MINUTES: Council Members Present Burt Bruns Tony Hernandez Buzz Petsos Mayor Pro Tem Rocky Randels Others Present City Manager, Bennett Boucher City Attorney, Kohn Bennett City Clerk, Sandra Sims Council Member Absent Mayor John Porter Longpoint Road Neighborhood Park Mayor Pro Tem Randels related guidelines for the meeting, stipulating that all would be heard; each shall be heard in order, three minutes would be allocated to each person, alternating between those pro and con, left to right, and front to back. He related that the meeting is for information gathering and that no vote would be taken on the issue at this meeting. Mr. Randels illustrated on the maps and aerials, the proposed location for a neighborhood park that would include some playground equipment. The park would be open from to dawn to dusk with no lighting. Against (Tape 1, 28) Don Arabian, 209 Long Point Road Mr. Arabian stated that he was appointed as spokesperson for residents of Long Point Road and was not adequately prepared to contain his comments to three minutes. Mr. Randels stated that Mr. Arabian would have another opportunity to speak after everyone had a chance to relate their views. He related that the 1988 Comprehensive Plan specified that there are 3,000 automobiles passing the proposed area per hour. He then related his calculations of converted gas burned per hour and the rate of diffusion to be 1 cubic yard per minute. He stated that an acceptable ratio of dilution is 10/1; which he calculated the dilution to be a higher ratio. Mr. Arabian's time allotment expired at this time. For (Tape 1, 176) Teresa Harden, 230 Columbia Drive Ms. Harden stated that children have no place to play and they are not going to be vandalizing. She opined that children should not be allowed to visit the park without supervision. She also related that the children need a bus shelter for inclement weather. Ms. Harden stated that there are a number of mothers working to convince the city to construct a park for children. Against (Tape 1, 317) Michelle Lehr, 210 Long Point Road Ms. Lehr stated that she purchased her home in January, 1996 and that she has no children. She related that she chose to live there because of her desire for quiet, and her concern is with potential noise. Ms. Lehr expressed concern that neither she nor other residents along Long Point Road were notified of the Board of Adjustment Meeting. She stated that beyond her own concerns, the emissions along A1A are detrimental to the health and safety of children if the park is established there. She related that a park should be advantageous to all residents, not just a single user group. She related that she is in favor of a park, not a playground with park-like attributes. She further opined that the proposed park would be an invasion of her street (Long Point Road) and is not adequate in size according to the County and City's Comprehensive Plan. For (Tape 1, 509) Corey Purvis, 230 Columbia Drive, #203 Ms. Purvis opined that auto emissions are not relevant. She also stated that there are children residing on Long Point Road. She related that the city should not wait for an accident to occur to facilitate a place for children to play. She stated that there are 25 children who wait at the bus stop in a dangerous area for vehicular traffic and they need a place to congregate and play. Against (Tape 1, 677) Marie Booker, 211 Long Point Road Ms. Booker stated that she moved to her quiet neighborhood on Long Point Road with few children, for that reason, and is opposed to the proposed park on Long Point Road. For (Tape 1, 704) Bob Gorham, Chairperson to the City's Recreation Board Mr. Gorham stated that he was present to listen on behalf of the board. He related that it has been the board's desire to provide park/recreational facilities for the west side of AlA and is keenly interested to hear the positive and negative attributes of the Long Point Road area designation. 1 1 1 City of Cape Canaveral Workshop Minutes Long Point Road Neighborhood Park April 24, 1997 Page 3 Against (Tape 1, 768) Robert Raber, 215 Long Point Road Mr. Raber stated that it is acceptable and understandable to provide a bus shelter, even with fencing to protect children from traffic and other harm. However, the proposed park is not suitable for the area on Long Point Road. He suggested that another site on Columbia Drive is appropriate. For (Tape 1, 822) Kelly Sellers, 230 Columbia Drive, #208 Ms. Sellers commented that carbon monoxide is not a relative issue. She spoke in favor of a fenced playground area designed for children under 12 years old. She related that there is no safe play area for children in the Columbia Drive neighborhood. She stated that the 15 miles per hour speed limit is not always followed and there is no safe place for children to ride bicycles. She submitted a list of signatures of people in favor of the park. (although there is no statement on the petition, the signatures are attached and incorporated into the minutes.) Against (Tape 1, 982) Christy Raber, 215 Long Point Road Ms. Raber stated that she is not anti - children and that she is in favor of a neighborhood park. However, the park should be designed for all ages. She opined that an abutting residential fence should not be a factor in securing the park. Ms. Raber stated that the city's lift station and the abutting gas station are obvious hazards, making the location unsafe. She stated that a pedestrian crossing button should be installed at the traffic light as an additional safety measure. Ms. Raber opined that the area is not sufficient in size to create a passive area for all ages; the playground equipment would likely require the full space. She also related that the city's comprehensive plan stipulates 1.5 acres per 1,000 population. She stated that the area considered for accommodation of a park has a population of 3,000 and the area denoted for the park is .5 acre. She opined that Columbia Drive is more geared to a neighborhood park/playground. For (Tape 1, 1134) Tim Sellers, 230 Columbia Drive, #208 Mr. Sellers queried, why discriminate against children? He stated that it doesn't matter where, just provide them with a park. Against (Tape 1, 1192) Lee Coates, 220 West Long Point Road Ms. Coates stated that the idea of a park is good and children should be protected and have a place to play. She opined that, however, the proposed lot is not big enough to accommodate the proposed park without noise intrusion to abutting residents. Ms. Coates stated that a bus shelter should be erected and consideration given to utilizing the Manatee Sanctuary Park or another area in the Columbia Drive area. She also queried, where will the funds to purchase the proposed lot be derived? 1 1 1 City of Cape Canaveral Workshop Minutes Long Point Road Neighborhood Park April 24, 1997 Page 4 For (Tape 1, 1340) Judy Hale, 110 Washington Avenue Ms. Hale opined that the city should provide all children a safe place to play . Against (Tape 1, 1442) Jackie Coates, Beautification Board Chairperson Ms. Coates stated that as April 9, 1996 and May 14, 1996 minutes would reveal, the subject of a west side park has been explored by the Beautifcation Board and were under the impression that a small property on Columbia Drive was being considered and recommended that a bus shelter should be constructed. She asked the following questions: 1. Does the city own the proposed property? 2. If leased, when was it leased, and what are the options? 3. What is the duration of the lease and the cost? Ms. Coates opined that the property has little residential or commercial use, therefore, its best use is as a passive park with benches and a bus stop. She related that in the event the purchase is not made and the lease expires, the property could be returned to its original state easily. For (Tape 1, 1720) Cindy Freburg, 7101 Ridgewood Avenue, #208 Ms. Freburg stated that she represents several parents from Cape View Elementary School. She is PTO president. Ms. Freburg stated that children are not an infliction and that an empty lot converted to a park can be beautiful with playground equipment included in the park setting. She stated that she is willing to support and volunteer to help implement the park. Against (Tape 1, 1850) Cindy Knight, 208 Long Point Road Ms. Knight stated that she has two children and four grandchildren, and certainly is not anti- children. She related that she is opposed and thought the proposed park was passive, not including playground equipment. For (Tape 1, 1890) Joy Salamone, 7103 N. Orange Avenue Ms. Salamone stated that during her tenure as Mayor of the city, at least seven years ago, west side parents had lobbied for a park to preclude children from having to cross A1A. She related that there are different parents now with the same problem as seven years ago. Ms. Salamone suggested that the history of the issue should be considered. She stated that continuous search has been made to locate an affordable, safe place to provide a neighborhood park with particular focus on children. Against (Tape 1, 2034) Mike Palm, 205 Long Point Road, across the street from the proposed park Mr. Palm opined that the way the park was proposed is wrong. He stated that the area is not a park, it is proposed to be a playground. 1 1 1 City of Cape Canaveral Workshop Minutes Long Point Road Neighborhood Park April 24, 1997 Page 5 For (Tape 1, 2105) Megan Dack, 230 Columbia Drive Ms. Dack, an elementary school child, expressed her concern to have a place to play regardless of whether it is called a park or a playground. Against (Tape 1, 2147) Joe Knight, 208 Long Point Road Mr. Knight stated that the cost will be $25,000 to get the park going. He also stated that the lease is with an option to purchase the property. He related that according to the proposed plans, the park will be open on one side, so it can not be considered an enclosed park. Mr. Knight related that he recently moved to Long Point Road from Columbia Drive where he resided for 8 years and does not choose to have the Columbia Drive residents using a park adjacent to his home on Long Point Road. He also opined that the proposed plan is for a playground, not a park. For (Tape 1, 2290) Rolanda Dack, 230 Columbia Drive Ms. Dack stated that a meeting should not be required for the city to provide a playground or park for children. She opined that all citizens should be concerned about the way we speak, drive and live with people, who include children. She stated that safety is an issue and the city should be concerned about children as they will be our future. There were no other people speaking against the issue, therefore, the following children were given an opportunity to speak in favor. For (Tape 1, 2471) Brandy Nicole stated that she wants a park. Gabriel Catrono stated that she wants a park because she can't watch television. Amanda stated that she wants to play in the park. Council Member, Buzz Petsos, stated that an expert witness would be required for the Council to consider auto emissions as an environmental factor. (Tape 1, 2560) The Audience was given a second opportunity to speak on relevant matters which had not yet been addressed Against (Tape 1, 2610) Don Arabian Mr. Arabian stated that he is an aeronautical engineer and knows the subject matter of emissions. He stated that he lives there and wants a park for children. He opined that the place is not good because it is on the west side of Al A, creating health and safety issues which are scientifically proven. Against(Tape 1, 2820) Lee Coates Ms. Coates stated that the proposal is for a playground, not a park. She opined that there should be a buffer around the residential zone if all other areas have been researched and exhausted. Further, any playground equipment should be of natural substances. For(Tape 1, 2927) 1 Corey Purvis Ms.Purvis stated that buffer zones are appropriate. t Against(Tape 1, 3020) Michelle Lehr Ms. Lehr stated that she has obtained minutes from all the boards since 1994 where a park on Long Point Road is mentioned. She stated that it always refers to the park as a "neighborhood park," never 1 as "a playground". She opined that it is not compatible with the adjacent neighborhood as required by the comprehensive plan. Ms. Lehr stated that there is a reason that there are no parks on the west side of AlA from the Port south to Indialantic. She queried, why has property not been considered for condemnation on Columbia Drive for the proposed park. For(Tape 1, 3450) I I Kelly Sellers 1 Ms. Sellers stated that there are children on Long Point Road and on Sunset who are a part of the I neighborhood. Against(Tape 2, 50) Sandy Wilson,Long Point Road Ms. Wilson stated that no one has approached the Long Point Road residents with questions as were the Columbia Road residents. Further, no one notified them of the clean up project at the proposed I park site. She expressed concern that the park plan was in working mode before the residents were contacted. She opined that Mr. Arabian has a good natural proposal for the proposed park area.
