RESOLUTION NO. 88 -13
A RESOLUTION ORDERING CERTAIN PROPERTY OWNERS TO
ABATE NUISANCE CONDITIONS OR THEIR PROPERTY OR TO
SHOW CAUSE WHY THEIR PROPERTY SHOULD NOT BE DECLARED
A NUISANCE AT A CERTAIN TIME AND PLACE; REPEALING
RESOLUTION NO. 67 -86; PROVIDING AN EFFECTIVE DATE.
WHEREAS, Section 3 of Article XXII of the Charter of the City of Cape
Canaveral, passed and adopted by the Legislature of the State of Florida,
provides
The presence of garbage, refuse, surface closets, dead animals,
trash, waste and unused lumber or other waste material sawdust
or debris of any kind, or woods or high grass produces and harbors
mosquitoes and dangerous reptiles, increases the danger of fires
and the spread thereof, and produces unpleasant odors, stenches
and smells and is otherwise dangerous to the health, comfort,
convenience and general welfare, and the existence of any such
condition is hereby declared to be a. nuisance,
and
WHEREAS, Section 1, paragraph :8 of Article B, provides the City
with the power "to define, prevent and abate all nuisances ", and
WHEREAS, the City Council has the power and authority to abate such
nuisances by requiring the owner of any property to remove therefrom all
such garbage, refuse, trash, waste, or other unused lumber or other waste
material, debris of any kind or woods and high grass, or to abate same on
an emergency basis, and
WHEREAS, the building official of this City and the City Manager have
reported to this Council that a nuisance does exist on certain lands within
the City, and on an emergency basis the City Building Inspector and City
Manager has provided immediate clearing, and
WHEREAS, such officials of this City have requested that the owners
of the following described land be given notices to abate the said complained
of nuisances or to show cause before the City Council of the City of Cape
Canaveral why the said conditions should not be declared to be nuisances
and abated or why the City should not have abated same on an emergency
basis.
NOW, THEREFORE, BE IT
RESOLVED BY THE CITY COUNCIL OF THE
CITY OF CAPE CANAVERAL, AS
FOLLOWS:
.SECTION 1. The proper officers of this City are hereby
authorized and directed to
give the following named titled owners
of the following described
parcels of land, notice to appear be-
fore the City Council of the
City of Cape Canaveral at
o'clock on the
1968, at the City
Hall, and to show cause before the said Council why the individual
condition of the said property should not be declared to be a
nuisance and abated, or to
abate the complained of in
the interim; or show cause
why the City couldn't abate such nui-
sance as an emergency, said
condition of said property being in
violation of the before quoted
provisions of the City Charter of
the City of Cape Canaveral.

SECTION 3. Notice of this action of the City Council shall

of which in incompliance with the Charter of thin City. Such
registered or certified mail properly addressed to the owners here

SECTION 2. Resolution No. 67 -66 heretofore adopted on Decem-
ber 19, 1967, is hereby repealed.
SECTION 3.. Notice of thin action of the City Council shall
be served upon each owner named herein by registered mail or certi•
fied mall of the Government of the United States of America, all
of which is in compliance with the Charter of thin City. Such
registered or certified mail properly addressed to the owners here-
in should be dispatched by the City Clerk or Building Official thei .
being in a position to swear or attest at the public hearing set
forth herein as to the fact of notice having been given to the
owners beforementioned.
SECTION 4. Thin Resolution shall take effect immediately upoi
its adoption.
