CODE ENFORCEMENT BOARD
MEETING MINUTES
NOVEMBER 17, 2005
7:00 PM
A Regular Meeting of the Code Enforcement Board of the City of Cape Canaveral, Florida
was held on November 17, 2005 in the City Hall Annex, 111 Polk Avenue, Cape
Canaveral, Florida.
Chairperson Mary Russell called the meeting to order at 7:00 PM. The Recording
Secretary called the roll.

The Board members established that the next meeting would be held on December 15,
2005.
City Assistant Attorney Latorre swore in all persons giving testimony.

1. Approval of Meeting Minutes: September 22, 2005.
Motion by Mr. Biederman, seconded by Mr. Hale to approve the meeting minutes of
September 22, 2005 as written. Vote on the motion carried unanimously.

COMPLIANCE HEARINGS:
1. Case No. 05 -00060 - Violation of Section 104.1.1 and 105.4 Florida Building Code
- Permits & Inspections, & Section 82 -116 Adoption of the National Electrical
Code, of the Cape Canaveral Code of Ordinances, (190 Center St.) — RJT Center,
LLC, Property Owner, c/o Ronald Abeles, MGRM.
Code Enforcement Officer, Duree Alexander testified that this case was in compliance.
PUBLIC HEARINGS:
1. Case No. 05 -00082 — Violation of Section 70 -69 License Required, of the Cape
Canaveral Code of Ordinances, (8210 Orange Ave.) — Richard R. Lambert,
Property Owner.
Code Enforcement Officer, Duree Alexander testified that this case was in compliance.
2. Case No. 05 -00086 — Violation of Section 94 -11 Maintenance, Notice to Repair, of
the Cape Canaveral Code of Ordinances, (8580 N. Atlantic Ave.) — M & P of
Brevard Inc., c/o Julie A. Blowers, R.A., Property Owner.
Code Enforcement Officer, Duree Alexander testified that this case was in compliance.
3. Case No. 05 -00087 — Violation of Section 94 -11 Maintenance, Notice to Repair
and Section 94-4 Exemptions, of the Cape Canaveral Code of Ordinances, (8590
N. Atlantic Ave.) — Shakti, Inc., c/o Manish Patel, R.A., Property Owner.
Code Enforcement Officer, Duree Alexander provided an overview of the Case History
and presented exhibits for the Board's review. Officer Alexander tested that the ground
sign is in need repair.
Officer Alexander respectfully requested that the Board find case number 05 -00087 in
violation of Chapter 94, Section 11, Maintenance., Notice to Repair; and be given until
December 22, 2005 to comply by obtaining a permit to repair the sign and have the
required final inspection. If the respondent is not in compliance by the above - specified
date; a fine of $50.00 for the first day of non - compliance and $25.00 per day thereafter
shall be imposed until found in compliance. Discussion followed.
Mr. Patel testified that he has called several sign companies in an attempt to have the
sign repaired. Art Kraft Sign Company agreed to write a proposal for the work to be
completed in December.
Motion by Mr. Stewart, seconded by Mr. Viens, to accept staffs recommendation to find
Shakti, Inc. in violation of Section 94 -11 Maintenance, Notice to Repair and come into
compliance by January 19, 2006 or be fined fifty dollars ($50.00) for the first day of non-
compliance and twenty -five dollars ($25.00) for each day thereafter. Vote on the motion
carried unanimously.

4. Case No. 05 -00096 — Violation of Section 94-11 Maintenance, Notice to Repair, of
the Cape Canaveral Code of Ordinances, (6952 N. Atlantic Ave.) — Gerald F.
Sale, Property- Owner.
Code Enforcement Officer, Duree Alexander provided an overview of the Case History
and presented exhibits for the Board's review. Officer Alexander testified that the ground
sign is in need repair.
Gerald Sale testified that it has been difficult to find a sign company to do the work;
however he stated that he has met with AFT Sign Company who has agreed to have the
sign repaired in three weeks. Mr. Sale requested that the Board give him four weeks to
complete the work.
Officer Alexander respectfully requested that the Board find case number 05 -00096 in
violation of Chapter 94, Section 11, Maintenance, Notice to Repair; and be given until
December 22, 2005 to comply by obtaining a permit to repair the sign and obtain an
approved final inspection. If the respondent is not in compliance by the above - specified
date; a fine of $50.00 for the first day of non - compliance and $25.00 per day thereafter
shall be imposed until found in compliance. Discussion followed.
Motion by Mr. Stewart, seconded by Mr. Hale, to accept staffs recommendation to find
Gerald Sale in violation of Section 94 -11 Maintenance, Notice to Repair and come into
compliance by January 19, 2006 or be fined fifty dollars ($50.00) for the first day of non-
compliance and twenty -five dollars ($25.00) for each day thereafter. Vote on the motion
carried unanimously.
5. Case No. 05 -00099 — Violation of Section 104.1.1 and 105.4 Florida Building
Code - Permits & Inspections, of the Cape Canaveral Code of Ordinances, (216
Polk Ave,) — Timothy J. Seppi, Property Owner.
Code Enforcement Officer, Duree Alexander provided an overview of the Case History
and presented exhibits for the Board's review. Officer Alexander testified that the
Respondent has replaced a concrete driveway without a permit or required inspections.
William Killgore, representative for the property owner, testified that he has an
authorization from the property owner to pick up the permit, but was not able to get to the
Building Department to pick up the permit this afternoon.
Officer Alexander respectfully requested that the Board find case number 05 -00099 in
violation of Section 104.1.1 and 105.4, Florida Building Code, Permits and Inspections;
and be given until December 22, 2005 to comply by obtaining a permit and obtain an
approved final inspection. If the respondent is not in compliance by the above - specified
date; a fine of $50.00 for the first day of non - compliance and $25.00 per day thereafter
shall be imposed until found in compliance. Discussion followed.
Motion by Mr. Viens, seconded by Mr. Hale, to accept staff's recommendation to find
Timothy Seppi in violation of Section 104.1.1 and 105.4, Florida Building Code, Permits
and Inspections, and come into compliance by January 19, 2006 or be fined fifty dollars
($50.00) for the first day of non - compliance and twenty -five dollars ($25.00) for each day
thereafter. Vote on the motion carried unanimously.

6. Case No. 05 -00101 — Violation of Section 94-11 Maintenance, Notice to Repair, of
the Cape Canaveral Code of Ordinances, (6103 N. Atlantic Ave.) — JWL, LLC, c/o
Keith Bennett, R.A., Property Owner.
Code Enforcement Officer, Duree Alexander provided an overview of the Case History
and presented exhibits for the Board's review. Officer Alexander testified that the ground
sign is in need of repair. Officer Alexander further testified that the sign is a non-
conforming sign and, with modifications to the sign, it could be brought into compliance
by moving it six feet back from the property line.
Officer Alexander respectfully requested that the Board find case number 05 -00101 in
violation of Chapter 94, Section 11, Maintenance, Notice to Repair; and be given until
January 19, 2005 to comply by obtaining a permit to repair the sign and obtain an
approved final inspection. If the respondent is not in compliance by the above-specified
date; a fine of $50.00 for the first day of non - compliance and $25.00 per day thereafter
shall be imposed until found in compliance. Discussion followed.
Motion by Mr. Biederman, seconded by Mr. Stewart, to accept staffs recommendation to
find JWC, LLC c/o Keith Bennett, R.A. in violation of Section 94-11 Maintenance, Notice
to Repair and come into compliance by January 19, 2006 or be fined fifty dollars ($50.00)
for the first day of non - compliance and twenty -five dollars ($25.00) for each day
thereafter. Vote on the motion carried unanimously.
7. Case No. 05 -00107 — Violation of Section 34 -96(d) Standards Established and
Section 10415.1.1 and 104.5.1.2 Florida Building Code - Permits, of the Cape
Canaveral Code of Ordinances, (227 Lincoln Ave.) — Patricia Harris, Property
Owner.
Code Enforcement Officer, Duree Alexander provided an overview of the Case History
and presented exhibits for the Board's review. Officer Alexander testified that the fence is
in need repair and missing sections. Officer Alexander further testified that the roof
permit has expired without the required inspections.
Officer Alexander respectfully requested that the Board find case number 05 -00107 in
violation of Chapter 34 Section 96(d) Standards Established, and Section 104.1.land
105.4, Florida Building Code, Permits and Inspections; and be given until December 22,
2005 to comply by obtaining the required permits and approved final inspections for the
roof and removal or repair of the existing fence, and further required the proper
maintenance of the yard. If the respondent is not in compliance by the above - specified
date; a fine of $50.00 for the first day of non - compliance and $25.00 per day thereafter
shall be imposed until found in compliance.
Motion by Mr. Viens, seconded by Mr. Hale, to accept staffs recommendation to find
Patricia Harris in violation of Chapter 34 Section 96(d) Standards Established, and come
into compliance by December 15, 2005 or be fined fifty dollars ($50.00) for the first day of
non - compliance and twenty -five dollars ($25.00) for each day thereafter. Vote on the
motion carried unanimously.
