HomeMy WebLinkAboutOrdinance No. 22-1994• • • ORDINANCE NO. 22 -94 AN ORDINANCE OF THE CITY OF CAPE CANAVERAL, BREVARD COUNTY, FLORIDA, ENACTING PROVISIONS TO MINIMIZE FIRE HAZARDS WITHIN THE CITY; PROVIDING RESTRICTIONS ON THE STORAGE AND DISPENSING OF FLAMMABLE MATERIALS AND LIQUIDS; RESTRICTING THE USE OF BOTTLED GAS AND REQUIRING A BUILDING PERMIT FOR THE USE OF BOTTLED GAS; SPECIFYING THE INSTALLATION OF DOORS IN PUBLIC PLACES; REQUIRING BATTERY BACK -UP FOR SMOKE DETECTORS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES AND RESOLUTIONS; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED by the City Council of the City of Cape Canaveral, Brevard County, Florida, as follows: SECTION 1. Section 38 -4 , Restriction on the storage and dispensing of flammable materials and liquids, is hereby created to read as follows: Sec. 38 -4 Restriction on the storage and dispensing of flammable materials and liquids. Except as provided in this section, it shall be unlawful for any person to store more than fifteen (15) gallons of gasoline, kerosene, or diesel fuel, except such greater amounts as are normally stored in the fuel tanks of motor vehicles in any residential area of the City. The provisions of this section shall not apply to above - ground liquid petroleum, central gas distribution systems for mobile home parks, as defined in section 110 -1, in existence on the effective date of this Ordinance. In no event shall above- ground storage of liquid petroleum, gasoline, kerosene or diesel fuel exceed two hundred and fifty (250) gallons in any residential area of the City. SECTION 2. Section 38 -5, Restriction on the use of bottled gas; permit required, is hereby created to read as follows: Sec. 38 -5. Restriction on the use of bottled gas; permit required. (a) Any person who utilizes bottled or tank gas as a fuel source for any structure within the City shall be required to obtain a building permit prior to the installation or replacement of any bottle, tank or other gas storage device. No building permit shall be issued and no hook -up shall occur unless the City fire inspector shall have certified to the building official that the storage device and • • City of Cape Canaveral, Florida Ordinance No. 22 -94 Page 2 the hook -up does not constitute a hazard to the residents of the City. This subsection (a) shall not apply to portable cooking devices. (b) This section shall apply only to new installations of bottled or tank gas and replacements of existing gas bottles or tanks occurring on or after October 1, 1994. SECTION 3. Section 38 -6, Doors to businesses or public halls, is hereby created to read as follows: Sec. 38 -6. Doors to businesses or public halls. All doors to business premises or premises used as gathering places for the public, for any purpose, shall be installed in a manner that such doors open to the outside of such premises. SECTION 4. Section 38 -7, Smoke detectors to have battery back -up, is hereby created to read as follows: Sec. 38 -7 Smoke detectors to have battery back -up. (a) Each smoke detector installed in any structure within the City which utilizes electric current provided by electric wiring connected to the structure's main electrical system as a primary energy source shall contain a battery - powered alternative energy source. (b) This section shall apply to smoke detectors installed after September 1, 1994. SECTION 5. Severability. If any section, paragraph, phrase, or word of this Ordinance is held to be unconstitutional or invalid, such portion shall not affect the remaining portions hereof and it shall be construed to have been a legislative intent to pass this Ordinance without such unconstitutional or invalid part. • • • City of Cape Canaveral, Florida Ordinance No. 22 -94 Page 3 SECTION 6. Conflicting Provisions. Any ordinance, parts of an ordinance, in conflict herewith are repealed. or SECTION 7. Effective Date. This ordinance shall take effect immediately upon its adoption.
