SPECIAL WORKSHOP MEETING
November 30, 1993
A Workshop Meeting of the Cape Canaveral City Council was held on November 30, 1993, at
the City Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida. The meeting was called to
order at 7:00 P.M. by Mayor Salamone.

BUSINESS:
1. Discussion Re: Proposed Revisions of Personnel Rules & Regulations.
The following sections of the proposed revisions to the City's Personnel Rules & Regulations
were reviewed and discussed as follows:
TABLE OF CONTENTS:
No changes.
SECTION 1 - GENERAL PROVISIONS:
Positions Covered, Item 1.02(B), the last sentence which read, "Methods of appointment, rights
and benefits will be determined by the City Manager, unless otherwise specified by the
government grant, contract or local bargaining unit agreement" would be deleted.
Additions or Revisions, Item 1.04, time frame of "within three (3) working days" to be added
to the last sentence of this item.
SECTION 2 - DEFINITIONS:
Anniversary Date - Change the last sentence to read: "If an employee is in a non -pay status,
including leave of absences, for a period of thirty (30) days or more, the anniversary date is
deferred by an equal amount of time, including said . thirty (30) day period".
Discussion followed relative to the definition of "Annual Review Date". Members of Council
expressed their opinions regarding the annual review date being the same day and month of the
anniversary date in succeeding years and the current practice of changing annual review dates

upon promotions, demotions, transfers, etc. Council concurred to revise the definition of annual
review date to allow that the annual review date would be changed based on promotions,
demotions, and other applicable changes in status.
Full-Time Position - would be changed from a minimum of thirty (30) hours per week to
"scheduled to work a minimum of forty (40) hours per week".
Grievance Procedure - deleted the words "or information" at the end of the definition of
grievance procedure.
Immediate Family - After a lengthy discussion, Council concurred to change the definition of
immediate family to read "includes spouse, children, parent, brother, sister".
After a ten - minute break, the meeting was reconvened.
Mr. Nicholas suggested that a definition of "supervisor" should be included in the definitions.
Council concurred.
Overtime - deleted the words "which consists of seven (7) consecutive days" at the end of the
definition for overtime.
Part-Time Position - definition revised to read: "a budgeted position in which an employee is
scheduled to work at least twenty (20) hours per week on a regular basis".
Pay Range - added the words "wage and salary range" to the definition.
Position - deleted the words "by competent authority" at the end of the definition for position.
Probationary Period - added the words "six (6) month" to the definition of probationary period.
Salary Range - Council concurred to delete the definition for salary range as it was similar to
pay range.
Work Week - definition revised to read "the normal work week is seven (7) consecutive days
(Sunday through Saturday of each week) ".
SECTION 3 - POLICY STATEMENT:
Mayor Salamone questioned if there was a legal reason which justified the expanded Policy
Statement included in the Rules and Regulations. Mr. Boucher stated that the Policy Statement
identified management rights. Mr. Kancilia stated that the City may be limiting its rights by
including such a Policy Statement in Personnel Rules. There was extensive discussion regarding
the inclusion of the Policy Statement in the Rules. Council concurred to delete Item 3.02,

Policy Statement, in its entirety.
Item 3.02, Equal Opportunity & Non - Discrimination would be moved to Section 1 of the
Personnel Rules and Regulations and renumbered to Item 1.06 with the deletion of the beginning
of the Policy Statement section. The word "legal" would be deleted from Subsection 3.02(A)
in the last line of that item.
SECTION 4.- STANDARDS OF CONDUCT:
There was discussion among Council and staff relative to Item 4.01, Policy and the "traits of
a successful City employee". At the conclusion of the discussion, it was determined that the
paragraph relating to "traits" would remain in the Rules.
Item 4.02, Conflict of Interest, (A) - deleted words "to the employee" in the third line of (A).
Item 4.02, Conflict of Interest, (C) - deleted word "frequently" from the eleventh line of (C).
Item 4.02, Conflict of Interest, (E) - Extensive discussion occurred regarding the meaning of
"substantial" as it pertained to business commitments. Council concurred to reword the
subsection to: "If an employee of the City is an officer, director, agent, or member of, or own
controlling interests in any corporation, firm, partnership, or other business entity which is
subject to the regulation of, or which has business commitments with the City, they shall file
a statement of financial interests to this effect in accordance with Florida Statues, Chapter 112".
Item 4.02, Conflict of Interest, (F) - deleted words " "his /her own agency" and the parenthesis
around "the City" at the end of subsection (F).
Item 4.03, Political Activities (B) - deleted words "in all areas of political activity" at the end
of subsection (B).
Item 4.05, Solicitation and Distribution (C) - was reworded to read: "City employees are
prohibited from posting unauthorized literature on City bulletin boards or any City property".
Item 4.06, Outside Employment (A) - changed the words "interest of the City service" to read
"performance of his /her duties" at the end of the first sentence of subsection (A). Added
provision for notifying City regarding termination of outside employment.
After a ten - minute break, the meeting was reconvened.
Item 4.06, Outside Employment (B) - reworded subsection to read: "Employees sustaining
injuries while engaged in outside employment are ineligible to receive benefits under the City's
Worker's Compensation Program".

Item 4.06, Outside Employment (C) - added the following: "without authorization of the City
Manager" to the end of subsection (C).
Item 4.07, Use of City Vehicles - There was discussion regarding that City employees should
not be allowed to take home City vehicles. The following was deleted: "Employees authorized
to take home vehicles will be subject to the appropriate Internal Revenue Service regulations.
no personal use, except for commuting, is allowed by any City employee other than the City
Manager."
Item 4.08, Use of City Property - deleted the following: "Employees may be allowed to use
vehicles to and from work by permission of the City Manager, on a case by case basis. Refer
also to Section 4.07."
Item 4.09, Sexual Harassment Policy - There was extensive discussion regarding the inclusion
of wording relative to a definition of "sexual harassment". Council concurred to delete the
words "is generally defined" to "includes, but is not limited to" in the second sentence of the
second paragraph of the Sexual Harassment Policy. Deleted the last sentence of the second
paragraph which read: "Justified complaints will be dealt with appropriately."
SECTION 5 - CLASSIFICATION PLAN:
Item 5.02, Use (A) - deleted the words: and content".
Item 5.02, Use (D) - changed the word "ladders" to "opportunities".
Item 5.03, Content (B) - changed the subsection to read: "Job titles which are indicative of the
work of each job, and which are used on all personnel, accounting, budget, and official
records."

Council concurred to change the order of Item Nos. 5.04, Job Descriptions, and 5.05, Job Titles
with Job Titles being the first of the two sections.
Item 5.06, Administration - deleted subsection (A) in its entirety.
