HomeMy WebLinkAboutResolution No.67-05• RESOLUTION NO. 67 -5 i A RESOLUTION ORDERING CERTAIN PROPERTY OWNERS TO ABATE NUISANCE CONDITIONS OF THEIR PROPERTY OR TO SHOW CAUSE WHY THEIR PROPERTY SHOULD NOT BE DECLARED A NUISANCE AT A CERTAIN TIME AND PLACE; PROVIDING AN EFFECTIVE DATE. WHEREAS, Section 3 of Article XXII of the Charter of the City of Cape Canaveral, passed and adopted by the Legislature of the State of Florida, provides The presence of garbage, refuse, surface closets, dead animals, trash, waste and unused lumber or other waste material, sawdust or debris of any kind, or woods or high grass produces and harbors mosquitoes and dangerous reptiles, increases the danger of fires and the spread thereof, and pro- duces unpleasant odors, stenchos and smells and is otherwise dangerous to the health, comfort, convenience and general welfare, and the exist- ence of any such condition is hereby declared to be a nuisance. and, WHEREAS, the City Council has the power and authority to abate such nuisances by requiring the owner of any property to remove therefrom all ouch garbage, refuse, trash, waste, or other unused lumber or other waste material, debris of any kind or woods and high grass, and WHEREAS, the building official of this City and the City Manager have reported to this Council that a nuisance does exist on certain lands within the City, and WHEREAS, such officials of this City have requested that the owners of the following described land be given notices to abate the said complained of nuisances or to show cause before the City Council of the City of Cape Canaveral why the said conditions should not be declared to be nuisances and abated. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CAPE CANAVERAL, AS FOLLOWS: SECTION 1. The proper officers of this City are hereby authorized and directed to give the following named registered owners of the following described parcels of land, notice to appear before the City Council of the City of Cape Canaveral at 7:3G p.m. o'clock on the 21st day of February , 1967, at City Hall, and to show cause before the said Council why the individual condition of the said owned property should not be declared to be a nuisance and abated, or to abate the condition complained of in the interim; said condition of said property ® • being in violation of the before quoted provision of this City Charter of the City of Cape Canaveral. The names and addresses of the owners to be notified by registered mail (return receipt requested) are as follows: (1) P. L. Cummins, 350 Monroe Avenue, Cape Canaveral Lots 13, 14, 15, Block 21, Avon by the Sea Subdivision according to public records filed in the office of the Clerk of Circuit Court, Brevard County, Florida, (2) Howard M. Field, 910 Clearview, Lakeland, Florida Lot 14, Block 67, Avon by the Sea Subdivision, according to public records filed in the office of the Clerk of Circuit Court, Brevard County, Florida. (3) Joseph R. McLeod, 3219 Liddy Avenue, West Palm Beach Lot 12, Block 21, Avon by the Sea Subdivision, according to public records filed in the office of the Clerk of Circuit Court, Brevard County, Florida. (4) Vernon J. Nealey, 333 Madison Avenue, Cape Canaveral Lots 7, 8, 9, 10 & 11, Block 21, Avon by the Sea Subdivision, according to public records filed in the office of the Clerk of Circuit Court, Brevard County, Florida. (5) N. E. Pereira, 320 North Atlantic Avenue, Cocoa Beach Lot 16, Block 21, Avon by the Sea Subdivision, according to public records filed in the office of the Clerk of Circuit Court, Brevard County, Florida. SECTION 2. Notice shall be served upon each owner in compliance of the Charter of this City. SECTION 3. This Resolution shall take effect immediately upon its adoption.
