6 Ordinance No 02 -95 approving the vacation of the alleyway
Please note that the enclosed Site Plan is consistent with the
previous City Council approval and incorporates the following
minor revisions
1 A dune crossover has been added within the property
2 The native shrubs, Wax Myrtle and Youpon Holly, have been
substituted for the non - native India Hawthorn and Varie-
gated Pittosporum
3 The boundary has been modified to incorporate the vacated
alleyway and reflects the portion of the alleyway retained
by the developer, as well as that deeded to the Fairmans
4 Slight adjustments have been made to the building footprint
As a result of the final architectural design, the footprint
of the 37 -unit building was decreased by 529 square feet
We trust that you will find the Site Plan consistent with the
previous City Council approval
Our client is now in the process of applying for the building
permit and time is of the essence We understand that the Site
Plan will be scheduled for the May 8 Zoning Board meeting

1 The surface water drainage from the project does not
discharge to the existing inlet on Buchanan Avenue for the
25 -Year, 24 -Hour Storm Event Therefore, the outfall pipe
is downsized to 12- inches It is our belief that the 12-
inch diameter RCP pipe can be connected to the existing
inlet as shown on Sheet C -3

Pursuant to your request m reference to Sand Dunes Condominium, t ain of the
opinion that the site plan will expire twelve (12) months from the date the Planning & Zoning
Board approved the request Therefore, Mr Fleis request that we utilize either the March 7
1995, or November 2 1995 dates, being dates that they complied with certain conditions of the
site plan are not applicable
If indeed v e took the position that the final approval date is the date that an
applicant would complete conditions, which conditions are done Solely by applicant and in the
time set by applicant the outcome would be inconsistent with the terms and intent of the Code
and in fact would set an Improper precedence Unfortunately in this instance it appears that the
applicant has let the time cxp1Te without requesting the time extension and therefore it appears
they must resubmit its site plan

FINDINGS OF FACT An application for authorization to conduct the activities seaward of the
coastal construction control line which are indicated in the project description, was filed by the
applicant/perrruttee named herein on August 17, 1994, and was determined to be complete
pursuant to rule on December 20, 1995 The proposed project is to be located landward of the
30 -year erosion projection and the existing line of construction established by mayor structures
in the immediate area
CONCLUSIONS OF LAW After considering the merits of the proposal and any written
objections from affected persons, the Department finds that upon compliance with the permit
conditions, the activities indicated in the project description are of such a nature that they will
result in no significant adverse impacts to the beach /dune areas or to adjacent properties, that
the work is not expected to adversely impact nesting sea turtles, their hatchlings, or their habitat,
that the work is expendable in nature and /or is appropriately designed in accordance with Rule
62B -33 007, Florida Administrative Code, and that it is an activity or type of construction which
the designee of the Chief of the Bureau of Beaches and Coastal Systems has authority to approve
or deny pursuant to Administrative Directive DEP 140, effective July 1, 1993 The direct and
cumulative impacts to the beach and dune system that will be caused by both the seaward
location and shore - parallel width of the proposed construction represent the maximum such
impacts that are acceptable to the Department Therefore, future construction on the site
seaward of the coastal construction control line shall not extend further seaward of, or increase
the shore - parallel coverage occupied by, the proposed structures approved pursuant to this
permit Based on the foregoing considerations, the designee approves the application, authorizes
construction and /or activities at the location indicated below in strict accordance with the project
description, the approved plans (if any) and the Standard Permit Conditions which are attached
and are by this reference incorporated herein, and any additional conditions shown below,

SPECIAL PERMIT CONDITIONS
1 Prior to the start of construction, a preconstruction conference shall be held at the site
among the contractor, the owner or authorized agent, and a staff representative of the
Bureau of Beaches and Coastal Systems to establish an understanding among the parties
as to the items specified in the special and standard conditions of the pernut The
proposed locations of the structures shall be staked out for the conference
2 The fill material shall be obtained from a source landward of the control line and shall
consist of sand which is similar to that already on the site in both grain size and
coloration This fill material shall be free of construction debris, rocks, or other foreign
matter A sample of the sand shall be provided to the staff representative of the Bureau
of Beaches and Coastal Systems during the preconstruction conference
3 Prior to commencement of construction activity authorized by this permit, a temporary
construction fence shall be erected completely across the shore - parallel width of the site,
from property line to property line, at a maximum distance of 135 feet seaward of the
control line This fence shall remain in place until the construction authorized by this
permit is complete The temporary construction fence shall be subject to approval from
a staff representative of the Bureau of Beaches and Coastal Systems
4 All exterior lighting will be installed and maintained as depicted on approved lighting
plans No addtional permanent exterior lighting is authorized
5 All rubble and debris resulting from this construction shall be removed to a location
landward of the coastal construction control line

CAVEAT
Due to potential adverse impacts to the beach and dune system that may result from additional
development on the property, the shore - parallel and seaward extent of the permitted structures
shall not be increased, nor will any additional major structures be permitted which would exceed
the limits established by the permitted construction seaward of the coastal construction control

INTRODUCTION
The proposed development is a residential condominium consisting of 37 units and five (5)
single family detached homes located in Section 23 Township 24 Range 37 in Brevard County The
project site currently has a single story residential home and a two story residential home and consists
of vegetation typical of plants found in associated sandy area (seagrapes palm and palmettos) The
north half of the project site west of the dune line drains in a northwesterly direction and the south
half in a southerly direction
The project site which is approximately 2 84 acres contains for the most part well draining
sandy soils belonging to the Palm Beach series The existing soil type topography vegetative cover
and other parameters along with the soil report prepared by KSM Engineering and Testing Inc were
used to deternune the curve number pre development runoff volume and wet season high water
table The soil map from Sods Survey of Brevard County (USDA SCS) the U S G S map and the
flood map are included herewith
The purpose of this report is to demonstrate that the proposed Stormwater Management Plan
is consistent with and functions accordingly under Chapter 664 of the City of Cape Canaveral Land
Development Regulations and Section 40C 42 026(2) Specific Design and Performance Criteria of

STORMWATER MANAGEMENT DESIGN CRITERIA
CITY OF CAPE CANAVERAL
Post Development rate of discharge shall not exceed pre development rate of discharge for
a 25 Yr 24 Hr storm event and the 5 Yr 24 Hr storm event
Post Development volume of direct runoff must not exceed the pre development level for a
25 Yr 24 Hr storm event
ST JOHNS RIVER WATER MANAGEMENT DISTRICT
Provide either of the following
a Off line retention of the first one half inch of run off or 125 inches of runoff from the
impervious area whichever is greater
b On line retention of an additional one half inch of runoff over the volume specified in
1(a)
C Provide additional 50 percent volume due to discharge to Class II OFW
2 Draw down the treatment volume within 72 hours following a storm event
The proposed stormwater management system is designed as an on -line system and retains
15 345 CU FT of runoff The project outfalls an existing storm inlet located on the south side of
Buchanan Avenue via a control structure located at the western portion of the project The on -site
storage system and the outlet capacity is designed for a 25 Yr 24 Hr storm event The adopted
design method satisfies both City of Cape Canaveral and St Johns River Water Management District
criteria

WATER TABLE ELEVATION & PERMEABILITY
On site geotechnical investigation of the project site was conducted by KSM Engineering and
Testing Inc The Investigation consisted of a hand auger boring to a depth of seven (7) feet and
performing a percolation test For a complete description of the report refer to Appendix A
The groundwater table was not found to a depth of 84" below grade It is estimated that the
wet season water table will be about 72 Inches from existing grade

POST DEVELOPMENT CONDITIONS
For purpose of hydrologic consideration the site was analyzed as one single interconnected
drainage basin Proposed under the stormwater management plan are dry retention ponds which
provide pollution abatement and peak flow attenuation The stormwater management plan is
designed to take advantage of the highly permeable soils and to maximize infiltration and aquifer
recharge
The proposed stormwater design meets St Johns River Water Management District t s criteria
for an on -line system The downstream discharge will be through fixed weir control structure An
18 dia concrete pipe is utilized for the final discharge to the City of Cape Canaveral stormwater
management system

the proposed mains at the two points of connection to the existing mains on Ridgewood Avenue and

40C -42, F A C , i.ssuea by the staff of the St Johns River Water
Management District on August 25, 1995 This permit is subject to
the 15 standard limiting conditions and other special conditions
approved by the staff These conditions are enclosed
Tris permit is a legal document and should be kept with your other
important records T'-ie permit requires the submittal of an As -built
certification and may require submittal of other documents All
information provided in compliance with permit conditions should be
sunmitted to the District office from wnich the permit was issued
An As -built certification form is attached Complete this form
within 30 days of completion of construction of the permitted system,
including all site worK
Upon receipt of the As -built certification, staff will inspect the
project site Once the project is found to be in compliance with all
permit requirements, the permit may be converted to its operation
phase and responsibility transferred to the operation and maintenance
entity in accordance dith cnapter 40C -42 028, F A C

for obtaining permits from any federal, state, and /or local

1 This permit for construction will expire five years
from the date of issuance unless otherwise specified by

2 Permittee must obtain a permit from the District prior

specifically authorized by this permit
3 Stormwater retention and detention storage must be
excavated to rough grade prior to building construction
or placement of impervious surface within the area
served by those systems Adequate measures must be
taken to prevent siltation of these treatment systems
and control structures during construction or siltation
must be removed prior to final graaing and
stabilization
4 The permittee must require the contractor to review and
to maintain a copy of this permit complete with all
conditions attachments exhibits and permit
modifications in good condition at the construction
site The complete permit must be available for review
upon request by District representatives
5 All construction operation and maintenance shall be
as set forth in the plans specifications and
performance criteria as approved by this permit
6 District authorized staff upon proper identification
must be granted permission to enter inspect and
observe the system to insure conformity with the plans
and specifications approved by the permit
7 During any construction of the permitted system
including stabilization and revegetation of disturbed
surfaces permittee is responsible for the selection
implementation and operation of all erosion and
sediment control measures required to retain sediment
on -site and prevent violations of the water quality
standards in Chapter 17 -3 and 17 -4 F A C The
permittee is encouraged to use appropriate Best
Management Practices aescribea in the Floriaa Lana
Development Manual A Guide to Sound Land ana Water
Management (DER 1988)
8 If the permitted system was designed by a registered
professional within 30 days after completion of the
stormwater system the permittee must submit to the
District the following District Form EN -d_ (As -Built
Certification By a Registered Professional) signed and
sealed by a appropriate professional registered in the
State of Florida and two sets of As Built arawings
when a) required by a special condition of this permit
b) the professional uses As Built drawings to support
the As Built Certification or c) when the completed
system substantially differs from permitted plans
This submittal will serve to notify the District staff
that the system is ready for inspection and approval
9 If the permitted system was not designed by a
registered professional within 30 days after completion
of the stormwater system the permittee must submit to
the District the following District Form EN -44 (As
Built Certification) signea by the permittee and two
sets of Ps Built drawings when required by a special
condition of this permit or when the completed system
substantially differs from permitted plans This
submittal will serve to notify the District staff that
the system is ready for inspection and approval
10 The permittee must construct and maintain a permanent
protective cove (vegetative or suitable alternative)
for erosion and sediment control on all land surfaces
exposea or disturbed by construction of the permitted
project Unless modified by another condition of this
permit or otherwise specified on a District- approved
erosion and sediment control plan the protective cover
must be installed within fourteen days after final
grading of the affectea land surface A permanent
vegetative cover must be established within 60 aays of
it installation The permittee s requirement to
maintain cover on off -site surfaces shall not be
complete until after the District receives the
permittee s statement of compliance
11 The permittee must notify the District of all revisions
or modifications to the permitted plans required by any
other governmental body or regulatory agency
12 Within thirty days after sale or conveyance of the
permitted stormwater management system or the land on
which the system is located the owner in whose name
the permit was grantea snall notify the Distr-Lcc or-
such change of ownership Transfer of this permit
shall be in accordance with the provisions of Chapter
373 F S and Chapters 40C -1 F A C All terms - and
conditions of this permit shall be binding upon the
transferree
13 Construction of the stormwater management system must
be complete and all disturbed areas stabilized in
accordance with permitted plans and conditions prior to
any of the following issuance of the first
certificate of occupancy initiation of intenaed use of
the infrastructure or transfer of responsibility of
maintenance of the system to a local government or
other responsible entity
JA The operation phase of the permit shall rot become
effective until the requirements of Condition No 8 or
9 have been met The permit cannot be transferred to
the responsible operation and maintenance entity
approved by the District until construction of the
completed stormwater management system is approved by
the District
15 Prior to lot or unit sales or upon completion of
construction of the system whichever occurs first the
District must receive the final operation and
maintenance document(s) approved by the District and
recorded if the latter is appropriate For those
systems which are proposed to be maintained by county
or municipal entities final operation and maintenance
documents must be received by the District when
maintenance and operation of the system is accepted by
the local government entity Failure to submit the
appropriate final document will result in the pe -rmittee
remaining personally liable for carrying out
maintenance and operation of the permitted systems

WITHIN THE CITY, PROVIDING A LEGAL DESCRIPTION, PROVIDING
FOR AUTHORITY OF THE CITY TO EXECUTE A DEED, REPRALING

WHEREAS, Jim Peeples, Trustee, and Paul and Marcia Fairman
( "Petitioners ") have petitioned the City of Cape Canaveral, Brevard
County, Florida to vacate a 12' wide alleyway that exists east of
Ridgewood Avenue, running immediately south of Buchanan Avenue to
Lincoln Avenue, said alleyway more particularly described

A Platted alleyway which lies within Block 68, AVON -BY-
THE -SEA, according to the Plat thereof as recorded in
Plat Book 31 Page 7 of the Public Record of Brevard
County, Florida
shall be vacated in favor of the Petitioners provided that the
existing water line located within the alley, proposed to be

INTRODUCTION
The proposed development is a residential condominium consisting of 37 units and five (5)
single family detached homes located in Section 23 Township 24 Range 37 in Brevard County The
project site currently has a single story residential home and a two story residential home and consists
of vegetation typical of plants found in associated sandy area (seagrapes palm and palmettos) The
north half of the project site west of the dune line drains in a northwesterly direction and the south
half in a southerly direction
The project site which is approximately 2 84 acres contains for the most part well draining
sandy soils belonging to the Palm Beach series The existing soil type topography vegetative cover
and other parameters along with the soil report prepared by KSM Engineering and Testing Inc were
used to determine the curve number pre development runoff volume and wet season high water
table The soil map from Soils Survey of Brevard County (USDA -SCS) the U S G S map and the
flood map are included herewith
The purpose of this report is to demonstrate that the proposed Stormwater Management Plan
is consistent with and functions accordingly under Chapter 664 of the City of Cape Canaveral Land
Development Regulations and Section 40C -42 026(2) Specific Design and Performance Criteria of

STORMWATER MANAGEMENT DESIGN CRITERIA
CITY OF CAPE CANAVERAL
Post Development rate of discharge shall not exceed pre development rate of discharge for
a 25 Yr 24 Hr storm event and the 5 Yr 24 Hr storm event
Post Development volume of direct runoff must not exceed the pre development level for a
25 Yr 24 Hr storm event
ST JOHNS RIVER WATER MANAGEMENT DISTRICT
1 Provide either of the following
a Off line retention of the first one half inch of run off or 125 inches of runoff from the
Impervious area whichever is greater
b On line retention of an additional one half Inch of runoff over the volume specified in
1(a)
C Provide additional 50 percent volume due to discharge to Class II OFW
2 Draw down the treatment volume within 72 hours following a storm event
The proposed stormwater management system is designed as an on line system and retains
15 345 CU FT of runoff The project outfalls an existing storm inlet located on the south side of
Buchanan Avenue via a control structure located at the western portion of the project The on site
storage system and the outlet capacity is designed for a 25 Yr 24 Hr storm event The adopted
design method satisfies both City of Cape Canaveral and St Johns River Water Management District
criteria

On -site geotechrucal investigation of the project site was conducted by KSM Engineering and
Testing Inc The investigation consisted of a hand auger boring to a depth of seven (7) feet and
performing a percolation test For a complete description of the report refer to Appendix A
The groundwater table was not found to a depth of 84" below grade It is estimated that the
wet season water table will be about 72 inches from existing grade

POST DEVELOPMENT CONDITIONS
For purpose of hydrologic consideration the site was analyzed as one single Interconnected
drainage basin Proposed under the stormwater management plan are dry retention ponds which
provide pollution abatement and peak flow attenuation The stormwater management plan Is
designed to take advantage of the highly permeable soils and to maximize Infiltration and aquifer
recharge
The proposed stormwater design meets St Johns River Water Management District' s criteria
for an on -line system The downstream discharge will be through fixed weir control structure An
18' dia concrete pipe is utilized for the final discharge to the City of Cape Canaveral stormwater
management system
