HomeMy WebLinkAbout05-02-1995 Regular Meetingr CITY COUNCIL REGULAR MEETING May 2, 1995 A Regular Meeting of the Cape Canaveral City Council was held on May 2, 1995, at the City Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida. The meeting was called to order at 7:00 P.M. by Mayor Porter. ROLL CALL: Mayor John Porter Present Mayor Pro Tem Rocky Randels Present Councilmember Arthur Berger Present Councilmember Leo Nicholas Present Councilmember Buzz Petsos Present City Manager Bennett Boucher Present City Attorney Kohn Bennett Present City Clerk Sandra Sims Present City Treasurer Deborah Haggerty Present PROCLAMATIONS: 1. 1995 Spring Beautification Awards Ms. Jackie Coates, Beautification Board Chairperson, presented Beautification Awards and Maggie's Nursery gift certificates in the amount of Twenty -Five Dollars to the winners of the Spring Beautification Contest. Winners were as follows: Multi - Family: Residential: Non - Residential: Seton -by- the -Sea 8000 Ridgewood Avenue Arlene Atkinson, Vice Chairman and Bill Reynolds, Groundskeeper were present to accept the award. Tim and Frankie Gillam 333 Fillmore Avenue Mr. and Mrs. Gil lam were not present. However, their award will be delivered. Christ Lutheran Church 2711 N. Atlantic Avenue Paul and Babe Featherman were present to accept the award. Proclamation - National Association of Letter Carriers National Food Drive Day - May 13, 1995 Mayor Porter read the proclamation, urging everyone to participate in the Food Drive. Mayor Pro Tem Rocky Randels will deliver the proclamation to the Cape Canaveral Post Master. ADOPTION OF MINUTES: 1. Regular City Council Meeting of May 2. 1995. Motion was made by Mr. Nicholas, and seconded by Mr. Berger to approve the minutes of the Regular City Council Meetings of April 18, 1995, as presented. Motion carried with members voting as follows: Councilmember Berger, For; Councilmember Nicholas, For; Councilmember Petsos, For; Mayor Porter, For; Mayor Pro Tem Randels, For;. PUBLIC HEARING: 1. Ordinance No. 08 -95, second reading. Mayor Porter read the ordinance by title. AN ORDINANCE OF THE CITY OF CAPE CANAVERAL, BREVARD COUNTY, FLORIDA, AMENDING CHAPTER 78, UTILITIES, ARTICLE IV,RECLAIMED WATER; OF THE CITY OF CAPE CANAVERAL CODE OF ORDINANCES BY PROVIDING A DEFINITION SECTION; RENUMBERING THE PRESENT SECTION; ESTABLISHING A CROSS - CONNECTION CONTROL SYSTEM; PROVIDING FOR UNAUTHORIZED USE; AND PROVIDING FOR ADOPTION OF CHAPTER 62 -610, OF THE FLORIDA ADMINISTRATIVE CODE; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES; AND PROVIDING FOR AN EFFECTIVE DATE. Motion was made by Councilmember Nicholas, seconded by Councilmember Randels and carried to adopt Ordinance No. 08 -95 at second reading. There was no public comment. Voting as follows: Councilmember Berger, For; Councilmember Nicholas, For; Councilmember Petsos, For; Mayor Porter, For; Mayor Pro Tem Randels, For. r City of Cape Canaveral, Florida City Council Regular Meeting May 2, 1995 Page 3 BUSINESS: 1. Resolution No. 95 -14, Supporting the Cape Canaveral and County -Wide Library Expansion Projects Mayor Porter read the Resolution by title. A RESOLUTION OF THE CITY OF CAPE CANAVERAL, BREVARD COUNTY, FLORIDA; SUPPORTING THE BREVARD COUNTY LIBRARY SYSTEM EXPANSION PROJECTS IN BREVARD COUNTY, FLORIDA. Motion was made by Councilmember Berger and seconded by Mayor Pro Tem Randels adopt Resolution No. 95 -14. Voting as follows: Councilmember Berger, For; Councilmember Nicholas, For; Councilmember Petsos, For; Mayor Porter, For; and Mayor Pro Tem Randels, For. Mr. Randels commended Mr. Nicholas for incorporating the County and City's points of view into the resolution. 2. Summer Recreation Programs Motion was made by Mayor Pro Tem Randels to approve the proposed change to the Summer Recreation Program as recommended by the Recreation Director: 1) The additional increase of $692 for staffing, 2) $2,924 for transportation to the Cocoa Beach Swimming Pool, seconded by Councilmember Nicholas. Council consensus was for Ms. Hanson to report back to the Council if the program turn-out is not substantive to support the activities. The time period is at the discretion of the Recreation Director. The motion carried with voting as follows: Councilmember Berger, For; Councilmember Nicholas, For; Councilmember Petsos, For; Mayor Porter, For; and Mayor Pro Tem Randels, For. 3. Contract Utility Billing with the City of Cocoa, Implementation of Phase II. Deborah Haggerty, Finance Director, explained that Phase II transfers the contract billing to encompass Commercial and Industrial Customers within the City of Cape Canaveral. Implementation is projected for June, 1995. Ms. Haggerty reported that when all phases are implemented, $23,041 savings will be realized from elimination of the Customer Service position (end of FY95). Further, reorganization of personnel can possibly save a much as $46,000. Motion was made by Mayor Pro Tem Randels, seconded by Councilmember Petsos and carried to approve Phase II of the Contract Utility Billing with the City of Cocoa. The motion carried with voting as follows: Councilmember Berger, For; Mayor Pro Tem Nicholas, For; Councilmember Petsos, For; Mayor Porter, For; and Councilmember Randels, For. r L City of Cape Canaveral, Florida City Council Regular Meeting May 2, 1995 Page 4 City Manager's Report. 4. Mr. Boucher reported on a televideo seminar he and the City Clerk attended on "Re- Engineering Government." He related that the four -hour video was conducted by an excellent facilitator who revealed excellent suggestions spurring ideas to save process steps in delivering services. Mr. Boucher related that the key to re- engineering success is having quality, trustworthy personnel implementing and carrying out pilot programs. A program Mr. Boucher suggested the City pilot is changing the current Purchase Order system to use credit cards for small purchases. Councilmember Nicholas related that electronic transfer for utility billing could also be considered. Mr. Boucher reported that the red flags along City streets indicate where trees will be planted in conjunction with the on -going Beautification Project. Mr. Boucher reported that the County Board of Commissioners will be considering the Library expansion on May 9, 1995, at 5 :30 p.m. Mr. Boucher reported on the revolving loan status for the Wastewater Treatment Plant. He stated that $750,000 may be available, if the $750,000 is received, then a new agreement will be required again in October to remain on the funding list. Three other loan agreements are being negotiated. Recreation Director's Report Nancy Hanson, Recreation Director, reported that the Senate Ways and Means are now considering the Ball Field Lighting Grant. Therefore, it appears that the City is in a good position to receive funding. Ms. Hanson requested that Council establish a memorial in honor of Gabriel Applegate, son of Lonnie Applegate, who was recently killed in an ultra -lite accident. She stated that he was an excellent student and model teenager from our community. Ms. Hanson suggested that possibly the new park under construction might be named after him. Extensive discussion ensued and Council consensus was that naming of parks require tremendous consideration in an historical sense. However, a memorial tree and plaque is an immediate acceptable gesture in recognition of this special teenager's life. Finance Director's Report Deborah Haggerty, Finance Director, reported that forfeitures from prior years' Florida Pension Fund will probably be $25,000. This amount will be reflected in the next budget transfer. Mayor Pro Tem Rocky Randels' Report r City of Cape Canaveral, Florida City Council Regular Meeting May 2, 1995 Page 5 Mr. Randels reported that he attended an FDOT sponsored seminar on highway beautification. He distributed brochures and will forward copies to the City Engineer and Beautification Committee. Mr. Randels reported on a Greenway System Seminar which he attended which might be applied to the area on Astronaut Boulevard where the new port road cuts will be. He will forward this literature to the City Engineer. Mr. Randels reported on recycling, that contrary to the old "glut" in recycling, there is now a shortage in recycling materials and that we should take advantage. Mr. Randels related a report on the importance and legal requirements of using letter - size paper. City Attorney, Kohn Bennett, expounded further on the legal profession's requirements to use letter -size paper. Mr. Randels distributed an article on the new concept of pay -as you -go garbage collection. Council concurred that the concept is with merit. Councihnember Buzz Petsos' Report Mr. Petsos queried as to the status of the Public Officials Bill status. He stated that should this bill be adopted, the City Attorney will have to become involved. Mr. Petsos requested that the unkempt lots ordinance be revised. Consideration of the unkempt lots ordinance revision will be placed on the June 1, 1995 Workshop Agenda. Mr. Petsos reported that he and Bobby Scott are still meeting in regard to the YMCA and may receive transportation as a result of the negotiations. Mr. Petsos commended the Building Department on non - compliance signage. Councihmember Leo Nicholas' Report Mr. Nicholas queried as to the status of Port Canaveral's quest to acquire State land. City Manager Boucher responded that they have not received confirmation. Councihnember Art Berger's Report Mr. Berger requested that the issue of Restaurant Impact Fees be addressed at a workshop session. Discussion ensued and consensus was for Mr. Berger to meet with the City Manager to establish the manner in which to proceed. Mayor Porter's Report Mayor Porter reported that construction of Xeriscape Park will begin May 27, 1995 r City of Cape Canaveral, Florida City Council Regular Meeting May 2, 1995 Page 6 with the help of volunteers. Mayor Porter queried how the Council should lobby for Beach Restoration Sand. He related that we have been shorted for sand, and even though any sand is better than none, we need to establish a lobbying plan soon. City Attorney's Report City Attorney, Kohn Bennett, reported that the City of Sebastion has been sued and lost for denying a Conditional Use Permit. The City denied the permit without establishing a substantial finding, or competent evidence as required by quasi-judicial process. Audience to be Heard No one from the public appeared for comment.
