on real property located in the City of Cape Canaveral, Florida,

RESOLUTION NO. 69-15
RESOLUTION AUTHORIZING SPECIAL REFERENDUM ELECTION
ON JUNE 3, 1969, FOR FREEHOLDERS OF THE CITY OF CAPE
CANAVERAL, FLORIDA, TO VOTE ON ESTABLISHING AN ANNUAL
TAX RATE ON REAL PROPERTY TO BE LEVIED OR IMPOSED BY
THE CITY OF CAPE CANAVERAL, FLORIDA; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Charter of the City of Cape Canaveral, Florida, in
Article XVIII, Section 6, provides:
SECTION 6. LIMITATION ON REAL PROPERTY TAXES
No tax on real or personal property shall be levied or
imposed by the City Council in excess of such limitation on
the annual rate thereof as has been approved by at least a
majority of the freeholders voting in the City of Cape Canaveral
in a referendum election called by the City Council for that
purpose. Such maximum limitation on the annual rate of tax
levy shall remain effective unless and until such limitation is
changed as hereinafter provided. Such referendum shall be
held in compliance with the ordinance providing for special
elections. The limitation imposed by such referendum may
be changed at any time, but only by referendum held in the
same manner as provided herein for establishing the original
limitation.
WHEREAS, the Council of the City of Cape Canaveral proposes to
call a tax rate referendum election on June 3, 1969, for the purposes of
raising funds to expand City services in the areas of police and/or
recreation land acquisition and facilities, and/or fire protection;
NOW, THEREFORE, he it resolved by the City Council of the City
of Cape Canaveral, Florida, as follows:
SECTION 1: The City Council of the City of Cape Canaveral does
hereby authorize and call a special referendum election of freeholders of the
City of Cape Canaveral, Florida for June 3, 1969, to establish, approve or
disapprove a limitation on annual rate of tax to be imposed by the City Council
on real property within the City of Cape Canaveral, Florida, for the year
1969 and years thereafter until changed pursuant to the provisions of the
City Charter.
SECTION 2: The freeholders of the City of Cape Canaveral, Florida,
shall vote at the special referendum election to be held on June 3, 1969, on
each of the following propositions:
(a) The City of Cape Canaveral, Florida, shall levy a tax
on real property located in the City of Cape Canaveral, Florida,
not otherwise exempt by law, at the rate not to exceed .5 mills
per year for four (4) years for construction of police station, jail
and courtroom facilities estimated to cost not more than $50,000.00
plus a rate not to exceed 1.0 mills per year and yearly thereafter
for maintenance and operation cost of said police station, jail and
courtroom facilities.
(h) The City of Cape Canaveral, Florida, shall levy a tax on
real property located in the City of Cape Canaveral, Florida, not
otherwise exempt by law, at the rate not to exceed .5 mills per year
for four (4) years for recreation land acquisition and recreation
facilities estimated to cost not more than $50,000.00, plus a rate
not to exceed .5 mills per year and yearly thereafter for maintenance
and operation of said recreation facilities.
(c) The City of Cape Canaveral, Florida, shall levy a tax on
real property located in the City of Cape Canaveral, Florida, not
otherwise exempt by law, at the rate not to exceed .5 mills per year
and yearly thereafter for fire protection.
SECTION 3: The approval of each of said propositions set forth in
Paragraph 2 by at least a majority of the freeholders voting in the special
election above described, shall establish the authority of the City of Cape
Canaveral, Florida, to impose the taxes so approved on real property in the
City of Cape Canaveral, Florida.
SECTION 4: The effective date of the Resolution shall he upon the
adoption hereof.
ADOPTED by the City Council of the City of Cape Canaveral, Florida,
this 30th day of April, 1969.
