HomeMy WebLinkAboutMinutes 03-17-2005CITY OF CAPE CANAVERAL • CODE ENFORCEMENT BOARD MEETING MINUTES MARCH 17, 2005 7:00 PM A Regular Meeting of the Code Enforcement Board of the City of Cape Canaveral, Florida was held on March 17, 2005 in the City Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida. Chairperson Mary Russell called the meeting to order at 7:00 PM. The Recording Secretary called the roll. MEMBERS PRESENT Mary Russell Chairperson Karen Hartley James Hale Craig Stewart Lars Holfve 1st Altemate Raymond yens MEMBERS ABSENT Walter Godfrey Vice Chairperson Charles Biederman George Pestik 2nd Alternate OTHERS PRESENT Duree Alexander Kate Latorre Joy Daine Code Enforcement Officer Assistant City Attorney Board Secretary The Board members established that the next meeting would be held on April 21, 2005. Assistant City Attorney Latorre swore in all persons giving testimony. NEW BUSINESS: 1. Approval of Meeting Minutes: February 17, 2005. Motion by Mr. Holfve, seconded by Mr. Hale to approve the meeting minutes of February 17, 2005. Vote on the motion carried unanimously. PUBLIC HEARINGS: 1. Case No. 04-125 — Violation of Section 70 -69 Occupational License Required, of the Cape Canaveral Code of Ordinances, (110 Polk Ave.) — Tim Grady. Property, Owner. Code Enforcement Officer, Dureb Alexander testified that this case was in compliance. • • Code Enforcement Board Meeting Minutes March 17, 2005 Page 2 2. Case No. 04-127 — Violation of Section 70-69 Occupational License Required. of the Cape Canaveral Code of Ordinances. (8117 Canaveral Blvd.) — Earl Sweigart, Property Owner. Code Enforcement Officer, Duree Alexander provided an overview of the Case History and presented exhibits for the Board's review. Officer Alexander testified that Estrella Emfridsson, business owner, has not obtained the required licenses for the various services currently offered on the premises. Officer Alexander stated that she has been working with the business owner since May 2004 for compliance. Andrea Bowers, City Treasurer, tested that it appeared four licenses would be required. Ms. Bowers further testified that a state license is required for the travel agent business and the employment agency prior to obtaining a City occupational license. Ms. Bowers stated that the advertised phone, Internet, mailboxes, and photo copying services may be licensed as "member services ". Ms. Emfridsson testified that two of the services advertised were referrals and the Internet service was free. Ms. Emfridsson stated that she felt she did not need an occupational license for those services. Officer Alexander recommended that Earl Sweigart, property owner, be found in violation of sections 70 -71, Engaging in Business Without Paying Tax, and 70-69, Occupational License Required, of the Cape Canaveral Code of Ordinances and be given until April 1, 2005 to obtain the required licenses or discontinue the services found to be in violation. If the respondent fails to comply by the above date, a fine shall be imposed in the amount of fifty dollars ($50.00) per day for the first day and twenty -five ($25.00) per day thereafter, until found in compliance. Motion by Holfve, seconded by Stewart to accept staffs recommendation. Discussion followed. Vote on the motion carried unanimously.
