A RESOLUTION DETERMINING TO MAKE CERTAIN LOCAL STREET
IMPROVEMENTS IN CAPE CANAVERAL STREET IMPROVEMENT PRO -
JECT IN THE CITY OF CAPE CANAVERAL, FLORIDA, ADOPTING
THE ASSESSMENT PLAT AND PLANS AND SPECIFICATIONS SUB-
MITTED BY THE CONSULTING ENGINEERS; DETERMINING TO
DEFRAY THE EXPENSE THEREOF BY SPECIAL ASSESS14EIlTS
AGAINST THE PROPERTIES BENEFITED THEREBY;AND DIRECTING
THE ENGINEERS TO MAKE AND FILE WITH THE CITY COUNCIL
AN ASSESSMENT ROLL COVERING SUCH LOCAL STREET IMPROVE -
MENTS; PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CAPE
CANAVERAL, FLORIDA, that:
SECTION I. The assessment plat and pLans and specifica-
tions for certain local street improvements, including the
repair, grading, paving, widening, guttering, hard surfacing
and draining in " Cape Canaveral Street Improvement Project"
in the City of Cape Canaveral, Florida, prepared by the Con -
sulting Engineers and presently on file with the City Clerk
are hereby adopted and approved. The location of such local
street improvements ( herein called "project ") is hereby des-
cribed as follows:

A 20 foot wide asphaltic concrete pavement, with two 24" curbs,
including base and all excavation and stabilization extending
along the following named streets and including all intersec-
tions except Ridgewood Avenue, and State Road 401 -AIA.
Johnson Avenue - between 401 -AIA and a point 290 feet
more or less east of center line of Ridgewood Avenue.
Lincoln Avenue - between 401 -AIA and a point 290 feet
more or less east of center line of Ridgewood Avenue.
Buchanan Avenue - between 401 -AIA and a point 290 feet
more or less east of center line of Ridgewood Avenue.
Pierce Avenue - between 401 -AIA and a point 290 feet more
or less east of center line of Ridgewood Avenue.
Fillmore Avenue - between 401 -AIA and a point 290 feet
more or less east of center line of Ridgewood Avenue.
Taylor Avenue - between 401 -AIA and a point 290 feet
more or less east of center line of Ridgewood Avenue.
Polk Avenue - between 401 -AIA and a point 290 feet more
or less east of center line of Ridgewood Avenue.
Tyler Avenue - between 401 -AIA and a point 290 feet more
or less east of center line of Ridgewood Avenue.
Harrison Avenue - between 401 -AIA and a point 290 feet
more or less east of center line of Ridgewood Avenue.
Jackson Avenue - between 401 -AIA and a point 290 feet
more or less east of center line of Ridgewood Avenue.
Monroe Avenue - between State Road S 401 and a point 290
feet more or less east of the center line of Ridgewood
Avenue.

feet more or less east of center line of Ridgewood Avenue.
Jefferson Avenue - between State Road S -401 and a point 290
feet more or less east of center line of Ridgewood Avenue.
Adams Avenue - between State Road S -401 and a point 290 feet
more or less east of center line of Ridgewood Avenue.
Washington Avenue - between State Road S -4n1 and a point 290
feet more or less east of center line of Ridgewood Avenue.
Long Point Road - from State Road S -401 to a point approxi-
mately 1,185 feet to the west.
Church Lane - from State Road S -401 to a point approximately
950 feet to the west.
Holman Road - from State Road 401 -AlA west to a point approx-
imately 560 feet.

A 30 foot wide asphaltic concrete pavement with two 24" curbs, in-
cluding base and all excavation and stabilization extending along
Ridgewood Avenue from a point 149 feet moreor less south of center
line of Johnson Avenue to a point 1,430 feet more or less north of
the center line of Washington Avenue.

Beach Parking Areas consisting of Asphaltic concrete pavement in-
cluding base and all excavation and stabilization , extending
east over the following named streets from unnamed Alley, with
the width and length of each.

SECTION 2. It is hereby determined to construct such
project and to defray the cost thereof by special assessments
to be levied against the properties benefited. The nature of
the proposed public improvements is the construction of cer-
tain street improvements in the City, including the repair,
grading, paving, widening, guttering, hard surfacing, and
draining. Such assessments shall be paid in not exceeding
ten (10) equal yearly installments with interest at the rate
of not exceeding seven per centum (7 %) per annum on the un=
paid balances from the date of acceptance by the City Council
of such project, to which, if not paid when due, there shall
be added a penalty of one per cent (1 %) per month until paid,
provided that such assessments may be paid without interest
at any time within thirty (30) days after the project is
completed and a resolution accepting the same has been adopted
by the City Council. Such special assessments shall be levied
on a front foot basis against all lots and lands adjoining and
contiguous or bounding and abutting upon such improvements or
specifically benefited thereby and further designated by the
assessment plat. The assessments shall be levied against such
properties in direct proportion to the benefits received from
the construction of the project. The total estimated cost of
such improvements is $720,000.00. No part of such cost shall
be paid from the general fund of the City.
SECTION 3. The assessments as finally determined and
adjusted shall be payable at the office of the City Clerk. The
first installment of such assessment, together with interest
upon the whole assessment, shall be due and payable in cash
on the first day of the month which is one (1) year from the
date of acceptance of the project by the City Council, and a
like payment, together with interest upon the unpaid balance
of the assessment, shall be due and payable on the same date
in each and every year thereafter until paid in full; provided,
however, that such assessments may be paid in full without int-
erest at any time within thirty (30) days after the adoption
of a resolution accepting the completed project; and that un-
paid balances of assessments may be paid at any time by payment
of the principal and interest thereon to the next quarter- annual date.

SECTION 4. The Consulting Engineers are hereby directed
to promptly make and file with the City Council an assessment
roll, on the front foot basis, showing the lots and lands
assessed, the amount of the assessment, against each lot or
parcel of land, which assessments, if not paid in cash, shall
be divided into not exceeding ten (10) equal annual install-
ments.
SECTION 5. The City Clerk is hereby directed to cause
this resolution to be published one time in a newspaper of
general circulation published in the City of Cape Canaveral,
Florida; and if there be no newspaper published in the City,
this resolution shall be published once a week for a period
of two weeks in a newspaper of general circulation published
in Brevard County, Florida.
SECTION 6. This resolution shall take effect immediately
upon its adoption.
