MINUTES CALL TO ORDER: ROLL CALL: Art Berger Present Leo Nicholas Present Buzz Petsos Present Mayor Porter Present Mayor Pro Tem Randels Present Others Present: City Attorney, Kohn Bennett City Clerk, Sandra Sims Treasurer, Deborah Haggerty Barker Sheriff's Department, Lt. Steve Salvo CONSIDERATIONS: 1. A motion was made by Mayor Porter not to advertise for a new City Manager and to rescind the action to terminate City Manager, Bennett Boucher, taken on September 5, 1995. Following is the verbatim of Mr. Petsos: " I'd like to do something that a politician doesn't do often, and that's admit I was wrong. Why, because I listened to some wrong information I believed to be true. I believe the dismissal of the City Manager on Tuesday night was not handled in the best of light. I was also very miffed there was no second from anyone on this board on the motion I made to table the motion to dismiss for further study. I believe the motion to dismiss was goaded on by the Mayor and followed through with by the Council. Neither of these actions made the outcome right or for that matter did any of them make sense. I've done a lot of leg work in the past two days in talking to all department heads and officials from other portions of the county and the port, not 100 %, not 75% , not even 25 % of the people I talked to had grave concern, but most described Bennett as honest, sincere and with the best interest of the City at heart, most all felt they had a good working relationship with him. A friend reminded me today about progressive discipline, and if you need to correct someone you don't take the course of immediately dismissing them. This is a progressive community and Bennett brings forth some innovative ways of doing business, some good and some not so good. This coupled with being in the middle of creating the new budget the Wastewater Treatment Plant expansion and bond issues involving it. I believe the timing of this is less than beneficial for the City and its citizens. I do not believe I could morally live with myself dealing with the situation the way it was handled. With Bennett agreeing to obtain the necessary personnel management skills and dealing with his employees not just as numbers, and with an honest and timely evaluation by the Council, I would like to second the motion to reconsider item #15 from Tuesday nights September 5 agenda I Special City Council Meeting September 7, 1995 Page 2 effectively reinstating the former City Manager immediately. I would like to apologize to the citizens, the Council and most of all to Bennett for my actions of Tuesday night. Mayor Porter reiterated that Mr. Boucher has been an effective City Manager in whom the citizenry has confidence as demonstrated in their attendance at tonight's meeting. Mr. Boucher was reinstated by a 3 -2 vote as follows: Mr. Berger, Against; Mr. Nicholas, Against; Mr. Petsos, For; Mayor Porter, For; and Mayor Pro Tem Randels, For.
