Prosecution of Violations with No Criminal Penalty. Any violation of the City Code of Ordinances which the City elects to prosecute before the Code Enforcement Board shall have no criminal penalty as to said violation. • • City of Cape Canaveral, Florida Ordinance No. 23 -94 Page 2 SECTION 2. Severability. If any section, paragraph, phrase, or word of this Ordinance is held to be unconstitutional or invalid, such portion shall not affect the remaining portions hereof and it shall be construed to have been a legislative intent to pass this Ordinance without such unconstitutional or invalid part. SECTION 3. Conflicting Provisions. Any ordinance, or parts of an ordinance, in conflict herewith is repealed. SECTION 4. Effective Date.
