MINUTES
The Workshop Meeting of the Cape Canaveral City Council was called to order at 5:20 P.M. by
Mayor Pro Tem Rocky Randels.

Evaluation_and Appraisal Report (E.A.R)
1. Review the E.A.R for changes and additions.
Council agreed by majority to defer the second portion of the meeting until Mayor Porter was
present. Mr. Mel Scott, Senior Planner, Brevard County Management was present as technical
planner for the E.A.R discussion. Mr. Scott explained that the E.A.R set for structure to make
future changes to the Comprehensive Plan, and that the E.A.R provided the essence for the
Comprehensive Plan. The E.A.R however was not binding in form. Discussion followed on
Department of Community Affairs intervention in judiciary matters. Mr. Scott explained that
every Comprehensive Plan must have minimum standards. He stated that once adopted a
Comprehensive Plan becomes an obligation to perform. The E.A.R would provide an evaluation
of past performance and an assessment of future direction for the city. He noted that any changes
in the E.A.R. on Council's part could be made at a future date.
Beatrice McNeely, Planning and Zoning Board Chairperson, stated that the City's Mission
statement should be added. Mr. Boucher opened discussion with Chapter Three. Mr. Petsos
recommended to strike "no plans for future annexations under Policy 2 - 4, page 10. Council

agreed by majority to strike this portion. Ms. McNeely noted that Map 4 - 1 (Beach Access Map)
was omitted. Mr. Boucher recommended that under Chapter 4, Conservation and Coastal
Management Element, Air Resources, that the section read, "the city shall work with Canaveral
Port Authority to monitor air quality. Discussion followed on data needed to substantiate air
quality. Mr. Scott stated that Brevard County air quality was measured by the Florida Stated
Department of Environmental Protection and had been measured as good.
Mr. Bruns questioned how the city could protect its environment. Mr. Scott explained that the
City's Land Development Regulations need to be consistent with the goals in the Comprehensive
Plan. Mr. Scott further explained that the city's intent would be expressed in the E.A.R. Mr.
Petsos addressed Section II, Condition at the Date of the E.A.R, under Erosion, noting a
problem with erosion in the estuaries. He stated that if this problem could be outlined in the
E.A.R. that it may provide points toward grant funding. Ms. McNeely noted in the same section
the need to add emergency vehicle access to the beach. Mr. Boucher recommended adding
groundwater pollution to the water resources section in the same section. Mr. Randels suggested
including the National Estuary Program under Conditions of Resources to help secure grant
funding. Discussion followed on the city's efforts to convert asphalt areas with sod, on the new
ordinance regarding impervious lots, and on the city's vigorous tree planting and protection
program to be included under Ecological Communities.
Mr. Bruns addressed under Section III, Effect of Statute & rule Changes since 1988, " any future
amendment to increase density will come under a higher level of scrutiny with Department of
Community Affairs (DCA)." Mr. Boucher explained that due to a rule change any city will be held
to a higher standard. Mr. Boucher explained further that any policy regarding development
should be added to the Comprehensive Plan and then the city would enact an ensuing ordinance.
Mr. Randels suggested adding to page 34 on which the last line reads, "the city has also recently
acquired property for recreational activities." He proposed adding "an is constantly seeking other
opportunities." Mr. Boucher recommended incorporating the proposed change in an objective or
policy statement in the new Comprehensive Plant. He stated that this section outlined any statute
and rule changes that have occurred since 1988 and how they affect this element. Mr. Bruns
addressed page 35, the Minimum Criteria for Local Government, regarding local governments
moving or relocating infrastructure located within a high hazard area . Mr. Scott explained that
the rule change in 9J5 enabling a local government which has lost a sewer line, sidewalk or even a
road in a natural disaster to move that infrastructure more landward, or farther west after
subsequent rebuilding.
Mr. Scott stated that adopting the Evaluation would denote agreement with its intent. Mr. Bruns
questioned if DCA's points were addressed in their letter of January 3rd. Mr. Randels stated that
these points were suggestions from DCA after a cursory review. Council agreed by majority to
adjourn and reconvene for further discussion on Thursday, January 23rd, at 5 P.M. Mr. Boucher
stated that any factual items and suggestions could be submitted to staff as long as the item did
not change the E.A.R.'s intent.
