I feel that the Board is well served by its existing and alternate membership and this transition should be a smooth one. Memorandum To: Planning and Zoning Board From: Todd Peetz, City Planner Date: May 3, 2005 I Re: Agenda Overview for the May 11th P&Z Meeting IThe following is an overview for the May 11th meeting. 1) Special Exception 05-02 Residential in a C-1 zone. The project is also known as Shady Villas. Advance notice, we have a number of projects coming up, especially two comprehensive plan amendments, the first one on the Porter Property to change C-1 to R3 and R2 1 residential and the second is Mr. Greene's Mixed Use text amendment and a change from R3 to Cl. This will be heard on May 25th. Also submitted and probably won't be on the May 25th meeting is a changes to the land development code for mixed use districts, a special exception for a Cell Tower in the M-1 zone and several pending site plans which are relatively small at this time. Board Chairperson Bea McNeely called the meeting to order at 7:30 p.m. The Secretary called the roll. NEW BUSINESS: 1. Approval of Meeting Minutes: March 23, 2005. Motion by Lamar Russell, seconded by John Fredrickson to approve the meeting minutes of March 23, 2005. Vote on the motion carried unanimously. 2. Motion Re: First Addition to Beachside Townhomes - Preliminary Replat - Request for Time Extension - John Johanson, Applicant. Todd Peetz, City Planner, explained that Mr. Johanson has not obtained a building permit for the construction. Susan Chapman, Board Secretary, read code Section 98-47 regarding time limits. She advised that Mr. Johanson completed the first phase of this two phase project. She verified that Mr. Johanson has not obtained building permits for construction. She clarified that the Board could grant a one six-month extension of time, for good cause, according to the code. John Johanson, Applicant, advised that this replat was for a two-unit townhouse and the hurricanes delayed his project. He respectfully requested that the Board grant him a six- month extension, even though he planned to begin construction within the next few months. Discussion followed. Motion by Lamar Russell, seconded by Mr. Nicholas to approve the request for a six- month extension of the Preliminary Replat for First Addition to Beachside Townhomes. Vote on the motion carried unanimously. Planning & Zoning Board Meeting Minutes April 13, 2005 Page 2 3. Motion Re: Portside Villas - Revised Site Plan (Entry Gates) - John Wilt, Allen Engineering. Todd Peetz, City Planner, advised that the Board previously reviewed another revision to this project for the pool area however, the revision to the security gates at the entrance was not ready at that time. He advised that the City staff reviewed the revision to the entry gates and noted that the City Engineer's comment regarding the traffic pattern has been addressed. He verified that there are no problems with setbacks. Discussion followed regarding traffic backup on N. Atlantic Avenue at Villages of Seaport waiting for the owners to go through the entrance gate. John Wilt, representative for Allen Engineering, advised that a guardhouse was removed and gates added at the entrance. He explained that there will be two stacking areas. He verified that the project is being advertised as a gated community. Discussion followed regarding traffic congestion on N. Atlantic Avenue and how this revision to add gates could increase the current condition; and time frame for improvements on N. Atlantic Avenue. Mr. Russell noted that it was the best interest of the City to keep the flow of traffic moving. The Board inquired about the traffic study that should have been ready months ago. Todd Peetz responded that the first draft has been reviewed by City staff and the final draft should be ready by the next meeting. The Board also discussed placing a condition on the approval that the gates not be activated and kept open until the improvements are made on N. Atlantic Avenue. City Attorney Garganese advised that he could write a development agreement. Discussion followed regarding the Board making recommendations to the City Council. Motion by Mr. Nicholas, seconded by Mr. Fredrickson to recommend approval of the revised site plan with the proviso that the development agreement stipulate that the gates shall be kept open and not be activated until the road improvements are completed on N. Atlantic Avenue. Vote on the amendment carried unanimously. Vote on the main motion, as amended, carried unanimously. 4. Motion Re: Chadwick Townhomes - Preliminary Replat - Charles and Katherine Chadwick, Property Owners. Todd Peetz, City Planner advised that this was a request for approval of a preliminary replat for a two-unit townhouse located on the north side of Madison Avenue. He further advised that city staff reviewed the preliminary replat and recommends approval. Charles Chadwick, property owner, testified that he lives at 411 Madison Avenue which is located directly across the street from this property. He advised that he will save as many trees as he can. Discussion followed regarding tree protection and the amended landscape code. City Attorney Garganese advised that the applicant would need to seek approval from City Council for tree removal. He pointed out a few typos in the dedication. Mr. Chadwick advised that he would have the surveyor make the corrections. Planning & Zoning Board Meeting Minutes April 13, 2005 Page 3 Motion by Lamar Russell, seconded by Alice Filteau to approve the preliminary replat for Chadwick Townhomes. Vote on the motion carried unanimously. DISCUSSION: Bea polled the Board members to add some discussion items. Lamar Russell questioned why there was no vote or discussion by City Council on the proposed scooter ordinance. He advised that he spoke with Councilman Hoog before this meeting who did not recall the issue on an agenda. He questioned if City Attorney Garganese inquired to the City Council why no action was taken, as requested by this Board, at the last meeting. Attorney Garganese responded that due to the late hour of the last council meeting, some of the items on the agenda were not even addressed. Mr. Russell requested a copy of the City Council meeting tape and a copy of the agenda and meeting minutes where the ordinance should have been addressed. Todd Peetz gave an update on the density issue. He advised that the issue will be on the next City Council agenda next Tuesday night. Todd Peetz asked if the Board would consider canceling the next meeting because there were no paying applicants for new business, the only item that could possibly be on the next agenda would be to review the proposed draft ordinance amending Chapter 110. Motion by Chairperson McNeely, seconded by Vice Chairperson Nicholas to cancel the next meeting. Vote on the motion carried by majority, with John Fredrickson voting against. Todd Peetz updated the Board members on two upcoming Comprehensive Plan amendments. Todd Peetz advised that the density study would be presented to City Council at their next meeting. Approximately twenty-four (24) acres of park land exist in Cape Canaveral. This equates to a population of approximately 12,000 residents. The City's population as of April, 2004 was 9,807. This is still adequate park space available. AlA is operating at Level of Service "A" with 373 available peak hour trips between North City Limits and Central Blvd. AlA South of Central Blvd to North Atlantic has a level of Service is "A" with 368 excess trips. This development could generate 3-5 more peak hour trips as added into the Traffic Impact Analysis and capacity is available. The City of Cape Canaveral provides wastewater treatment. The wastewater treatment capacity is 1.8 million gallons per day (MGD). The existing usage is 1.26 MGD with an excess capacity of .54 MGD. This project could generate approximately 1,200 gallons daily. There is adequate wastewater treatment capacity available. The City of Cocoa has a total capacity of 56 MGD and currently provides 48 MGD. Approximately 24.4 MGD of water is being used on an average daily basis, leaving 23.6 MGD available. This project could require approximately 1,400 gallons daily. There is adequate potable water service available with the proposed change. Brevard County provides facilities for solid waste disposal. At this time, the County does not foresee any deficiency with their solid waste facilities. Environmental Description of Amendment Area: The site is vacant Palm Beach Pb soil type. Palm Beach soils are excessively drained sandy soils that consist of nearly level and gently sloping. There are no known wetlands, Aquifer Recharge or Floodplain areas associated with this parcel. There are also no known endangered species living on the site. Historical and Archaeological Resources in Amendment Area: There are no known historical or archaeological resources on site. Population Projections and Trends: The potential addition of 4 new town home units would equate to at 2.37 persons per household to 9-10 new persons to the City. If applicable, elevation drawing(s) or photograph(s) of proposed structure(s) are encouraged. • NOTE: Application fee of $250.00 is non-refundable upon payment to the City. • NOTE: Any balance from required deposit will be returned to the applicant upon written request minus all associated costs. 6 v CITY OF CAPE CANAVERAL SPECIAL EXCEPTION WORKSHEET The purpose of this worksheet are two-fold: (1) to assist the Planning and Zoning Board and the Board of Adjustment in the evaluation of all criteria relevant to the application; and (2) to educate the applicant as to the criteria which must be addressed and satisfied prior to beginning the special exception consideration process. If the applicant can not satisfactorily address one or more of the following, this should serve as a preliminary indication that the request for special exception may be rejected or that the application may not be acceptable for processing. CRITERIA (Building Official or Designee to Verify) 1) Does the Special Exception create any adverse impact to adjacent property through the creation of noise, light, vibration, traffic, utility requirements, or stormwater runoff that would not have been created had the property been developed as a principle use in the applicable zoning district. The special exception is for four (4) residential units. The requirements found in the land development code should be able to minimize any impacts created for adjacent property owners. Traffic would generate three to five additional peak hour trips. If developed as a commercial use,more than likely it would generate more peak hour trips. 2) Will the Special Exception create any unusual police, fire or emergency services? There should be no unusual needs or requirements for police, fire or emergency services. 3) Will the Special Exception meet all the requirements of the zoning district in which the request is to, be located, such as: lot requirements, building setbacks requirements, lot coverage, height, buffers, off-street parking, signs, storage, landscaping, etc.? The lot should be able to accommodate all of the above requirements. This will be determined during site plan review. 4) Is there adequate ingress and egress,with particular reference to auto and pedestrian safety and convenience,traffic flow and control, and emergency access in case of fire or medical emergency? There should be appropriate ingress and egress from this site. The access being proposed will be to Sea Shell Lane and North Atlantic Avenue. Access should be more closely evaluated at the site plan stage. There have been concerns with the number and proximity of driveway access points along North Atlantic. 5) Is there adequate off-street parking and loading areas available without creating undue noise, glare, odor or other detrimental effects upon adjoining property owners? It would appear that adequate off street parking could be accommodated on site. This will be determined during site plan review. 6) Is there adequate and properly located utilities available or may be reasonably provided to serve the proposed development (if applicable)? There are a full set of utilities available to serve the subject property. 7) Is there adequate screening and/or buffering provided to protect and provide compatibility to adjoining properties? It would appear additional Landscaping may be required being commercially zoned property fronting on public streets. A landscape plan was not included with the application. 8) Are signs and exterior lighting, if any, designed and arranged so as to promote traffic safety and to eliminate or minimize any undue glare, incompatibility, and disharmony with adjoining properties? Being a request for residential use the property should be compatible with the surrounding uses. This would be further evaluated as part of the site plan review. 9) Is there adequate refuse and service areas? There is adequate refuse capacity. Refuse service would be curb side pick up service. 10)Do the setbacks, landscaping, and open space meet the requirements of the zoning district? The project appears to be able to meet setbacks and open space requirements. Landscaping may need to be enhanced to be determined at the site plan review. 11)Is the proposed use compatible with surrounding uses in its function, its ours of operation, the type amount of traffic generated, structure size and setbacks, its relationship to land values and any other facts that may be used to measure or determine compatibility? The proposed use should be compatible with the surrounding uses, provided limited traffic impact and can meet setback requirements. 12)Is the Special Exception consistent with the goals, objectives and policies of the Comprehensive Plan? Jr. and Elizabeth C. Venable, Petitioners. Mr. McMillin, stated for the record that he was handed a note from legal counsel informing him of voting conflict provisions of Florida Statutes with which he was familiar. He advised that he attended all of the Planning & Zoning Board meetings concerning Mr. Venable's application, he lives on Holman Road, he does not have a financial conflict, the reason he attended all of the meetings was to make sure that the City did not make an error because they did not know and still did not know where the boundary is between C-1 and R-1 zoning districts South of Holman Road. He was satisfied with the research performed by Mr. Peetz revealing that Mr. Venable's property was in the C-1 zone. He stated that he did not have a voting conflict. G Board of Adjustment Meeting Minutes April 12, 2004 Page 2 Mr. Venable, Petitioner, testified that the property was located on Holman Road and is located in the back part of the C-1 property where the Tea Room and Hertz Rent-a-Car was located; the property was unique because it was located between C-1 and R-1 zoning; the purpose of the petition was to allow a gradual transition between the zoning districts by constructing multi-family; the proposed density was less than allowed by city code; he may decide to construct a lesser amount of units than the eight units depicted on the submitted conceptual site plan; he believed the special exception would be advantageous to everyone; it would prevent any commercial building up to 45 ft. in height from being constructed; the units will be an asset to the neighborhood. He advised that he would use curb-side trash service and verified whatever he does would meet the requirements of the city code, including adequate buffering. Mr. Peetz, City Planner, testified that the applicant has applied to construct eight units on property that allows ten units at maximum density. The City would be going through some administrative comprehensive plan amendments and rezonings to ensure the depth of the C-1 zoning district is met, per the City Council direction. Mr. Peetz verified the identified property in which the special exception was being sought. Mr. Peetz advised that the comment by the fire department regarding turning radius would be addressed during the site plan review process. Mr. McMillin voiced his concern that Fantasia Fantasy Golf has overflow lighting. Chairperson Rigerman responded that the city code has provisions to address overspill lighting through code enforcement. Mr. Peetz advised that landscaping, parking and buffering would be addressed during site plan review process. Mr. Venable advised that the City Manager informed him that the recommendation by the Planning & Zoning Board was to allow multi-family use, not limited to a certain number of units, not townhomes or condominiums, but recommended multi-family residential per the R-2 code. Mr. McMillin advised that city staff and the Planning & Zoning Board had reviewed, held discussion and based their recommendation on the information that had been submitted for eight condominium units. Mr. McMillin advised that at the third P & Z meeting, Mr. Venable said he would like the alternative of constructing six townhouses rather than eight condominiums and the P & Z minutes indicated that his request was lawful. Mr. McMillin disagreed with the City Attorney because city staff reviewed a certain submittal. Mr. Venable verified that the City Manager contacted him after the last P & Z meeting and told him that the approval was conceptual, approval is for multi-family, they were not approving the numbers, and he could construct what was allowed in the R-2 zoning code. The Board members disagreed with the City Manager and questioned why the City does not rezone the property. Mr. Morley, Building Official, gave examples of differences between townhomes and condominiums. Ms. Nutcher, Assistant to the City Attorney, responded that she knew that the City Attorney and Assistant City Attorney advised her that at this point, the project is at its conceptual stage and more detail can be involved at the site plan stage. At this point, the issue is whether to allow multi-family residential use in the C-1 district and not the specifics of how many units or what kind. She reiterated that the specifics would be during the site plan process. Mr. McMillin responded that this means after all the residents that were notified of this request go away, according to the City Manager and City Attorney, Mr. Venable can construct what is allowed in the R-2 code and not what was presented at the meetings. Mr. Venable responded that the neighbors should be happy to have eight or less units rather than more. Mr. Venable commented that the City Manager apprised him of the fact that it was an inappropriate approval and that it was a conceptual approval and not just the numbers and the Attorney was telling them the same thing. Discussion continued. Motion by Mr. McMillin, to grant the special exception for eight condominiums, as recommended by the Planning & Zoning Board. Discussion followed regarding the special exception process. Motion died for lack of a second. Motion by Mr. McMillin, seconded by Mr. Laws, that he be granted to do whatever is permitted in R-2 zoning on C-1 property. Discussion followed. Mr. Venable advised that the property is zoned C-1 and directly next to it is residential and a special exception will allow more desirable construction next to the residential. Special Exception Request No. 04-01 to Allow Outside Storage of Recreational Vehicles and Boats in the C-1 Zoning District, Section 14, Township 24 South, Range 37 East, West 70 ft. of Parcels C & D, Tutens Subdivision - Howard and Betty Gould, Petitioners. Mr. and Mrs. Gould, Petitioners, testified that they wanted to continue storing recreational vehicle and boats on the western 70 ft. of their property which is what they have been doing for approximately 20 years; they had gone through some process 20 years ago and thought they were granted a special exception for the use but no one can find the paperwork. Mrs. Gould advised that the storage area started for their tenants in the trailer park for safety reasons and now the city has a lot of condominium complexes that do not allow for parking or storage, so they are providing a service to the citizens of the city, as well as their own tenants. Discussion followed regarding comments by city staff. Mrs. Gould noted that the Planning & Zoning Board asked them to provide a buffer to block the outside storage from the street. Mrs. Gould offered to install Oleanders as a buffer as highlighted on the submitted site plan. Mr. Gould advised that the Oleanders would be planted outside the 70 ft. area to allow the RVs sufficient turning radius. Discussion followed. Mrs. Gould verified that their was fire department access provided off of Central Boulevard and through the park from N. Atlantic Avenue; they maintain the roadway and weedwack around the recreational vehicles. The Board members reviewed photographs of the property. Mr. Gould verified that there were no vertical obstructions. Mrs. Gould verified that all the vehicles were properly tagged with the exception of one that was being worked on; they would not pave the road or the area where the vehicles are being parked; the Oleanders would be planted to create a dense buffer to block the view from the street. The proposed amendments significantly revise and reorganize Chapter 110 with regard to the procedures and requirements forthe granting of rezonings,variances,special exceptions, and administrative appeals. Additionally, the amendments provide for the addition of specific criteria to be considered for rezonings. You may recall that this was an area of concern during the code review process as the current code does not provide such criteria. Because of the breadth of the amendments and the reorganization associated with same, the proposed changes go beyond the specific code sections reviewed at the February 15th workshop. The attached ordinance amends sections 110-26, up to and including, section 110-62, as well as sections 110-136, up to and including section 110- 139. I advise that this draft be presented at the next Code Review Workshop in lieu of picking up where we left off in February. ARTICLE II. PROCEDURE; LAND USE DECISIONS DIVISION 1. GENERALLY Sec. 110-26. Intent and Purpose. The intent and purpose of this article is to set forth the procedure and requirements for applying for variances,special exceptions,rezonings and administrative appeals,as set forth in this article. Authority. • (a) Unless otherwise provided in this chapter, the city council shall render all final decisions regarding rezonings and the board of adjustment shall render all final decisions regarding variances, special exceptions and administrative appeals. (b) The respective board rendering final decisions may impose reasonable conditions and safeguards on any approved rezoning, variance, special exception or administrative appeal to the extent deemed necessary and relevant to ensure compliance with applicable criteria and other applicable provisions of the city code and comprehensive plan. Such conditions and safeguards, when made part of the terms under which the rezoning,variance,special exception,or administrative appeal is granted,have the same force and effect as any other provision of this Code,and violation of same shall be deemed to be a violation of this Code and punishable by this Code. (c) All formal decisions shall be based on competent substantial evidence and the applicable criteria set forth in this article. Due process; special notice requirements. (a) All applicants shall be afforded minimal due process as required by law, including the right to receive notice, be heard, present evidence, cross-examine witnesses, and be represented by a duly authorized representative. (b) In addition to any notice requirements provided by state law,all public hearings under this article shall be publicly noticed for at least ten(10)calendar days prior to the date of the hearing. Said notice shall include the address of the subject property,matter to be considered and the time, date and place of the hearing. The notice shall be posted in the following manner: (1) Posting the affected property. (2) Posting at city hall. (3) Notifying,by certified mail,all owners of real property adjacent to and within five hundred(500) feet of the subject property. (c) When any proposed zoning district boundary change,variance,or special exception lies within 500 feet of the boundary of any property under another government's jurisdiction, notice shall be forwarded to the governing body of the appropriate government authority in order to afford such body an opportunity to appear at the hearing and express its opinion on the effect of said proposed district boundary change, variance or special exception. The city manager or the city manager's designee is hereby authorized to prepare applications in furtherance of this chapter. At a minimum, all applications for rezonings, variances, special exceptions, and administrative appeals shall be accompanied by the applicable application fee adopted by the city council and shall contain the following information: (1) A general description of the relief sought under this chapter. (2) A brief explanation as to why the application satisfies the relevant criteria set forth in this article. (3) The name(s) of the owner(s) of the particular real property. (4) If the applicant is other than all of the owners of the particular property, written consent signed by all owners of the particular real property shall be attached. (5) The legal description of the particular real property, accompanied by a certified survey or that portion of the map maintained by the Brevard County Property Appraiser reflecting the boundaries of the real property. (6) The current and future land use and the zoning designations on the real property. (a) Any variance or special exception approved by the board of adjustment pursuant to this article shall expire 12 months after the effective date of such approval unless a building permit based upon and incorporating the variance or special expiration is issued by the city within said time period. Upon written request of the property owner,the board of adjustment may extend the expiration date, without public hearing, by an additional 12-month period, provided the property owner demonstrates good cause for the extension. Such request shall be submitted to the board of adjustment prior to the expiration of the first 12-month period. In addition, if the aforementioned building permit is timely issued, and the building permit subsequently expires and the subject development project is abandoned or discontinued for a period of six months, the variance or special exception shall be deemed expired and null and void. (b) Thereafter, a variance or special exception shall expire and become null and void if the use granted thereunder is abandoned or otherwise ceases to exist for a period of 18 consecutive months. As used herein, abandoned shall mean that the applicant has gone out of business, let all business licenses lapse or has otherwise changed the use of the property in conformance with this Code. (c) All rezoning applications shall be reviewed for compliance with the following standards: (1) The proposed rezoning change is in compliance with all procedural requirements established by the city code and lawi (2) The proposed rezoning change is consistent with the city's comprehensive plan including,but not limited to,the Future Land Use Map and the proposed change would not have an adverse effect on the comprehensive plan; (3) The proposed rezoning change is consistent with any master plan applicable to the property; (4) The proposed rezoning change is not contrary to the land use pattern established by the city's comprehensive plan; (5) The proposed rezoning change would not create a spot zone prohibited by law; (6) The proposed rezoning change would not materially alter the population density pattern in a manner that would overtax the load on public facilities and services such as schools, utilities, streets, and other municipal services and infrastructure; (7) The proposed rezoning would not result in existing zoning district boundaries City of Cape Canaveral Ordinance No._-2005 Page 11 of 27 (DRAFT 4-4-05) that are illogically drawn in relation to existing conditions on the property and the surrounding area and the land use pattern established by the city's comprehensive plan; (8) Changed or changing conditions make the proposed rezoning necessary; (9) The proposed rezoning change will not seriously reduce light or air to adjacent areas; (10) Should the city be presented with competent substantial evidence indicating that property values will be adversely affected by the proposed rezoning, the applicant must demonstrate that the proposed rezoning change will not adversely affect property values in the surrounding area; (11) The proposed rezoning will not be a substantial detriment to the future improvement or development of vacant adjacent property; (12) The proposed rezoning will not constitute a grant of special privilege to an individual owner as contrasted with the public welfare; (13) The proposed rezoning change is not out of scale or incompatible with the needs of the neighborhood or the city; (14) The proposed rezoning does not violate any applicable land use regulations adopted by the city. (d) In approving a change in the zoning classification on a lot or parcel of land, at the request of or with the concurrence of the owner(s)of said lot or parcel,the city council may approve a rezoning subject to restrictions provided such restrictions do not confer any special privilege upon the owner(s)or subject property that would otherwise be denied by the city's land development regulations in the same zoning district. (2) That literal interpretation of this chapter would deprive the applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of this chapter and would work unnecessary and undue hardship on the applicant. (3) That the special conditions and circumstances referred to in subsection(e)(1) of this section do not result from the actions of the applicant. City of Cape Canaveral Ordinance No._-2005 Page 14 of 27 0 (DRAFT 4-4-05) (4) That approval of the variance requested will not confer on the applicant any special privilege that is denied by this chapter to other lands,buildings,or structures in the same zoning district. (5) That the requested variance is the minimum variance from this chapter necessary to make possible the reasonable use of the land,building or structure. (6) That approval of the variance will be in harmony with the general intent and purpose of this chapter, and will not be injurious to the neighborhood or otherwise detrimental to the public welfare. (d) Under no circumstances shall the board of adjustment grant a variance to permit a use not generally or by special exception permitted in the district involved or any use expressly or by implication prohibited by this chapter. DIVISION 4. SPECIAL EXCEPTIONS Section 110-38.Reserved. Special exception applicant obligations. (a) Any of the following may file a special exception application requesting a special exception from this chapter for their real property: (1) The owner(s)of the property described in the application. (2) Tenants, with the owner's sworn consent. (3) Duly authorized agents of the owner(s)of the property evidenced by a written power of attorney. (4) The city council. (5) The planning and zoning board. (6) The city manager. (b) Special exception applications shall be submitted at least 30 days prior to the planning and zoning board meeting at which such application is to be considered. (c) In addition to the application requirements set forth in this article,special exception applications shall indicate the section of this code under which the special exception is sought and state the grounds upon which the special exception is sought. City of Cape Canaveral Ordinance No._-2005 Page 15 of 27 (DRAFT 4-4-05) Sec. 110-39.Reserved: Procedure. (a) The planning and zoning board shall be required to review all special exception applications and make a written recommendation to the board of adjustment. Such recommendation shall include the reasons for the board's recommendation and show the board has considered the applicable special exception criteria set forth in this section. (b) Upon receipt of the planning and zoning board's recommendation, the board of adjustment shall make a final decision on the application. If the board of adjustment determines that the planning and zoning board has not made a recommendation on an application within a reasonable period of time,the board of adjustment may,at its discretion, consider an application without the planning and zoning board's recommendation. (c) All special exception recommendations and final decisions shall be based on the following criteria to the extent applicable: (1) Whether the applicant has demonstrated the special exception,including its proposed scale and intensity,traffic-generating characteristics, and offsite impacts, is compatible and harmonious with adjacent land uses, and will not adversely impact land use activities in the immediate vicinity. (2) Whether the applicant has demonstrated the size and shape of the site, the proposed access and internal circulation,and the design enhancements to be adequate to accommodate the proposed scale and intensity of the special exception requested. The site shall be of sufficient size to accommodate design amenities such as screening,buffers,landscaping,open space,off-street parking,and other similar site plan improvements needed to mitigate against potential adverse impacts of the proposed special exception. (3) Whether the proposed special exception will have an adverse impact on the local economy, including governmental fiscal impact, employment, and property values. (4) Whether the proposed special exception will have an adverse impact on the natural environment,including air,water,and noise pollution,vegetation and wildlife, open space, noxious and desirable vegetation, and flood hazards. (5) Whether the proposed special exception will have an adverse impact on historic, scenic, and cultural resources, including views and vistas, and loss or degradation of cultural and historic resources. (6) Whether the proposed special exception will have an adverse impact on public City of Cape Canaveral Ordinance No._-2005 Page 16 of 27 (DRAFT 4-4-05) services, including water, sewer, surface water management,police, fire,parks and recreation, streets, public transportation, marina and waterways, and bicycle and pedestrian facilities. (7) Whether the proposed special exception will have an adverse impact on housing and social conditions, including variety of housing unit types and prices, and neighborhood quality. DIVISION 5. ADMINISTRATIVE APPEALS Sec. 110-40.Reset%ed. Administrative appeals. (a) Any final administrative decision regarding the enforcement or interpretation of this chapter,where it is alleged there is an error by an administrative official,can be appealed as set forth in this section. Any of the following may seek review of an administrative decision pursuant to this section: (1) City council; (2) Planning and zoning board; (3) Any person aggrieved or affected by any decision of the building official in the interpretation of any portion of this chapter. (b) Appeals shall be taken within thirty(30) days after such administrative decision is made by filing a written notice of appeal with the building official and the board of adjustment stating the name of the decision maker, date of the decision, applicable code provisions and the specific grounds for appeal. Upon receipt of the notice of appeal, the building official shall schedule the appeal before the board of adjustment and transmit all documents, plans,papers or other materials constituting the record upon which the action appealed from was taken. (c) The board of adjustment shall be required to review all administrative appeals and prepare written findings constituting its final decision on the administrative appeal based on the criteria set forth in this section. (d) Review of administrative decisions shall be based on the following criteria: (1) Whether the applicant was properly afforded procedural due process; (2) Whether the decision under review is supported by competent, substantial evidence; and City of Cape Canaveral Ordinance No. -2005 Page 17 of 27 (DRAFT 4-4-05) (3) Whether the decision under review complied with applicable law, including a proper interpretation of any provision under this chapter. (e) An administrative appeal filed pursuant to this section stays all proceedings in furtherance of the action appealed from,unless the building official from whom the appeal is taken certifies in writing to the board of adjustment after the notice of appeal is filed that, because of facts stated in the certificate,a stay would,in the building official's opinion,cause imminent peril to life and property. In such case where the building official makes such certification, proceedings shall not be stayed other than by an injunction, which may be granted by the board of adjustment or issued by a court of competent jurisdiction. (f) The board of adjustment shall have the right to reverse or affirm,wholly or in part, or may modify the order, requirement, decision or determination as ought to be made, and to that end, shall have all the powers of the officers from whom the appeal is taken. This Ordinance shall be incorporated into the Cape Canaveral City Code and any section or paragraph, number or letter, and any heading may be changed or modified as necessary to effectuate the foregoing. Grammatical,typographical,and like errors may be corrected and additions,alterations, and omissions,not affecting the construction or meaning of this ordinance and the City Code may be freely made. Section 5. Severability. If any section,subsection,sentence,clause,phrase,word or provision of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction,whether for substantive,procedural,or any other reason, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions of this Ordinance. Section 6. Effective Date. This Ordinance shall become effective immediately upon adoption by the City Council of the City of Cape Canaveral, Florida.
