MINUTES Mayor Rocky Randels called the Workshop Meeting of the Cape Canaveral City Council to order at 6:03 P.M. Council Members Present: Mayor Council Member Council Member Mayor Pro Tem Council Member City Attorney City Manager Administrative Assistant Rocky Randels Jim Morgan Larry Weber Buzz Petsos Richard Treverton Mark McQuagge Bennett Boucher Virginia Haas 1. Citv Attomev's Discussion/Presentation. City Attorney Mark McQuagge was introduced and it was noted that the City Attorney offers two free seminars per year. Attorney McQuagge addressed a question to council for Finance Director Andrea Bowers in that if council had any questions regarding the budget transfers they could be addressed at that time. Council had no questions regarding the budget transfers. Attorney McQuagge first called for any questions prior to beginning the workshop. Mayor Randels questioned the procedure for reading Resolutions. Attorney McQuagge responded that a resolution must first be read then discussion regarding the resolution may begin. Attorney McQuagge began discussing the duties and "Dual Capacity Positions" utilizing the Mayor position as an example. Attorney McQuagge discussed several hypothetical situations involving dual capacity positions. In essence, all reports, issues, requests 1 1 City of Cape Canaveral, Florida City Council Workshop Meeting December 18, 2001 Page 2 should be directed to the appropriate department to be handled by the appointed staff member. Attorney McQuagge reminded council that the City Attorney acts on the direction of council. The City Attorney must maintain order at the direction of the Mayor. Attorney McQuagge began discussion regarding the Sunshine Law and the computer age. Regarding correspondence using e- mails, Attorney McQuagge urged council to send initial inquiries or information to the City Manager and refrain from carbon copying other council members. At that point the City Manager could assess the content on a cases by case basis as to which e-mails could be broadcast to other Council Members. In addition, Attomey McQuagge suggested that the Council Members reserve any opinions or`;positions on issues for an open forum. There being no furth mousiness, the meeting adjourned at 7:00 P.M.
