WHEREAS, there exists an Agreement between the City of Cape Canaveral, Florida, and Five Beaches Cable TV Inc., dated 15 September 1989, providing in Section X that a schedule of charges may be submitted to Council on every 2nd anniversary of the Agreement, for approval, and WHEREAS, the Five Beaches Cable TV, Inc, has submitted a schedule of charges which the Council has reviewed and approved commencing on September 15, 1988, NOW, THEREFORE, Be it resolved by the City Council of the City of Cape Canaveral, Florida, SECTION 1. That there be established under the Agreement between the City and Five Beaches Cable TV, Inc., a schedule of charges and installation fees as set forth in the schedule attached hereto and made a part hereof and marked "Exhibit A ". SECTION 2. This resolution shall become effective on September 15, 1988. ADOPTED BY THE CITY COUNCIL OF THE CITY OF CAPE CANAVERAL, FLORIDA, on this 3rd day of September 1988. During that work- shop session the Council indicated that at their regularly scheduled meeting which is to take place on Tuesday, September 3, 1968 that they would approve the Schedule of Charges sub- mitted by Five Beaches Cable W. Inc. This Schedule of Charges is attached to this letter, marked "Exhibit All and is incorp- orated herein by reference. During the workshop session in the capacity as Vice President of Five Beaches Cable TV, Inc., I agreed that the Schedule of Charges as attached would not be negotiated to a lower figure with the Commission of the City of Cocoa Beach. I further agreed that in the event that this Schedule of Charges was reduced within the City of Cocoa Beach as finally determined by a court of competent jurisdlctlots, that Five Beaches Cable TV, Inc. would agree that the name reduction would be applied to the subscribers within the City of Cape Canaveral. It is our understanding that the Schedule of Charges attached hereto is to be passed by the Council of the City of Cape Canaveral on the basis outlined above. RSHsa 9 With cordial regards. Ralph S.
