WORKSHOP MEETING
June 10, 1993
A Workshop Meeting of the Cape Canaveral City Council was held on
June 10, 1993, at the City Hall Annex, 111 Polk Avenue, Cape
Canaveral, Florida. The meeting was called to order at 7:32
P.M. by Mayor Salamone.

1. Interview of prospective Boardmember.
Mr. John Kancilia, City Attorney, interviewed John C. Thomas for a
possible appointment to the Commercial Development Board. Agenda

2. Ordinance No. 22 -93, Amending City's Code of Ordinances by
Repealing and Reenacting Chapter 503, Subdivision of Land (first
reading on June 15, 1993).

3. Discussion Re: Proposal from Dyer, Riddle, Mills & Precourt
to prepare State Revolving Loan Program Application.
Mr. Boucher explained the proposal received from Dyer, Riddle,
Mills & Precourt to prepare the City's application to the State
Revolving Loan Fund Program. He stated that the current interest
rate was 2.78 %. Agenda this item for Tuesday.
4. Discussion Re: 1993 Revisions to Standard Building Codes (Jim
Morgan) .
Mr. Jim Morgan, Building Official, stated that the 1993 revisions
included many upgrades to the industry standards. Mayor $alamone
questioned if the Codes included provisions for a Deputy Building
Official. She felt that if Mr. Morgan was on vacation that it was
in the City's best interest to completely follow the procedures and
utilize a Deputy Building Official for review of building permits.
Mr. Morgan stated that the City had a working relationship with
Cocoa Beach to utilize their Building Official during Mr. Morgan's
absence.
There was discussion relative to "insignificant" building
permits /inspections for minor jobs and the changes included in the
1993 revisions to the Codes. Mr. Morgan explained that he was
confident with Mr. Kleving's abilities even though technically Mr.
Kleving did not yet meet the qualifications of a Deputy Building
Official.
Mr. Boucher stated that when Mr. Morgan was absent, the Cocoa Beach
Building Official would sign for building permits as needed. Mayor
Salamone requested a copy of the S.B.C.C.I. codes. There was
additional discussion regarding eliminating the use of staples on
roofs. Mr. Porter described procedures used by Brevard County
whereby specific checklists /handouts for permits were set out and
available to all contractors and /or homeowners regarding building
projects, i.e., pools, fences, sheds, etc. Mr. Morgan stated that
Chapters 32 and 1205 contained the most significant changes and Council

requested copies of both chapters.
5. Ordinance No. 10 -93, Amending City's Code of Ordinances.
Chapter 668, Floodplain Protection (second reading on June 15,
1993)
Mr. Kancilia explained the amendments as recommended by the Federal
Emergency Management Agency (FEMA) which were added to page 3 since
the first reading of the ordinance. Agenda this item for Tuesday.
6. Ordinance No. 11 -93, Repealing and Reenacting Section 2 of the
Charter of the City of Cape Canaveral to Revise and Restate the
Description of the City Boundaries (second reading on June 15,
1992.

7. Ordinance No. 12 -93, Amending City's Code of Ordinances.
Chapter 611, Building Code, by adopting the 1993 revision of the
Standard Building Code (second reading on June 15, 1993).
The ordinance would be amended to add the changes to the roofing
regulations and change the "Chief Building Inspector" to "Deputy
Building Official ". Agenda this item for Tuesday.
8. Ordinance No. 13 -93, Amending City's Code of Ordinances.
Chapter 613, Standard Plumbing Code, by adopting the 1993 revision
of the Standard Plumbing Code (second reading on June 15, 1993).

16. Discussion Re: Vacancy on Planning and Zoning Board.
Mayor Salamone advised that Council's practice in the past to move
alternates up to regular board members when regular positions
became available and she suggested moving Mr. Petsos to a regular
member and Mrs. McNeely up to first alternate. Agenda this item
for Tuesday.
17. Discussion Re: Status of Alternates on Code Enforcement
Board.
Mayor Salamone stated that Council had enacted a policy whereby
alternates who had missed three (3) consecutive Board meetings
without advising the Board chairperson or Secretary were subject to
removal from the Board. Agenda this item as a resolution for
Tuesday.
18. Discussion Re: Authorization to send City representative to
attend House Appropriations Sub - Committee meeting in Washington on
June 30, 1993, re: Sand Transfer Facility.
Mr. Porter advised that he wanted to speak to Congressman Bacchus
prior to scheduling attendance at the Sub - Committee meeting.

19. Discussion Re: Status of Wholesale Agreement with Canaveral
Port Authority.
Mr. Boucher advised that the Port had two main concerns in the
wholesale agreement including the up -front fee for capacity and the
proposed wholesale rate.
20. Discussion Re: Wastewater Project Update.
Mr. Boucher advised that he had received the capacity analysis
report from Hartman & Associates. He stated that Burton &
Associates was reviewing two ways to structure the rates, either
consumption or flat rate. Mr. Boucher explained that the City of
Cocoa wanted to take over all the City's billing for sewer and
garbage and this would be negotiated further for a reasonable fee.
21. Monthly Activity Reports.

22. City Manager's Report.
Mr. Kancilia briefed Council on the status of the buffer zone
located at Ocean Woods. He advised that landowners adjoining Ocean
Woods have complained that the present occupants of Ocean Woods had
removed the "natural growth" and had replaced it with lawn and
sparse vegetation which did not provide a visual screen between

Ocean Woods and adjoining property owners, and individuals were
parking in the area where "natural growth" had previously existed.
He stated that the Code Enforcement Board was no longer an
appropriate forum in which to enforce a violation of a condition
attached to a special exception. The City would have to initiate
a lawsuit seeking injunctive relief if it wanted to enforce any
violation of a condition attached to the grant of the special
exception for the development of Ocean Woods.
Mayor Salamone suggested that both parties involved in the dispute
get together and discuss alternatives to actual lawsuits. There
was extensive discussion regarding the buffer zone, conditions of
the special exception, enforcement abilities, the natural
vegetation of the subject area, and the costs involved in enforcing
the development order through litigation. Mayor Salamone asked
that the item be placed on the next Council workshop for further
discussion.
22. City Manager's Report.

DISCUSSION:
1. Mr. Nicholas questioned whether or not the City Council had
decided to proceed with the wholesale agreement with the Port.
Mayor Salamone stated that Council had approved the concept of the
wholesale agreement by motion. Council concurred to agenda
discussion of the proposed Port agreement at the next Council
workshop meeting.
2 . Mr. Nicholas questioned if copies of the recodified City Code
of Ordinances would be available for the public to review during
the course of the special workshops scheduled for later in the
month. Mayor Salamone asked that copies of the proposed Code be
provided at the special workshop meeting for the public's review.
There being no further business, the meeting adjourned at 8:58 P.M.

A
