Discussion regarding proposed Ordinance No. 10-97, Adopting a New Zoning District, C-2
Commercial/Manufacturing District:
AN ORDINANCE OF THE CITY OF CAPE CANAVERAL, FLORIDA, AMENDING
CHAPTER 110, ZONING, ARTICLE VII, DISTRICTS, BY THE ADOPTION OF A
NEW ZONING DISTRICT WITHIN THE CITY UNDER A NEW DIVISION 8, C-2
COMMERCIAL/MANUFACTURING DISTRICT, SETTING FORTH PRINCIPAL
USES AND STRUCTURES; USES BY SPECIAL EXCEPTION; PROHIBTl'ED USES;
AREA DIMENSIONS; SETBACKS; AND OTHER PERFORMANCE STANDARDS;
PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF
INCONSISTENT ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING
FOR AN EFFECTIVE DATE.
City Manager, Bennett Boucher, stated that the C -2 Zoning District issues has been discussed by the
Commercial Development Board and Planning & Zoning Board for over one year. He distributed a
map illustrating the areas affected.

Mayor Porter called for an informal vote to establish an understanding of the Council's current position
on establishing the new zoning district. Voting was as follows: Mr. Bruns, Against; Mr. Hernandez,
For, Mr. Petsos, For, Mayor Porter, For, and Mayor Pro Tem Randels, For.
Mr. Randy O'Brien, Cape Canaveral property owner and County Commissioner suggested that the list
of what is allowed in the proposed district, page 5 (15) of the ordinance would be more succinct and
cleaner to have a list of businesses that are disallowed in the C-2 district.
Mr. Bruns expressed concern with page 4 (1), body shops and the disallowable uses and page 6 (17),
allowable uses. Mr. Randels suggested that page 2 will clarify those issues. Mr. Bruns expressed
greatest concern that the City is specifying Special Exceptions, when it should be a goal to eliminate all
Special Exceptions.
City Attorney, Kohn Bennett, stated that the City specifies Special Exceptions in all zoning regulations
as a matter of policy.
Mayor Porter queried, what does it mean on page 1 in regard to principal uses, does it mean there can
be secondary uses? Mr. Bennett stated that the ordinance could state principal and secondary uses
allowable.
Mr. O 'Brien spoke again suggesting that the ordinance should specify what businesses do not quay
for Special Exceptions. He related that it would simplify Board consideration and time. He explained
that it is always a better approach to delineate disallowed items than trying to enumerate every
allowable business.
Mr. Pat Rooney, American Boom and Barrier, queried if every current business has been considered
carefully for this zoning?
City Attorney, Kohn Bennett, explained that this ordinance would change only the Future Land Use
Map and businesses current or in the future will apply for the zoning that want to utilize the C -2
district.
Mayor Porter further clarified that the proposed C -2 zoning incorporates C -1 uses with M-1 uses. He
explained that the ideas arose through discussions on ways to improve and revitalize A1A.
Mr. O'Brien queried if the comprehensive plan would have to be amended to amend the future land use
map. Mr. Bennett stated that it would.
Mr. Rodney Ketchum, resident, stated that it is not clear procedurally how a property owner would
have to request the zoning change. Will it be inordinately expensive?
Mr. Bruns queried if it is logical for us to loosen our zoning requirements when most areas are
tightening regulations.

Mayor Porter explained that the idea is not to limit owners and businesses.He related that M-1 zoning
produces good jobs.Further,there have been tremendous problems filling vacant office buildings.He
explained that the City needs to offer something to accommodate those buildings, such as allowing M-
1 establishments to be located to the rear of service and retail establishments.He reiterated that the idea
is to enhance the aesthetics and revitalize the business activity of ALA.

Mr.Bennett explained that it is not possible to force anyone to rezone to C-1, so the benefit is to go
with C-2 zoning.He explained that it gives incentive to have retail on front and industrial behind.

Mr.Petsos opined that paint and body shops should not have the option of C-2 zoning. It should be
taken out because it must be in an enclosed structure.He also suggested that page 9; subsection(b)
should reference Section 110-356 for special setbacks.
Mr. Arthur Berger,resident, opined that some properties already have no setbacks, and queried if that
means there will be no nonconforming buildings in the C-2 district. And if they are allowed,which
setbacks will be required, C-1 or M-1?
! I Mayor Porter explained that the intent is to fill older buildings,not to make it more difficult for them.

• Mr. O'Brien opined that Bingo facilities should be disallowed in the C-2 district. Mr.Randels explained
1 that Bingo facilities are already addressed in a current ordinance. He also queried about page 6,
permitting mini storage and storage garages is redundant because they are permitted in M-1 by Special

Exception.
Planning&Zoning Chair,Ms.Bea McNeeley, explained that the mini storage facilities was an issue
that Planning&Zoning could not agree upon.

Consensus was to eliminate towers,bingo, storage units and paint&body shops.
s Upon recommendation by Mr.Bruns, Council concurred that car storage is to be disallowed. There
was a suggestion to allow car storage behind frontage properties.
