CODE ENFORCEMENT BOARD
MEETING MINUTES
JUNE 22, 2006
7:00 PM
A Regular Meeting of the Code Enforcement Board of the City of Cape Canaveral, Florida
was held on June 22, 2006, in the City Hall Annex, 111 Polk Avenue, Cape Canaveral,
Florida.
Chairperson Mary Russell called the meeting to order at 7:00 PM. The Board Secretary
called the roll.

The Board members established that the next meeting would be held on July 20, 2006.
Assistant City Attorney Latorre swore in all persons giving testimony.
NEW BUSINESS:

Approval of Meeting Minutes: May 25. 2006.
Motion by Mr. Stewart, seconded by Mr. Hale, to approve the meeting minutes of May 25,
2006, as written. Vote on the motion carried unanimously.

COMPLIANCE HEARINGS:
1. Case No. 05 -00094 — Violation of Section 22 -40 Approval Prerequisite for
Permits, and Sections 104.1.1 and 105.4 Florida Building Code - Permits &
Inspections, of the Cape Canaveral Code of Ordinances, (8797 N. Atlantic Ave.) —
Svend A. & Patricia L. Olesen, Co- Trustees.
Code Enforcement Officer, Duree Alexander testified that this Case is in compliance.
2. Case No. 05 -00123 — Violation of Section 104.1.1, and 105.4, Florida Building
Code - Permits & Inspections, of the City of Cape Canaveral Code of Ordinances,
(405 Holman Rd.) — Sandra Butler, Property Owner.
Code Enforcement Officer, Duree Alexander, provided an overview of the Violation and
the Case history. Officer Alexander testified that the respondent is working with the City
to come into compliance and is requesting that the Code Enforcement Board amend the
original Board Order to allow the respondent additional time.
Sandra Butler presented a letter (entered into the record as `Exhibit A') from Bill Young
stating that he is working with the building department to obtain the required permit. Mr.
Young further stated in his letter that he has met with Campbell Surveying to obtain a
survey of the deck and any wetlands that may exist. The survey is scheduled for mid
July; therefore, Mr. Young is requesting that this case be postponed until the August
meeting. Discussion followed.
Motion by Mr. Stewart, seconded by Mr. Godfrey, to accept staff's recommendation to
allow the respondent additional time. Discussion followed.
Motion by Mr. Stewart, seconded by Mr. Godfrey, to amend the motion to give the
respondent until August 17, 2006. Vote on the amended motion carried unanimously.
Vote on the original motion carried unanimously.
3. Case No. 06 -00013 — Violation of Section 22 -40 Approval Prerequisite for
Permits. of the Cape Canaveral Code of Ordinances. (8090 Astronaut Blvd.) —
Canaveral #30061 Inc., c/o Fredrick Ramirez. R.A.
Code Enforcement Officer, Duree Alexander provided an overview of the Violation and
the Case history. Officer Alexander testified that the respondent is in non - compliance
with the Order due to the fact that the respondent did not obtain approval from the
Community Appearance Board before the installation of the ground sign faces.
Officer Alexander respectfully requested that the Board find the respondent in non-
compliance and impose the fines as set forth in the Board Order until the respondent is
found in compliance. Discussion followed.
Chairperson Russell questioned whether or not a sign with a national logo should be
required to be submitted for approval to the Community Appearance Board.

Officer Alexander replied that the current sign code, Section 22 -40, requires that all
proposed sign alterations be presented to the Community Appearance Board for
approval.
Gordon Fraiser, business owner, stated that Chevron could not give an exact date on the
installation of the sign and erected the sign without prior notification. Mr. Fraiser further
stated that he is working on the Community Appearance Board submittal packet and
requested additional time.
Motion by Mr. Godfrey, seconded by Mr. Stewart, to amend the Board Order to give the
respondent until July 20, 2006 to come into compliance. Vote on the motion carried
unanimously.
PUBLIC HEARINGS:
1. Case No. 06 -00008 — Violation of Section 110.13, National Electric Code (NEC) —
Mounting and Cooling of Equipment Section 312.2; NEC — Damp and Wet
Locations, of the Cape Canaveral Code of Ordinances, (237 Cherie Down La.) —
Michael & Maurice P. Lindsey, Property Owner.
Code Enforcement Officer, Duree Alexander testified that this Case is in compliance.
2. Case No. 06 -00024 — Violation of Section 110.567(a)(4), Interior Landscaping for
Offstreet Parking Areas, of the Cape Canaveral Code of Ordinances, (8501
Astronaut Blvd.) — Pantelis Markogiannakis. Property Owner.
Code Enforcement Officer, Duree Alexander provided an overview of the Case history
and presented exhibits for the Board's review. Officer Alexander testified that the
respondent is in violation of the removal and replacement of landscape trees without
obtaining the required permit. Discussion followed.
Officer Alexander respectfully requested that the Board find the respondent in violation of
Section 110.567(a)(4), Interior Landscaping for Offstreet Parking Areas, of the Cape
Canaveral Code of ordinances, and be given until July 20, 2006 to come into compliance
or be fined seventy -five dollars ($75.00) for the first day and fifty dollars ($50.00) for each
day thereafter until the violation is corrected.
Motion by Mr. Viens, seconded by Mr. Godfrey, to accept staffs recommendation and
find the respondent in violation of Section 110.567(a)(4) and be given until July 20, 2006
to come into compliance or be fined seventy -five dollars ($75.00) for the first day and fifty
dollars ($50.00) for each day thereafter. Vote on the Motion carried unanimously.

Navinchandra C. Patel. R.A.
Code Enforcement Officer, Duree Alexander testified that this Case is in compliance.

OPEN DISCUSSION:
Walter Godfrey gave a brief overview of the Code Enforcement Board Members Seminar.
Mr. Godfrey stated that any Board Member that is unable to attend a meeting should
report to the Chairperson unless the Board agrees to designate another individual to be
the contact person. All Board Members agreed to designate the Recording Secretary as
the contact person for absent Members of the Code Enforcement Board.
