WORKSHOP MEETING
March 11, 1993
A Workshop Meeting of the Cape Canaveral City Council was held on
March 11, 1993, at the City Hall Annex, 111 Polk Avenue, Cape
Canaveral, Florida. The meeting was called to order at 7:32
P.M. by Mayor Salamone.

OLD BUSINESS:
1. Discussion Re: Ordinance No. 04 -93, Amending City's Code of
Ordinances by Repealing Chapter 723, entitled "Special Occupational
Permits" and Renaming Chapter 723 as "Solicitors, Peddlers and
Itinerant Merchants" (tabled on March 2, 1993).
Mr. Kancilia suggested having Lt. George McKee speak to the
Melbourne Police Department regarding his concerns about the
proposed ordinance. Council concurred to table the ordinance until
the next workshop.
NEW BUSINESS:
1. Interview of prospective Boardmember.
Attorney John Kancilia interviewed Mrs. Mary E. Jenkins for a
possible appointment to the Library Board. Agenda this item for
Tuesday.
2. Discussion Re: Presentation by Western Waste, Inc. of a
Commercial Cardboard Recycling Program.
Mr. Bob Hyres, Western Waste, explained the proposed expansion of
the Commercial Cardboard Recycling Program to businesses within the
City. He further explained the specifics of the program and the
incentives available to the businesses for participation in the
program. Council expressed concerns regarding the potential for
health risks with a reduced number of garbage pickups per week.
Mr. Hyres stated that it was not his firm's intention to reduce the
number of actual garbage pickups.
Ms. Deborah Haggerty, Finance Director, suggested that Western
Waste send out a questionnaire to the business customers within the
City to determine the number of interested participants. Mayor
Salamone expressed her concerns relative to the need to reduce
solid waste and that it was everyone's responsibility to attempt to
do what was beneficial to the planet in general.

Mr. George Gilchrist, Western Waste, distributed handouts to
Council and staff which outlined the number of pounds of recyclable
materials which had been collected since the recycling program
began. He thanked the City staff for their support of Western
Waste and the recycling program. He presented a safety vest to Mr.
Boucher and a recycling team game to Mayor Salamone.
Mr. Chuck Stenglein questioned when additional recycling of plastic
would become available and Mr. Hyres advised that hopefully within
the next year. Mr. Hyres stated that with the addition of yard
waste, the City was close to the 30 %, reduction in waste dumped at
the landfill under the requirements of the Solid Waste Management
Act.
3. Ordinance No. 03 -93, Amending City's Code of Ordinances by
Repealing and Reenacting Chapter 602, entitled "Fireworks
Regulations" (second reading on March 16, 1993).
Mr. Boucher advised that he wished to include a $50.00 permit fee
in the ordinance. Agenda this item for Tuesday.
4. Discussion Re: Ordinance to Amend Chapter 737, Alcoholic
Beverage Open Container Regulations.
Mr. Kancilia advised that the proposed ordinance was in conjunction
with the current Municipal Code Corporation recodification of the
City's ordinances which provided a technical update to the
definition of possession. Agenda this item for Tuesday.
5. Discussion Re: Resolution No. 93 -05, appointing member to the
Beautification Board.
Mr. Boucher advised that Mrs. Jacqueline Coates, who was currently
an alternate member to the Beautification Board, had requested that
she be moved into a regular member position. Agenda this item for
Tuesday.
6. Discussion Re: Establishing procedures for liaison rectardina
wetland project.
Mayor Salamone stated that Mrs. Filkins had asked Council to
consider giving Mr. Don Arabian a title of some type in conjunction
with his assistance with the wetlands project. She suggested
having Mr. Arabian be a liaison between Mr. Swindell's plan and the
Arabian Plan to help Council better understand the concepts. Mr.
Randels stated that the Council was grateful for all Mr. Arabian's
work on the project, but he felt that Mr. Arabian could report his
findings to the City Manager who would in turn report back to
Council. He did not wish to have an interface between Hartman &
Associates and Mr. Swindell, but he felt Mr. Arabian's value was to
review the documents as presented, discuss same with .the City
Manager who would also advise Council of his recommendations.
There was further discussion regarding whether or not to give Mr.
Arabian a title with or without specific authority. Mrs. Helen
Filkins spoke in favor of giving Mr. Arabian the title of technical
liaison or advisor to the Council with some authority. Mrs.
Calvert felt that the term "technical advisor to the Council or the
City" would be appropriate.
Mr. Kancilia felt that there was a distinction between the
functions of advising /reviewing documents and having authority and
that only the City Council had the authority to change the contract
that was presently in place with Hartman & Associates. He stated
that the official communication to the Council should be channeled

through one source - the City Manager. Mrs. Helen Filkins spoke in
favor of authorizing Mr. Arabian to monitor the contract. Mrs.
Calvert felt that the title of "technical advisor" would enable Mr.
Arabian to monitor the contract and advise the City Council without
giving him specific authority. Mrs. Mary Jenkins spoke against
giving Mr. Arabian a gratuitous title and undermining the City's
own contractor.
Mr. Porter stated that it would be invaluable to have ongoing
monitoring on the contract and that it was in the City's best
interests to utilize Mr. Arabian as an advisor. There was further
discussion regarding the Arabian Plan and Mr. Arabian's
contribution to the wetlands project. Mayor Salamone stated that
Council had discussed authorizing Mr. Arabian to be a technical
advisor to the City working through the City Manager to the
Council. She stated that when there were differences which would
impede the plan being implemented Mr. Arabian should be able to
advise the City Manager of such differences. There was additional
discussion regarding improvements to the sewer plant, the wetlands
project in general, and whether or not to give Mr. Arabian a
"title ".
Mr. Boucher stated that Mr. Arabian was very enthusiastic about the
wetlands project and he had established a good working relationship
with Mr. Arabian. Mrs. Calvert expressed her concerns about giving
Mr. Arabian a title and that without a title he would abandon the
project. Mayor Salamone stated that Council did want Mr. Arabian's
input and she would talk to him regarding same. She suggested
making Mr. Arabian a volunteer technical advisor to Council with
the procedure to allow Mr. Boucher and Mr. Arabian to have open
communication and to provide Mr. Arabian with whatever documents
were necessary. She stated that Mr. Arabian would also have access
to the City Council at public meetings to provide his guidance
relative to the wetlands project. Council concurred with the
Mayor's suggested procedures. Mr. Kancilia suggested informing the
City's contractors regarding the exact extent of Mr. Arabian's
authority and functions for the wetlands project. Mayor Salamone
agreed that Mr. Arabian would not have the authority to make
decisions or negotiate, however, Council was giving him the
authority to ask questions and gather information.
7. Monthly Activity Reports.
No comments.
8. City Manager's Report.
Mr. Boucher distributed a proposed ordinance relative to changing
the handicapped parking fee from $50.00 to $100.00 and Council
concurred to add the ordinance to Tuesday's agenda.
Mr. Boucher distributed an update regarding the Patriot's Day
schedule and expressed his appreciation for all of the work done by
the Recreation Department to organize the Parade. There was
discussion regarding an alternate plan in the event of inclement
weather.
Mr. Boucher advised that the installation of the traffic light at
A1A and Central Boulevard had begun.
Mr. Kancilia advised that the Sarah DeClue vs. City of Cape
Canaveral case had been settled for $12,000 against the City. He
stated that the lawsuit would be continuing against the signal
company and other defendants.

DISCUSSION:
Mrs. Helen Filkins reminded Council that the stormwater runoff
f mandate would be implemented during 1993 and advised that Mr.
1 Arabian's Plan also addressed stormwater. She stated that the land
needed for the stormwater program would be given to the Port by the
Governor's Cabinet if the City did not intervene and pursue the
land for its own uses. She stated that Mr. Arabian was willing to
go to Tallahassee to meet with the Department of Natural Resources
(DNR) . Mayor Salamone asked to add an agenda item to Tuesday's
meeting to authorize and pay for Mr. Arabian's expenses to travel
to the DNR prior to the Cabinet meeting.
Mr. Leo Nicholas questioned the status of the Adopt-a-Highway
program for Atlantic Avenue and Mr. Boucher would research same.
Mr. Nicholas advised that Rockwell had cleaned up Astronaut
Boulevard two weeks ago and the trash bags were still along the
road. He also questioned the Department of Transportation (DOT)
improvements along AlA near the Amoco station. Mr. Nicholas
x questioned if the City was allowing the location of a used car lot
at the Aerospace Complex and the old McDonnell Douglas building on
1 AlA. Mr. Chuck Stenglein also stated that there was a shrimp
dealer selling shrimp from his vehicle on Canaveral Beach
1 Boulevard. Mayor Salamone asked Mr. Boucher to investigate both
complaints and to ask Code Enforcement to travel the City streets
to locate and cite these types of existing violations.

Mr. Randels questioned the status of Mr. Peeples' written response
to the City's offer for the wetlands property and Mr. Kancilia
advised that the response had not been received.
There being no further business, the meeting adjourned at 9: 05 P.M.
